AN ORDINANCE PROHIBITING PERSONS FROM INTERCEPTING
MESSAGES CONVEYED AND COMMJNTICATED BY THE CITY OF
FORT NORTH RADIO STATION KQAN OR KRLT AND FROM
USING THE SAID MESSAGES FOR THEIR BENEFIT OR THE
BENEFIT OF OTHERS; DECLARING SAID ORDINANCE TO BE
CUMULATIVE OF OTHER ORDINANCES AFFECTING TRAFFIC;
DEFINING TERMS; PRESCRIBING A SAVINGS CLAUSE; AND
PROVIDING A PENALTY FOR THE VIOLATION THEREOF.
AREAS, it appearing to the City Council that certain persons
have been intercepting messages communicated and conveyed by the City of '
Fort Worth radio stations KQAN and KRLJ, stations operated by the Police
Department exclusively for the protection of life and property, and using
said messages for their benefit and the benefit of others, and as a result
of the use of such communications, unnecessary emergency calls have been
made by rapidly moving vehicles, endangering life and property on streets
of the City of Fort Worth and creating a serious menace to traffic; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
The word "person" when used in this ordinance shall include both
singular and plural and shall mean and embrace any person, firm, Corpora-
tion, association of persons, lessee, partnership, and their representatives,
servants, employees or agents.
SECTION 2.
It shall be unlawful for any person, unless authorized to do so
by the sender of the radio message, to intercept any communication or message
transmitted over the City of Fort Worth radio station KQAN or KRLJ and
divulge or publish the existence, contents, substance, purpose, effect or
meaning of such intercepted communication or message, or to use such inter-
cepted communication or message for his own benefit or for the benefit of any
other person.

SECTION 3.
This ordinance shall be declared to be cumulative of all other or-
dinances of the City of Fort Worth regulating traffic, and shall not be
construed to repeal the provisions of any of such ordinances except insofar
as those provisions are in direct conflict with the provisions herein con-
tained.
SECTION 4.
The holding or adjudication of any section or part of a section
of this ordinance to be invalid shall not affect the validity of any other
section or part of a section, but all other provisions shall remain in
full force and effect. The City Council hereby declares that if it had
known that any part of said ordinance was invalid it would not have passed
the invalid provisions, but that it would have adopted those provisions
that are valid.
SECTION 5.
Any person violating any of the provisions of this ordinance shall,
upon conviction thereof, be fined in any sum not to exceed One Hundred
Dollars ($100.00), and each violation thereof shall be and is hereby de-
clared to be a distinct and separate offense and punishable as such.
SECTION 6.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage and publication as required by law.
