AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE WESTERN PORTION OF THE EMERGENCY ACCESS,
UTILITY AND FIRE LANE EASEMENT (TO INCLUDE THE
CUL-DE-SAC) LOCATED WEST OF NORTH BEACH STREET
AND NORTH OF AUSTIN AVENUE; PROVIDING FOR
REVERSION OF THE FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the Western portion of the emergency access,
utility and fire lane easement (to include the cul-de-sac)
located west of North Beach Street and north of Austin Avenue,
situated in the City of Fort Worth, Tarrant County, Texas, and
being a portion of Lot 1, 301 Beach Industrial Park, as shown
on plat thereof recorded in Volume 388-118, Page 64, of the
Plat Records of Tarrant County, Texas, and more particularly
being a portion of a 26 foot wide Emergency Access, Utility,
and Fire Lane Easement across said Lot 1, said portion of
Easement being more fully described as follows:
BEGINNING at a point in the west line of said
Lot 1 and the westerly line of said Emergency
Access, Utility, and Fire Lane Easement, said
point being the point of intersection of said
west line of Lot 1 and westerly line of easement,
and being 233.15 feet South 0 degrees, 14 minutes,
20 seconds East from the northwest corner of said
Lot 1, and being on a curve whose center bears
South 89 degrees, 32 minutes, 40 seconds East,
50.0 feet;
THENCE northeasterly, easterly, and southeasterly
with said curve and with the northerly line of
said Easement, through a central angle of 164
degrees, 55 minutes, 48 seconds, a distance of
143.93 feet to the end of said curve;
THENCE South 89 degrees, 32 minutes, 40 seconds
East with said northerly line of Easement, 98.54
feet to a point on a curve whose center bears South
74 degrees, 28 minutes, 28 seconds East, 50.0 feet;
THENCE southerly with said curve, 26.30 feet to a
point in the southerly line of said Easement;
THENCE North 89 degrees, 32 minutes, 40 seconds
West with said southerly line of Easement, 98.54
feet to a point on a curve whose center bears North
74 degrees, 28 minutes, 28 seconds West, 50.0 feet;
THENCE southwesterly, westerly, and northwesterly
with said curve and said southerly line of Easement,
through a central angle of 164 degrees, 55 minutes,
48 seconds, a distance of 143.93 feet to the PLACE
OF BEGINNING
be and the same are hereby vacated, abandoned and permanently
closed as emergency access, utility and fire lane easements.
SECTION 2.
That the fee to the land in the above described
easements is hereby released and shall revert to the adjacent
owners as provided by law, SAVE AND EXCEPT that easements are
retained for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage, and it
is so ordained.

Beach Street Investmeri�t Joint Venture, owner of Lot 1, 301 Beach Industrial
Park, has requested that the City vacate the western portion of the emergency
access, utility, and fire lane easement (to include the cul-de-sac) as shown
on the attached map and further described in the attached field notes.
The subject emergency access, utility, and fire lane easement (including the
cul-de-sac) , all of which wao acquired by dedication, is unimproved. The Water
Department indicates need for a sanitary sewer easement across the west end of
the property.
Reviewing City departments and.-private utility companies have reviewed this
request and offer no objections provided the abutting property is replatted
to include dedication of an appropriate cul-de-sac at the west end of the
remainder of the emergency access easement and dedication of necessary utility
easements. A satisfactory replat has been submitted to City staff.
The City Plan Commission has reviewed this request and recommends vacation of
subject easement as requested.
Recommendation
It is recommended that an ordinance be adopted vacting subject easement.
