AN ORDINANCE AMENDING CHAPTER 16 OF THE FORT WORTH CITY CODE (1964) , AS AMENDED, WHICH CHAPTER REGULATES SOLID WASTE COLLECTION, FEES, AND DISPOSAL, BY AMENDING SUBSECTION (a) OF SECTION 16-19, DUMPING FEES, BY INCREASING THE FEE PERTAINING TO REFUSE CONTAINER VEHICLES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDI- NANCES; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That subsection (a) of Section 16-19 of the Code of the City of Fort Worth (1964) , as amended, be and the same is hereby amended so that hereafter same shall be and read as follows: (a) Persons disposing of refuse at any City operated disposal site, incinerator, dump or sanitary landfill, including persons holding a valid permit for private collection and dis- posal of refuse, shall pay a dumping fee for each and every load of refuse dump4bd or de- posited in accordance with the schedule of charges set out below. These charges shall not be applied to loads of refuse collected by the Texas Highway Department from rights-of-way of public streets and highways, nor to disposal of refuse resulting from the activities of any de- partment of the city government. (The acceptability of such ma- terial shall be determined by the Sanitation Superintendent or his arized representative and shall be delivered to sites designated by him.) SECTION 2. That this ordinance shall be cumulative of all pro- visions of the Code of the City of Fort worth (1964) , as amended, and all other ordinances of the City of Fort Worth, except in those instances where the. prvsrisions of this ordi- nance are in direct conflict with the provisions of such Code car other ordinances, in which instances said conflicting provisions of such Code or other ordinances are hereby re- pealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordi- nance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such uncon- stitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such un- constitutional phrase, clause, sentence, paragraph or section. SECTION 4. That the violation of any provision of this ordinance or of the Fort Worth City Code relating to the payment of fees therefor shall be deemed an offense and punishable by a fine not exceeding Two Hundred Dollars ($260.00) and each viola- tion thereof and each day there is a failure to comply with the terms of this ordinance shall be and is hereby deemed to be a distinct and separate offense and punishable as such. SECTION 5. That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained. The fee is charged for all commercial and private vehicles, except private automo- biles, depositing at the landfills. This fee was established on the basis of actual costs for processing refuse at the City's landfills, including land replacement costs, during the • period preceding the rate increase. As a result of increases in salaries, fringe benefits, and supply and equipment usage costs, and the purchase of additional earth-moving equipment for the landfills, the budgeted operating costs for the landfills in 1974-75 are considerably higher than in previous years. Based on the anticipated volume of refuse for the coming year, 273,000 tons, the cost per ton is projected at $3.59. During 1973-74, 948 permits were issued authorizing dumping at the City's sanitary landfills. Although some of the solid waste originates in the City of Fort Worth and is handled by commercial vehicles, some twenty nearby communities deposit all or part of their refuse in Fort Worth facilities. In fiscal 1973-74, 69,168 tons of refuse was delivered to the landfills by paying customers; this quantity represents 28 per cent of the total tonnage handled during the year. For the preceding year, the tonnage was 82,888.5 or 29 per cent. For 1974-75, the figure is estimated at 76,440; at the present charge of $2.80 per ton, a loss of $60,388 is projected from the handling of this material. In order to assure that all haulers pay a fair price for the disposal of I solid waste and that the use of the sites by others does not cause a loss to the citizens of Fort Worth, it is proposed that the fee be increased. Weights are calculated to the nearest quarter ton, and fees are charged accordingly. Payment is made at the time of dumping, either in cash or with tickets sold by the Health Department. It is therefore desirable that the fee be easily divisible by four, so that these transactions will not be unreasonably complicated. In order to recover current losses and to provide some margin for further cost increases, it is proposed that the fee be increased to $4.00 per. ton. It is proposed that the new fee be made effective January 1, 1975.
