AN ORDINANCE ORDERING AN ELECTION OF THE
QUALIFIED VOTERS OF THE CITY OF FORT WORTH,
TEXAS, ON SATURDAY, THE 2ND DAY OF APRIL,
A. D. 1977, FOR THE PURPOSE OF DETERMINING
WHETHER OR NOT THE STATE LAW APPLICABLE TO
"FIREFIGHTERS AND POLICEMEN", ESTABLISHING
COLLECTIVE BARGAINING UNDER THE PROVISIONS
OF ARTICLE 5154C-1, AS AMENDED, SHALL BE
ADOPTED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That a special election be held in the City of Fort
Worth, Texas, on Saturday, the 2nd day of April, A. D.
1977, at the polling places hereinafter described, between
the hours of 7:00 A.M., and 7:00 P.M., at which election
the following proposition shall be submitted to the resident,
qualified electors of said City:
FOR or AGAINST the following:
Adoption of the state law applicable to
"firefighters and policemen", which
establishes collective bargaining when
a majority of the affected employees
favor representation by an employees'
association and which preserves the
prohibition of strikes and lockouts and
provides penalties therefor.
SECTION II.
That said election shall be held at the following places
with the following named persons appointed presiding judges
of said election, to-wit:

SECTION III.
That said election shall be held under the provisions
of the Charter of the City of Fort Worth, Texas, and the
Constitution and laws of the State of Texas and the United
States of America insofar as same may be applicable, and
all resident, qualified electors shall be allowed to vote
upon said proposition, and all of such electors shall vote
in the election precinct of their residence or as provided
by law.
SECTION IV.
That absentee voting shall be on paper ballots and
such ballots shall conform to the requirements of Article
6.06 of the Election Code of the State of Texas, as amended,
which provides that a square shall be placed beside the
proposition, in which the voter is requested to place an
"X" or other clear mark to indicate the way he wishes to
vote, but which also provides that the failure of a voter
to mark his ballot in strict conformity with the instruc-
tions on the ballot shall not invalidate the ballot, and
the ballot shall be counted if the intention of the voter
is clearly ascertainable, except where the law expressly
prohibits the counting of the ballot.

Election materials shall be made available in English
and Spanish at every polling place within the city as re-
quired under the provisions of Article 1.08a of the Election
Code of the State Of Texas, as amended. Absentee voting
materials shall be printed in both English and Spanish.
Such requirements apply to (a) forms for applying for an
absentee ballot, (b) the ballot envelopes and carrier en-
velopes and (c) any other instructions of forms furnished
to the voters. Such instructions and forms shall be printed
with both English and Spanish translations on the face of
the instrument or may be furnished separately along with
each instrument. All absentee ballots and ballot labels
shall comply with the requirements applicable to other
ballots and ballot labels.

is printed separately from the ballot, a copy of the trans-
lation shall be furnished to each voter who votes by mail.
The conduct of absentee voting by personal appearance shall
comply with the requirements set forth in Article 1.08a of
the Election Code of the State of Texas, as amended.
It is specifically provided that the election officers
shall not refuse to count a ballot because of a voter hav-
ing marked his ballot by scratching out the statement or
proposition (either in English or Spanish) for which he does
not wish to vote.

SECTION V.
That voting machines approved by the Commissioners'
Court of Tarrant County, Texas, shall be used at the special
election on the 2nd day of April, A. D. 1977, in strict
compliance with the applicable provisions of Article 7.14
of the Election Code of the State of Texas, as amended,
and other applicable provisions of such Election Code.
SECTION VI.
That the official ballots to be used in voting machines
shall be in compliance with the applicable provisions of
Article 7.14 of the Election Code of the State of Texas
and shall have written or printed thereon the following:

SECTION VII.
That the City Secretary is hereby ordered and directed
to prepare and issue ballots for absentee voting and for
voting machines and to stamp same "Official Ballot," on which
ballots shall be printed in both English and Spanish the
proposition hereinabove set forth.
SECTION VIII.
That the City Secretary shall furnish to the election
officials said ballots and voting machines, together with
any other forms, blanks or instructions in accordance with
the Charter of the City of Fort Worth, Texas, and the laws
of the State of Texas insofar as same are applicable, and
the provisions of this ordinance.
SECTION IX.
That the way and manner of holding this election, the
notice to be given therefor, the polling places, the per-
sonnel of the officers, precinct judges and substitutes
therefor who are to hold the same, and all details connected
with the holding of the election shall be determined and
arranged by the City Council and administered under the
direction of and by the City Secretary.
SECTION X.
That this ordinance shall constitute the proclamation,
call, notice and ordinance calling and ordering said election;
that same shall be published in a newspaper of general cir-
culation in the City of Fort Worth once a week for four (4)
weeks prior thereto; and that the said City Secretary is

hereby directed to post or cause to be posted said procla-
mation, call, notice and ordinance in each voting precinct,
or at the polling place of combined voting precincts, at
least twenty days before said election.
SECTION XI.
That this ordinance shall be printed in English and
Spanish and shall constitute the election order for such
special election. A substantial copy of each printing
shall serve as the notice of election under the laws of
the State of Texas.
