(Construction and Maintenance)
AN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND MAINTENANCE OF THE PORTION OF
STATE HIGHWAY NO. 550, IN THE CITY OF FORT WORTH, TEXAS BETWEEN THE FOLLOWING LIMITS
TO-WIT: WEST OF WINTHROP STREET AT THE WEST CITY LIMITS OF FORT WORTH TO CAMP BOWIE
BOULEPARD AND WEST EXPRESSWAY AS AN EXPRESSNAY AND AS A STREET, -HEREINAFTER REFERRED
TO AS "THE PROJECT" AND AUTHORIZING THE CITY MANAGER OF THE CITY TO EXECUTE AND THE
CITY SECRETARY TO AFFIX THE COPPORATE SEAL AND ATTEST THE SAME, A CERTAIN CONTRACT
BETWEEN THE CITY AND THE STATE OF TEXAS PROVIDING FOR THE CONSTRUCTION, MAINTENANCE,
EXISTZRCE AND USE OF SAID PROJECT AS A FREEWAY AND AS A STREET, AND DETE;MINING THE
LIABILITIES AND RESPONSIBILITIES OF THE CITY AND THE STATE OF TEXAS WITH REFERERCE
THERETO; AND DECLARING AN EMERGENCY AND PROVIDING THAT THIS ORDINANCE SHALL BE EFFEC-
TIVE FROM AND AFTER ITS PASSAGE.
WHEREAS, the public convenience, safety and necessity of the City, and the
people of the City, require that the portion of State Highway No. 550 from Winthrop
Street to Camp Bowie Boulevard,, be constructed, since the existing condition consti-
tutes a serious inconvenience to the public, which it is urgently required to be
remedied; and
WHEREAS, the City has requested the State of Texas to contribute financially in
the project; and
WHEREAS, the State of Texas has made it known to the City that State will assist
the City in the improvement, and maintenance of said project as a street and as a
Freeway, providing the City approves the plans for said project.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL:
SECTION 1. That since the public convenience, safety and necessity of the
City requires it, said project shall be constructed as a street and as a Freeway
as defined by House Bill No. 771, Acts 51st Legislature, Regular Session.
SECTION 2. That the State of Texas be and is hereby authorised to enter upon,
construct and maintain the project at the location and in the manner shown on the
plan attached hereto, marked Exhibit A", and me►de a part hereof in all respects.
SECTION 3. The City Manager of the City be and is hereby authorized to exe-
cute for and on behalf of the City an agreement and contract with the State of
Texas in accoPdance with and for the purpose of carrying out the terms and provi-
sions of this ordinance, in the form attached hereto and marked Exhibit W. The
City Manager of the City is further authorized to approve and sign the detailed
plans for construction of the project or any section thereof, when and as such plans
are completed and prior to award of construction contract by the State. The City
Secretary is hereby directed to attest the agreement and contract and to affix the
proper seal of the City hereto.
SECTION 4. The fact that there is an imperative necessity that the work
provided for in said contract be begun and carried out promptly, and that such
contract should accordingly be forthwith executed, creates a public emergency
requiring that this ordinance be passed finally on the date of its introdactioni

and the City Manager having in wtiting declared the existence of such emergency and
requested such passage, this ordinance shall be passed finally on the date of its

Dear Mr. Jones:
We are attaching hereto two copies of a proposed Agreement between
the State of Texas and the City of Fort Worth covering the first stage
of improvement of the expressway type of construction from Winthrop
Street to Camp Bowie Boulevard in the west end of the present East-West
Freeway.
We would appreciate very much if you would present this to your
City Council for their consideration at their next meeting and if agree-
able to them, you sign the same and return both copies to us with 4 copies
of executed Ordinance.
When the Agreement is executed by the State Highway Commission we
will then return one copy to you for your file.

WHEREAS, in Zfij T 20 . the State Highway Commission by Minute No.
33981, as passed on March 26,�1953, authorised the Improv mint of an aaoess, road
to serve the Consolidated-Vultes Plant from the Gonsoliduted-Valtee Plant to the
West Expressway on Can Bowie Boulevard in Fort Worth; and
WHERUS' the City of Fort Worth on April 1. 1953. accepted the terms
and conditions +of'Mirnte No. 33981; and
WMUS. the Govem men t b4s Agreed to ,the *bongo in the type of In-
provvmout between the on of th4 presently aonstmcted West I;xnrosaway to the
east and of the presently contracted portion of this meoess road near the West
city limits of Fort Worth but have advised through tha 7-Arena of Public Roads
that due to limited authorization by Caagress for access road improvements there
can be made available at this time for stage improvement only $230,000.00 and this
subject to each the City of Port Worth and the State making available $250,000.00.
NOW, TMMMRE, IT IS ORDERS IV the State Highway Oommission that to
aocomplisb the improvement of this road. to an expressway type Mtn-At# No. 3'_1981 be
modified so that with the Oevernrnent finally making available $640,500.00 for this
expressway type of improvement and the City of Port Borth agreeing to pay one-half
of the total of all costs over and above $W.500.00, the State will Likewise pay
one-half of the total of all costs over and. above $640.500.00.
IT I8 FARTHER ORDERED that upon the City of Fort North advancing to the
State $250.000.00 the State Righwsv Engineer be authorized to proceed with the
improvement of this road to an exprossway type on the basis of stags improvement.
The estimated *cot of the first stage of improvement is $750,000.00 with the
Government paying $250,000.00, the City of Fort north $230,000.00 and the State
$250,000.00.
I# IS AMTHER ORDERED that an appropriation of $250,000.00 is hereby
made to cover the State's shares of the first stage of i*rov meat of the express-
way type sootion of this road.
