WHEREAS, the City of Fort Worth (City) and Huitt-Zollars, Inc. ,
(Engineer) made and entered into City Secretary Contract No. 24765,
(the Contract) which was authorized by the City Council by MSC C-
17319 on the 16th day of March, 1999 and subsequently revised by
four previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Extension of Bellaire Drive South from the existing western
terminus to Bryant Irvin Road.
WHEREAS, it has become necessary to execute Amendment No. 5 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I, of the Contract is amended to include the additional
engineering services specified in MSC C-22228, adopted by the City
Council on the loth day of July, 2007, and further amplified in a
proposal letter dated March 1, 2007 copies of which are both
attached hereto and incorporated herein. The cost to City for the
additional services to be performed by Engineer total $29,173.00.

Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the total
fee paid by the City for all work and services shall not exceed the
sum of $664,182. 60.

Dear Liam:
I appreciate your consideration of the March 20, 2006 and July 6, 2006 letters documenting
scope variances and tasks and clarifying subsequent submittal items required by Huitt-
Zollars, Inc. to finalize this additional compensation request.
My discussion in December 2006 with Rick Trice reviewed the tasks and confirmed the
city's acknowledgement of the tasks performed and the product delivered to the City.
Item 1. Baseline Survey:
Overtime amount of$5,189.00(delta) for permanent survey staff is acceptable to both the
CFW Department of Engineering Staff and Huitt-Zollars, Inc. In addition,two summer
interns logged overtime, totaling $5,330.10. HZ requests compensation for half of this
amount or $2,665.00. Total revised compensation request for Baseline Survey is $7,854.00.
Impact $ 7,854.00
Item 2. Rough Grading Packages:
Rough Grading Packages—To accommodate a City commitment to "have dirt flying"by
December 2005, early start packages of Rough Grading Phase I and Phase II were
identified and added to our scope. Creating two additional packages for review and then
advertising and bidding takes effort. The goal was met.
Impact $ 3,500.00

Item 3. Miscellaneous Roadway Alignment Changes:
After exercising an approval process for the Arborlawn roadway to set the alignment,the
road continued to move for various reasons. First changes were made on the east end to
accommodate the landowner. Changes were made to the western section to meet the
clearance requirements for the Big Tree. Design proceeded through the rough grading
packages. After the contractor had been selected for the rough grading packages, an
additional change was made on the west end at the intersection with Bryant Irvin Road for
both location of intersection and addition of free right turn lane. As we understand this,the
change was landowner and development driven.
Please note that tasks associated with this item spanned a time period from Dec. 2005
through early March 2006. Following Phase II contract award, a plan profile sheet for 24"
and 72" RCP culverts at stations 25+50 and 32+00 respectively was requested by DOE and
provided. Following the Feb. 27th pre-con meeting, a spot elevation plan revision detailing
right turn lane transition and island was prepared to accommodate DOE Survey Staff
staking request. These additional items were overlooked in the March 20, 2006 scope
variance/additional task letter. HZ requests the original impact amount of$13,208 for tasks
associated with Item 3., Alignment Changes.

Item 4. Survey-Land Parcels/Slope Easements:
Survey was also impacted by the change at the intersection at Bryant Irvin Road since the
land parcels and slope easement had already been done and had to be redone. This effort
also included park land documents and exhibits for the park buffer.
Impact $ 3,831.38
Item 5. Rough Grade Excavation Check:
An additional task, Item 5,rough grade excavation check was requested by DOE
following excavation by contractor. DOE Survey Crews cross-sectioned excavated
roadway along entire alignment for Rough Grade Contracts Phases I and II. HZ
compared design and survey cross-section data for the 5,600 ft. stretch of roadway.

Authorize Execution of Amendment No. 5 to Engineering Agreement with Huitt-Zollars, Inc., for
Engineering Services Related to the Extension of Bellaire Drive South from the Existing Western
Terminus to Bryant Irvin Road
RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 5 to Engineering
Agreement with Huitt-Zollars, Inc., for engineering services related to the extension of Bellaire Drive South
from the existing western terminus to Bryant Irvin Road.
DISCUSSION:
The 1998, Capital Improvement Program included funds for the design and construction of Bellaire Drive
South. On March 16, 1999, (M&C C-17319) the City Council authorized the City Manager to execute an
engineering agreement with Huitt-Zollars, Inc., in the amount of $299,300 for the preparation of plans and
specifications for the extension of Bellaire Drive South from the existing western terminus to Bryant Irvin
Road.
The agreement was subsequently revised by four previous amendments totaling $335,709.60 as follows:
•Amendment No. 1 (Administratively approved by the City Manager on April 15, 2003) in the amount of
$21,200 provided for an alignment study for the extension of Arborlawn Drive from International Plaza to
Bryant Irvin Road;
•Amendment No. 2 (Administratively approved by the City Manager on August 19, 2003) in the amount of
$12,000, provided for topographic mapping of the Arborlawn Drive alignment;
•Amendment No. 3 (M&C C-20842, July 19, 2005) in the amount of $277,939.60, provided for the
preparation of plans and specifications for Arborlawn Drive; and
•Amendment No. 4 (Administratively approved by the City Manager on February 22, 2007) in the amount of
$24,570, provided for the electrical and irrigation design to illuminate and irrigate Arborlawn Drive and
Bellaire Drive.
Amendment No. 5 will provide compensation for the following additional services that are necessary on the
project: baseline survey, the preparation of two rough grading packages, roadway alignment changes, the
preparation of slope easements and rough grade excavation check.
Huitt-Zollars, Inc., proposes to provide the necessary services for a lump sum fee of $29,173. Staff
considers this amount to be fair and reasonable.
