HomeMy WebLinkAboutOrdinance 6801 ORDINANCE NO. •J AN ORDINANCE PROVIDING THAT A PORTION OF RIGHT-OF- WAY ON THE SOUTH SIDE OF EAST LANCASTER AVENUE ADJACENT TO TRACT 7-B OF THE G. N. BUTTS SURVEY EASTWARD FROM WEILER BOULEVARD BE VACATED, ABAN- DONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portion of the right-of-way of East Lancaster Avenue be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except that easements are reserved for any and all existing utilities: Being a strip of land 17.0 feet in width in the G. N. Butts Survey, in the City of Fort Worth, Tar- rant County, Texas, and described by metes and bounds as follows: BEGINNING at the present point of intersection of the south line of East Lancaster Avenue with the east line of Weiler Boulevard, said point being North 00° 17' East 213.0 feet from the northwest corner of Lot 1, Whispering Oaks Subdivision to the City of Fort Worth, according to the plat recorded in Vol. 388-28, page 521, Deed Records of Tarrant County, Texas; THENCE North 000 17' East with the projected east line of Weiler Boulevard 18.2 feet to an iron pin for corner in the proposed south line of East Lancaster Avenue; THENCE South 670 53' East, along the proposed south line of East Lancaster Avenue, 293.9 feet to an iron pin for corner; THENCE South 1° 12 ' West 18.25 feet to a point for corner in the present south line of East Lancaster Avenue; THENCE North 670 53' West, along the present south line of East Lancaster Avenue, 293.7 feet to the point- of beginning, and containing 4,995.0 square feet of land more or less. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Joe H. Daniel has requested that the City vacate a portion of right-of-way on the south side of East Lancaster Avenue in the 5650 block, 17 feet in width StLARDI FAIGEand 293.6 feet in length eastward from Weiler Boulevard, as shown on the attached map. Subject right-of-way is located within the parkway of East Lancaster and there are existing sanitary sewer, gas and electric facilities located therein. The reviewing City departments and private utility companies have no objection to this request provided the applicant submits a satisfactory replat retaining the vacated right-of-way as an easement for existing utilities. Mr. Daniel has submitted a satisfactory replat. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right- of-way as requested. This 17 foot wide strip of right-of-way was originally declared excess by the County Commissioners when this part of East Lancaster was outside the City limits. In a number of cases, the adjacent property owners claimed the excess right-of-way but in this case, it had not legally been claimed therefore, it needs to be officially vacated by the City Council. Recommendation It is recommended that an ordinance- be adopted vacating subject right-of-way as recommended by the City Plan Commission. RNL:mj Attach.
