BE IT ORDAINED BY THE BOARD OF 049ISSIONERS OF THE CITY OF FORT WORTH: Section 1: That the right, privilege and franchise is hereby given and granted to the Fort Worth Belt Railwa Company, its successors and assigns, for a period of twenty- .ive years to con- struot, maintain and operate an extension of its present line of railway ,berrOueseit; ing at the point of interjection of the right-of-way of the Sts, San Francisco Railway ompany of Texas, with North Commerce thence southward crossing the right-of-way of the St.Louis Southwestern Railway Company of Texas, and over and along North Commerce Street to the intersection of North Commerce Street and Second Streets, a distance of less than one mile, as more particularly shown by a drawing of sai&71ine of railway tracks hereto attached ana made a part of this Ordinance, with the right, privilege and 'franchise to maintain and operate said line of railway for the purpose of operating steam cars and trains thereon and thereover as an extension of said belt line or switch line of railway tracks. Section 2: This fndnohise is granted nepon the condition that the said grantee, its successors and assigns, will lay and construct said tracks in such a manner as to conform to the grade of the streets over which it passes as fixed and established by the City of Fort Werth, and that it will coxts.trazi said tracks of first class material and keep and maintain the same in like manner, and restore 'the UV.V%VVV- -- after the construction of the same to such a condition as will not impede or interfere with public travel. Section 3: The Fort Worth Belt Railway Company, its successors and-assigns, shall be bound to pave said streets above mentioned from time to time or so much of the same as is occupied by its tracks, and for eighteen inches on each side thereof, with such material and like material as that with which the street may be paved,. Section 4: The Fort Worth Belt Railway Company, its successors and assigns, furthermore agree to indemnify and hold the City of Fort Worth harmless against all costs, injury or damage which may be occasioned as a result of the construction, maintenance or operation of its line on said streets. Section 5: This 'Ordinance is passed and the right, privi- lege and franchise herein given upon the express understanding and agreement that the said Fort Worth Belt Railway Company shall not hereafter claim any right or franchise under the Ordinance hereto- fore passed on the 30th day of November, 1912, and No.344, granting to the said Fort Worth Belt Railway Company the right to construct, maintain and operate an extension of its present line of tracks on Broiles Street in the City of Fort Worth, beginning at a point of connection with its present line of tracks on Broiles Street; thence southwesterly along and over said Broiles Street to Groves Street; thence across Groves Stet and Jones Street and Calhoun Street to North Commerce Street about its intersection with North Tenth Street; thence southward over North Commerce Street to the intersection of Commerce and Sixth Streets, and the said Fort Worth Belt Railway Company does hereby agree that it will not hereafter claim any right or privilege under said Ordinance so granted and consents that the same may be repealed and•tire said Ordinance �.�` so granted shall be and is hereby expressly repeale Section 6: This Ordinance shall be published in the official newspaper once a week for four consecutive weeks, within . thirty days from and after Its passage, and shall take effect and be in force after said publication upon the said Belt Rail%M Company filing with the City Secretary its acceptance in writing of this Ordinance and all its provisions and conditions. e I hereby dertify that the above and fore going ordi:-ante was duly presented and unanimously passed and adopted by the Board of Com- missioners of the City of Fort Worth at a session of said Board held Tuesday January 20th,1914, City Secretary. 4
