WHEREAS, the City of Fort Worth (City) and Teague Nall and
Perkins, (Engineer) made and entered into City Secretary Contract
No. 35498, (the Contract) which was authorized by the City Council
by M&C C-22144 on the 29th day of May, 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Cromwell Marine Creek and Comanche Culvert Improvements, Project No.
00478
WHEREAS, it has become necessary to execute Amendment No. 2
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in M&C C-24509,adopted
by the City Council on the 5th day of October, 2010 and further
amplified in a proposal letter dated July 21, 2010, copies of
which are attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by
Engineer total $90,600 .00.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not

Teague Nall and Perkins, Inc. is submitting thisAmendment to the above referenced contract based
on additional services requested. The following is a brief description and cost for the additional
services provided on this project:
Additional Services for Constructability Review
Prior to the 60 percent review meeting with the CITY, the ENGINEER shall schedule and
attend a project site visit with the CITY Project Manager and Construction personnel to walk
the project. The ENGINEER shall summarize the CITY's comments from the field visit and
submit this information to the CITY in writing.

Additional Services for Traffic Control Plan
The original project scope was written around the T/PW specification that provides for the
contractor to prepare a traffic control plan as a non-pay item. Since that time the
specifications have been updated to require a traffic control plan developed by the Engineer
as a part of the project. The following scope will provide for the inclusion of traffic control
plans and construction phasing necessary to construct the bridge.
Engineer will develop a traffic control plan utilizing standard traffic reroute configurations
posted as"Typicals" on the CITY's Buzzsaw website as applicable. The typicals need not
be sealed individually, if included in the sealed contract documents.
Engineer will develop supplemental traffic control drawings as needed for review and
approval by the Traffic Division of the Transportation and Public Works Department. These
drawings shall be sealed by a professional engineer registered in the State of Texas. The
following sheets are anticipated:

Additional Services for Bid Phase Services
ENGINEER will support the bid phase of the project as follows.
The ENGINEER shall upload all plans and contract documents onto Buzzsaw for
access to potential bidders. Contract documents shall be uploaded in .pdf files and
the plans in .pdf and AM files.
The ENGINEER shall sell contract documents and maintain a plan holders list from
documents sold and downloaded from Buzzsaw.
The ENGINEER will develop and implement procedures for receiving and answering
bidders' questions and requests for additional information. The procedures shall
include a log of all significant bidders questions and requests and the response
thereto. The ENGINEER will provide technical interpretation of the contract bid
documents and will prepare proposed responses to all bidders questions and
requests, in the form of addenda. The ENGINEER shall upload all approved
addenda onto Buzzsaw and mail addenda to al I plan holders.
Attend the bid opening in support of the CITY.
Tabulate and review all bids received for the construction project,assist the CITY in
evaluating bids, and recommend award of the contract.
Incorporate all addenda into the contract documents and issue conformed sets.
Provide 10 full size and 10 half size sets of conformed drawings to the City and 20
sets of specifications.

Additional Services for Construction Phase Services
ENGINEER will support the construction phase of the project as follows.
The ENGINEER shall attend the preconstruction conference.
After the pre-construction conference,the ENGINEER shall provide project exhibits
and attend public meeting to help explain the proposed project to residents. The
CITY shall select a suitable location and mail the invitation letters to the affected
customers.
The ENGINEER shall visit the project site at requested intervals as construction
proceeds to observe and report on progress.

The ENGINEER shall review shop drawings, samples and other submittals
submitted by the contractor for general conformance with the design concepts and
general compliance with the requirements of the contract for construction. Such
review shall not relieve the Contractor from its responsibility for performance in
accordance with the contract for construction, nor is such review a guarantee that
the work covered by the shop drawings, samples and submittals is free of errors,
inconsistencies or omissions.The ENGINEER shall log and track all shop drawings,
samples and other subm ittals.
As requested by the CITY,the ENGINEER shall provide necessary interpretations
and clarifications of contract documents, review change orders, and make
recommendations as to the acceptability of the work.
The ENGINEER shall attend the "Final" project walk through and assist with
preparation of final punch list.
■ No Additional Fee Required. These Services are included in the origi nal contract.
Additional Services for Record Drawings
The ENGINEER shall prepare record drawings from information submitted by the inspector
and/or Contractor. The drawings shall be submitted as full size(22"x 34") mylar drawings
with an estimated total of 45 sheets.

Additional Services for Storm Water Pollution Prevention Plan
For projects that disturb an area greater than one (1) acre, ENGINEER will prepare the
Storm Water Pollution Prevention Plan (SWPPP) required for the Project for use by the
Contractor during construction. ENGINEER will prepare drawings and details for proposed
SWPPP improvement that the Contractor must use during construction. Contractor will be
responsible for filing the SWPPP with appropriate regulatory agencies.
■ No Additional Fee Required. These Services are included in the origi nal contract.
Additional Services for ROW/Easement Services
ENGINEER will support and engage a Registered Professional Land Surveyor to perform
activities related to ROW and easements as outlined below,per direction and guidance from
the CITY's Project Manager.
Right-of-Way Research
The ENGINEER shall determine rights-of-way and easement needs for construction
of the project. Required temporary and permanent easements will be identified
based on available information and recommendations will be made for approval by
the CITY.

Right-of-Way/Easement Preparation and Submittal
The ENGINEER shall prepare documents to be used to obtain right-of-way
and permanent and/or temporary easements required to construct the
improvements.
Once right-of-way documents are approved, property corners will be set using
capped iron rods. Corners w ill not be set for easements.
The documentation shall be provided in conformance with the checklists and
templates available on the C ITY's Buzzsaw site.
Temporary Right of Entry Preparation and Submittal
Prior to construction,the ENGINEER shall prepare,mail and obtain Temporary Right
of Entries from landowners. It is assumed that letters will only be required for land
owners adjacent to temporary construction easements or who are directly affected
by the project and no easement is required to enter their property.
The documentation shall be provided in conformance with the checklists and
templates available on the C ITY's Buzzsaw site.

Additional Services for Park Conversion
This item includes the preparation of Park Conversion documentation for two park parcels.
One parcel is located to the north of the project area and includes an area of approximately
5,000 SF needed to construct a cul-de-sac. The second parcel runs parallel to the existing
right-of-way and south of the project area.
Work under this item generally includes the preparation of up to two exhibits showing the
park conversion area with aerial imagery and property lines. Metes and bounds will be
prepared describing the two areas with appropriate calls to existing monumentation,
property ownership,etc. Once documentation has been prepared,it will be submitted to the
City of Fort Worth Parks Department using the appropriate submittal forms.

Additional Services for Cul-de-Sac Design
The east approach to the bridge requires a street closure for proper design and public
safety. There is not sufficient spacing or adequate sight distance to allow turning
movements to occur from Cromwell-Marine Creek to or from Whitewater Trail. The following
fee represents topographic survey and engineering design to provide a cul-de-sac at the
end of Whitewater Trail.

Additional Services for Trail Design/Bridge Elevation Changes
Based on discussions and meetings with the parks department, the bridge elevation must
change to allow 10-feet of clearance for a trail crossing under the bridge along the east
bank of Marine Creek. The bridge design will also be widened to allow for a six-foot wide
trail along the south side. Design changes include revising the height and width of the
bridge structure, revising the paving plan and profiles on both approaches, revising storm
drain plans and profiles, revising drainage area maps and calculations, and revising
specifications and pay items. These revisions also require a site visit to review of existing
project conditions relative to current survey data.

Additional Services for Hydraulics/Hydrology Revisions
Revising the bridge height and adding the trail requires revisions to the Hydrologic modeling
and the hydraulic analysis as follows:
Hydrologic Analysis
The hydrologic model will be revised to add a 5-year return event. The resulting
fully-developed watershed condition for the 5-year event will be used to establish the
elevation of the trail under the bridge and the resulting low chord elevation for the
bridge.
Hydraulic Analysis
Once the 5-year return event is established, the hydraulic model for the proposed
bridge structure and trail paths will be revised to reflect design changes.
A revised analysis report in both digital and hard copy Format will be provided to the
City. Up to one (1) draft revisions sets will be prepared for review and comment in
preparation of final exhibits, report and documents.

Additional Services for Trail Design
Based on meetings with the Parks Department, plans will be revised to incorporate
approximately 1,800 linear feet of six-foot wide concrete trail. The trail will extend from the
library site along the south right-of-way across the proposed bridge to the east. The trail will
then run down along the southeast embankment and under the proposed bridge. The trail
will turn east and extend up to connect to the proposed cul-de-sac at Riverwater Trail. The
trail will conform to ADA requirements and Engineer will coordinate a TDLR plan review.

City.

Additional Services for Sanitary Sewer Replacement
Based on direction and alignments received from the Water Department, plan revisions will
be made to relocate the existing 8-inch and 30-inch sanitary sewer lines such that they are
not located under the approach slabs of the bridge structure. Plan and profile views of the
sewer line relocations will be developed based on supplementary topographic survey data.
City details will be used in addition to special details for connections to the 30-inch lines. In
addition, a sanitary sewer easement revision will be prepared based on the new alignment.
It is assumed that the existing easement will also remain and will not be vacated.
Approximately two plan and profile sheets will be required along with one detail sheet.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in
the amount of$90,600.00 to City Secretary Contract No. 35498 with Teague Nall & Perkins,for the
Storm Water Utility Project-5100 Cromwell Marine Creek Culvert and Comanche Trail Culvert
Improvements,thereby revising the total contract cost to$256,315.00.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve
streams, minimize water pollution and to operate the storm water system in a more effective manner
to fully comply with state and federal regulatory requirements. This will be accomplished by
infrastructure reconstruction and system maintenance, master planning, enhanced development
review, and increased public education and outreach. On September 22, 2009, (Ordinance No.
18838-09-2009)the City Council approved the issuance and sale of$45,000,000.00 in revenue
bonds for the Storm Water Capital Projects Bond 2009 Fund, to fund a two-year storm water capital
project program.
A request for qualifications to provide drainage design was issued by the City in January of 2006 and
(24)design consultants submitted statements of qualifications, including Teague Nall & Perkins.
On May 29, 2007, (M&C C-22144)the City Council authorized the City Manager to execute an
engineering agreement with Teague Nall & Perkins, for a lump sum fee of$224,676.00.
On May 28,2008, Amendment No. 1 was executed administratively for a fee reduction of$58,961.00.
Amendment No. 1 removed scope involving Comanche Trail Culvert Improvements from the
Contract.
Amendment No. 2 includes the design of a permanent street closure with a cul-de-sac, traffic control
plans, storm water pollution prevention plan, additional right-of-way and easements services and
additional scope for bid phase and construction phase services.
Teague Nall & Perkins, proposes to perform the design services for a lump sum fee of$90,600.00.
City staff considers the fee to be fair and reasonable for the scope of services proposed.
Teague Nall & Perkins, agrees to maintain the initial M/WBE commitment of 18 percent that it made
on the original agreement and extend and maintain that same M/WBE commitment of 18 percent to
all prior amendments up to and inclusive of this Amendment No. 2. Therefore Teague Nall &Perkins,
remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its

signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized
representative of its company.
This project is located in COUNCIL DISTRICT 7, Mapsco 47A.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Storm Water Capital Projects Bond 2009 Fund.
