AN ORDINANCE VACATING, ABANDONING AND CLOSING A
20 FOOT WIDE EMERGENCY ACCESS EASEMENT ALONG
THE SOUTH LINE OF BLOCK 3-R, LA VEA R. KILMAN
ADDITION, ADJACENT TO BLOCK 1, BRENTWOOD STAIR
SQUARE ADDITION, A LENGTH OF 99.7 FEET FROM NORTH
HANDLEY DRIVE WEST TO THE ALLEY AND A 10 FOOT
WIDE ALLEY ADJACENT TO LOTS 12 AND 13, BLOCK 2,
MINERAL WELLS ADDITION, A LENGTH OF 50 FEET;.
PROVIDING THE REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a 20 foot wide emergency access easement along
the south line of Block 3-R, LaVea R. Kilman Addition, adjacent
to Block 1, Brentwood Stair Square Addition, a length of 99.7
feet from North Handley Drive west to the alley and a 10 foot wide
alley adjacent to Lots 12 and 13, Block 2, Mineral Wells Addition,
a length of 50 feet be and the same are hereby vacated, abandoned and
permanently closed as emergency access easement and alley.
SECTION 2.
That the fee to the land in the above described easement
and alley vacations is hereby released and shall revert to the
adjacent owners as provided by law, SAVE AND EXCEPT that easements
are retained for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and it is
so ordained.

Casa.,Bonita, Inc. , dba Taco Bueno, with consent of other abutting owners, has
requested that the City vacate the 20' wide emergency access easement along the
south line of Block 3-R, La Vea R. Kolman Addition, adjacent to Block 1,
Brentwood Stair Square Addition, a length of 99.7' from North Handley Drive
west to the alley and to vacate the 10' wide alley adjacent to Lots 12 & 13,
Block 2, Mineral Wells Addition, a length of 501, as shown on the attached
map,
The subject alley and emergency access easement, acquired by dedication, are
not open and contain no utility or other public facilities.
Reviewing City departments and private utility companies have reviewed this
request and have no objections to this request as submitted, provided the subject
alley and easement are replatted with abutting property. A satisfactory replat
has been submitted to City staff.
The City Plan Commission has reviewed this request and recommends that the
subject alley and easement be vacated as requested.
Recommendation
It is recommended that subject alley and easement be vacated.
