WHEREAS, the City of Fort Worth (City) and DeOtte Inc. , (Engineer)
made and entered into City Secretary Contract No. 35548, (the Contract)
which was authorized by the City Council by M&C C-22182 on the 12th day
of June 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Westcreek-Kellis Park Drainage Improvements, Project No. 00630: DOE No.
5555
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I, of the Contract is amended to include the additional
engineering services specified in a proposal letter dated February 2,
2010, copies of which are both attached hereto and incorporated herein.
The cost to City for the additional services to be performed by Engineer
total $59,019.30.
2.
Article II, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $228,864.30.
3.
All other provisions of the Contract which are not expressly

Part 1—Geotechnical Engineering
In order to provide geotechnical design consistent with developing City design requirements, DeOtte, Inc. has been
asked to provide a geotechnical study including representative borings and engineering analysis and recommendations
consistent with the new City pavement design criteria as well as update the City's paving detail sheets to incorporate
the findings into the design. We anticipate having these services provided by Addula Consulting Engineers. This firm
is an MWBE firm(NCTRCA No. IMDB41677N0710).

Part 2—Survey and Engineering Design of Additional Erosion Control Improvements
Recent interactions with the Parks Department has revealed on-going concern about increasing erosion impacts in
Kellis Park at the downstream end of this project. As a result, additional erosion improvements have been requested
in the park at the downstream end of the project. Since there is existing erosion at a small drainage way, the
improvements are proposed to the immediate downstream side of an existing foot bridge. At this time, the
improvements are expected to include some armoring, likely of gabions and gabion mattress, along the banks and
flow line of the creek. Since the impacts will involve less than 300 linear feet of creek, no Corps of Engineers
permitting under Section 404 of the Clean Water Act is included in this amendment. In order to complete this task,
additional survey will be required including topography and trees, as well as channel conditions. Engineering design
will include appropriate plan, profile, cross sections and details for a competent and qualified contractor to build.
Parks and Recreation Services has directed that the plan improvements address that seeding shall be established until
it is accepted by the PACS, that the conversion documents clearly identify the clearing limits, that conversion exhibit
indicate the edge of improvements as the limits of conversion, that the restoration limits be shown on the plans and
that a formal legal description will not be needed as long as the exhibit is clear. The survey will be provided by
Gorrondona and Associates, an M/WBE firm. Some of the required area has already been surveyed but site features
and additional area will have to be provided.

Part 3—Additional City Meetings &Review
The City's review of the plans at various stages resulted in the following timeline:
TIMELINE:
11/07 60% submittal (4 copies plans—2 copies specs) were delivered to Richard Argomaniz,
COFW.
04/08 Richard DeOtte attended a design review meeting and comments were received from
the City of Fort Worth on the subject plans.
06/08 90% submittal (4 copies plans — 2 copies specs) were delivered to the City of Fort
Worth for review.
01/09 Water and Sewer 60%review comments were received from the City of Fort Worth
04/09 90% Submittal made to the City of Fort Worth incorporating Water and Sewer
Comments.
06/09 90% Review meeting held with Stormwater. It was determined at the meeting that an
additional 90%review submittal would be required.

As a result, DeOtte, Inc. has will be required to prepare and submit three separate 90% review packages. The
following is a breakdown of the additional costs incurred by the additional submittals.

Also, additional meetings were held with the City for the transition of PMs, the resolution of the confusion over the
basis for the determination of runoff used as the basic design criteria (which had been established early on in the
design process but was revisited at the 90%review stage), and two additional 90%review meetings to review the 90%
submittal packages. The contract includes within Basic Services meetings listed in Attachment "A-1". The contract
also includes a total of$2,000 for "Meetings and Reports" under Exhibit `B-313", Additional Services. These fees
were intended to cover the preparation of Monthly Status Reports, M/WBE Reports, Utility Clearance Meetings,
ROW Meetings, and impromptu face to face meetings with the assigned Project Manager to discuss the progress and
details of the project in the normal course of completion. These meetings and reports are still required by the project
and will continue to be performed. The additional meetings below are considered to be over an above the original
contract requirements.

A Park Conversion will be required for this project. Once the extents of improvements are known, an application,
exhibit, coordination and meetings are required in this process. Approval from both the Parks Board and the City
Council are required.

As the project as developed, it has become apparent that an additional utility easement will be needed. Additionally,
survey research has determined that street pavement along the radius at the intersection of West Creek and South
Ridge (northeast corner) is actually on a single family lot. The City has determined to obtain the necessary right-of-
way of this portion of the street. DeOtte, Inc. will have a right-of-way taking exhibit prepared for the City's use in
obtaining the property. Some meeting time and coordination is included in our costs.

Park Drainage Improvements (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the
amount of$59,019.30 to City Secretary Contract No. 35548 with DeOtte,Inc.,thereby,revising the total
contract cost to$228,864.30.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth,preserve streams,
minimize water pollution and to operate the storm water system in a more effective manner to fully comply
with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction
and system maintenance,master planning,enhanced development review,and increased public education and
outreach. On September 22, 2009, (Ordinance No. 18838-09-2009)the City Council approved the issuance
and sale of$45,000,000.00 in revenue bonds in Storm Water Revenue Bonds, Series 2009,to fund a
two—year storm water capital project program.
A request for qualifications to provide drainage design was issued by the City in January of 2006 and
twenty—four(24)design consultants submitted statements of qualifications,including DeOtte,Inc.DeOtte,
Inc. was selected to study the drainage in the subject area and provide design services for drainage
improvements for the Westcreek—Kellis Park Drainage Improvements project(City Project No.00630)
which will reduce flooding by improving the culvert connecting Westcreek and Kellis Park.
On June 12,2007, (M&C C-22182)the City Council authorized the City Manager to execute an engineering
agreement with DeOtte, Inc.in the amount of$132,545.00 for the design of Westcreek—Kellis Park Drainage
Improvements.
On September 16,2008, (M&C C-23037)the City Council authorized the City Manager to execute
Amendment No. 1 for a lump sum fee of$37,300.00.Amendment No. 1 included additional design effort to
implement drainage and erosion control measures as recommended in the Upstream Drainage Study
performed by DeOtte,Inc. as part of conceptual design.
The need for additional design scope has been identified.Amendment No. 2 will provide the following:
geotechnical engineering,traffic control,parks conversion,and additional right—of—way and easement
document preparation.
DeOtte,Inc.proposes to perform the design services for a lump sum fee of$59,019.30.City staff considers
the fee to be fair and reasonable for the scope of services proposed.
DeOtte,Inc.is in compliance with the City's MWWBE Ordinance by committing to an additional 20 percent
MWWBE participation on this Amendment No.2.The City's goal on this amendment is 20 percent.
This project is located in COUNCIL DISTRICT 3,Mapsco 89M.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds are available in the current capital budget,
as appropriated,of the Storm Water Revenue Bonds, Series 2009.
