KOLLMAN, HIS HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, TO LEAVE HIS TWO-STORY FRAME GARAGE APARTMENT FOR A MAXIMUM DISTANCE OF 1.7 FEET INTO THE EAST-WEST ALLEY IN BLOCK 3, LAWN PLACE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IM- MEDIATELY. WHEREAS, John B. Kollman is the owner of an existing two-story frame garage apartment located on Lot 6, Block 3, Lawn Place Addition to the City of Fort Worth, which structure encroaches into the east-west alley in said Block 3; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That John B. Kollman, the owner of said land above described and the improvements situated thereon, and his heirs, executors, administrators and assigns, be permitted to leave the existing building for a maximum distance of 1.7 feet into the east-west alley in Block 3, Lawn Place Addition, and that said improvements now existing be al- lowed to stand during the life of said building as the same is now constructed, provided, however, that in the event such building be demolished or major alterations and repairs be made thereto in the future, said building shall be reconstructed or repaired so as not to encroach upon said alley and so as to be in compliance with the then existing ordinances, rules and regulations of the City of Fort Worth, Texas. SECTION 2. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Kollman, owner of Lot 6, Block 3, Lawn Place Addition, has re- R quested that an ordinance be adopted permitting the continuance of an en- croachment into the east-west alley in Block 3, Lawn Place Addition, as shown on the attached map. Permission to continue the encroachment is needed to clear the title and to permit the full use of the property. The encroaching structure is a two-story frame garage-apartment which extends into the alley 1.7 feet at the rear of Lot 6, Block 3, Lawn Place Addition. Although the construction of accessory buildings in residential zones as dwel- ling units has not been permitted since 1948, this building is a legal non- conforming use for which maintenance and general upkeep are permitted, but no major alterations are allowed. The ordinance permitting the encroachment would apply as long as the improvements are in place, but it would not apply to new structures or major repairs, alterations or additions to the existing structure The applicant has agreed to remove an existing fence which also encroaches in- to the alley. City departments and the private utility companies have reviewed the request and do not object to the continued encroachment, provided no major repairs, alterations or additions be made to the encroaching structure.
