ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF DILLARD AVENUE AND PUBLIC PLACES IN THE CITY OF FORT NORTH, TEXAS, DECLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID I14PROVF393+ITS FULLY COMPLETED AND PERFORMED, DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HERRIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY OF FORT WORTH. WHEREAS, the City of Fort Worth, Texas has heretofore entered into a contract with Texas Bitulithic Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues, and public places in said City, to-wit: DILLARD AVENUE: FROM THE NORTHERLY LINE OF RANEY AVENUE TO A POINT 200 FEET NORTH OF THE NORTHERLY LINE OF CALUMET STREET, KNOWN AND DESIGNATED AS UNIT NO. 3; and, WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance Nos. 3957 and 4161, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance Nos. 3957 and 1+161, and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public place herein- above described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with t he proceedings relating to such improvements -1- and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: -2- zzz. - When each of the certificates have been duly executed as hereinabove provided, same shall be delivered to Texas Bitulithic Company as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of theCity Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of the City of Fort Worth. The contractor has completed the construction in accordance with the plans and specifica- tions at a final contract cost of $72,645.03 with the property owner's portion being $50,762.41 and the City's portion being $21 ,882.62. Unit No. I L Weiler Boulevard and Unit No. 2 - Pyron Avenue has been completed and the ordinance accepting the improvements was adopted March 4, 1960. The contract price on Unit No. 3 - Dillard Avenue was $40,380.00. The final contract cost is $38,682.81 with the property owners portion being $28,514.62 and the City's portion being $10, 168. 19. It is recommended that an ordinance accepting the improvements on Unit No. 3 be adopted and Estimate No. 8 and Final in the amount of $ 1 ,016.82 be approved for payment.
