HomeMy WebLinkAboutOrdinance 603 ORDINANCE NO. 603, — AN ORDINANCE EXCLUDING FROM THE SALOON LIMITS, CERTAIN TERRITORY AS DESCRIBED IN ORDINANCE NO. 78, PASSED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH ON OCTOBER 7th, 1908, AND ENTITLED "AN ORDINANCE AMENDING SECTION l OF ORDINANCE NO. 64, PASSED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTHW MAY 27th, 1908," N' AND ALL OTHER ORDINANCES HERETOFORE PASSED BY THE CITY OF FORT WORTH PRESCRIBING ^V FIXING THE SALOON LIMITS OF THE CITY OF FORT WORTH, WITHIN WHICH THE BUSINESS OF SELLING AND VENDING INTOXICATING LIQUORS AT WHOLESALE� OR RETAIL, MAY BE LAWFULLY CONDUCTED WITHIN THE CITY OF FORT WORTH, r AND PROVIDING PENALTIES FOR THE VIOLATION OF SAME; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND TAKING OUT, EXCLUDING AND REMOVING FROM SAID SALOON LIMITS IN THE SAID t'ITY ©F IPGRT- WORTH, THE TERRITORY HEREINAFTER DESCRIBED, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING A PENALTY. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: Section That Section l,�,of Ordinance No. 78 passed by the Board of Commissioners of to City of Fort Worth on October 7th, 1908, "and entitled an Ordnance amending Section 1 of Ordinance No. 64 passed by the Board of Commissioners-cof the City of Fort Worth May 27, 1908, the same being an Ordinance prescribing and fixing the saloon limits within which the business of selling and vending intoxicating 1*iquors at wholesaYQ or at retail, may be lawfully conducted within the City of Forth Worth, and providing penalties for the violation of same, and repealing all Ordinances in conflict therewith," and all other Ordinances heretofore passed by the Board of Commissioners of the City of Fort Worth r where the same conflict with the terms of this Ordinance, be a� 4 amended so as to exclude, remove a,nd take out of the said saloon limits, the following described territory: BEGINNING at a point in the boundary line of the territory described in said Ordinance No. 78, said point being at the intersection of the Vest line of South Boaz Street with the North line of East Front Street; Thence in an Easterly direction with the North line of East Front Street with A is meanders to a point 200 feet East of the East property line tf Virginia Avenue, produced; Thence North 100 feet; Thence in a Westerly direction parallel with the North l±..Vq of East Front Street to a point on the West line of Crump Street 100 feet North of the intersection of the West line of Crump Street with the North line of East Front Street; Thence in a Northerly direction with the West line of Crump Street to a point of the intersection of the hest line of Crump Street with the West line of Elm Street; Thence in a Northerly direction with the West line of Elm Street to a point 100 feet South of the South line of Eighteenth Street; Thence Westerly parallel with the South line of Eighteenth Street•to a .point in the East line of the kight of 'hay of the Missouri, Kansas & Texas Railway Company of Texas; Thence in a southerly direction along the East line of the said Right of Gay of said Missouri, Kansas & Texas railway, and with its meanders to a point at the intersection of said East line of said railway Right of Way with the north line of East Front Street; Thence South 500 feet; Thence East to a point at the intersection with the West line of South Boaz Street; Thence North along the West line of South Boaz Street to a point at the intersection of the Vest line of South Boaz Street with the north line of East Front Street, which IV the point of beginning. Section 2: This Ordinance shall be held and construed as an amendment to said above mentioned Ordinances Nos. 78 and 64, and to Ordinance No. 167 passed by the.:Board of Commissioners on June 5, 1910, and all other Ordinances passed by the Board of Commissioners of the City of Fort Worth now in force which may be in conflict with the F terms of this Ordinance, which said Ordinances shall remain in full force and effect except a!;, herein amended, and all other ordinances, and parts of ordinances in conflict herewith, are hereby repealed. Section 3: Any person or persons, association of persons, firm or corporation who shall hereafter engage in the business of Belling fat retail, arty spirituous, vinous m mdlt liquors, or medioated biters Capable of producing intoxication within the City of Fort Worth-at any place within the boundary lines of the territory described in Section l, of this Ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than Twenty-five ($25.00) Dollars, and not more than Two Hundred ($200.00) Dollars, and each day thakf such person or persons, association of persons, firm or corporation shall so engage in such sale or business, shall be and constitute. a separate and distinct offense, and be punishable as such. Section 4: Any person or persons, association of persons, 1lrr, or corporation who shall hereafter engage in the business of selling.at wholesale, any spirituous, vinous or malt liquors, or medicated bitters capable of producing intoxication within the City of Fort Worth at any place within the boundary lines of the territory described in Section 1 of this Ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than Twenty-five ($25.00) Dollars, and not more than Two Hundred ($200.00) Dollars, and each d.a3f that such person or persons, association of persons, firm or corporation shall so engage in such sale or business, shall be and constitute a separate and distinct offense, and be punishable as such. Section 5: If any section, sus-.section or clause of this Ordinance is for any reason held to be null and void, such decision shall not affect the validity of any of the remaining portions of this Ordinance. Section 6: All Ordinances or parts of Ordinances in violation of the terms of this Ordinance, be and the same are hereby repealed. Section 7: This Or inance shall take effect and be in force from and after its passage and publication 'as required by law.
