AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH GLADE, INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with GLADE, INC. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in .stid City, to-vit: 1. LOWDEN STREET From South Grove Street to Pecan Street, known and designated as Unit 1, Project No. 104-24000-194. 2. ANNIE STREET From May Street to St. Louis Avenue, known and designated as Unit 2, Project No. 104-24000-194. 3. ANNIE STREET From St. Louis Avenue to Galveston Avenue, known and designated as Unit 3, Project No. 104-24000-194. 4. INGRAM STREET From Lipscomb Street to Travis Street, known and designated as Unit 4, Project No. 104-24000-194. 5. WAGGOMAN STREET From Merida Avenue to McCart Avenue, known and designated as Unit 5, Project No. 104-24000-194. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 621888 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues�,and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6218 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; ,and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount ,of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: a -• III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. The making and con- struction of street improvements in this unit only as set out and described in Ordinance No. 6206, dated Novemeber 24, 1969, with Benefit Hearing set for December 23, 1969, when it was determined by the City Council to delete this unit from the contract as provided in Sec. 10, Art. 1105b, of the Revised Civil Statute of Texas as amended. 9. SANDAGE AVENUE From Covert Street to 380.8 Feet South, known and designated as Unit 9, Project No. 104-24000-194. The making and con- struction of street improvements in this unit only as set out and described in Ordinance No. 6206, dated November 24, 1969, with Benefit Hearing set for December 23, 1969, when it was determined by the City Council to delete this unit from the contract as provided in Sec. 10, Art. 1105b, of the Revised Civil Statute of Texas as amended. 10. MERIDA AVENUE From Covert Street to 379.1 Feet South, known and designated as Unit 10, Project No. 104-24000-194. The making and con- struction of street improvements in this unit only as set out and described in Ordinance No. 6206, dated November 24, 1969, with Benefit Hearing set for December 23, 1969, when it was determined by the City Council to delete this unit from the contract as provided in Sec. 10, Art. 1105b, of the Revised Civil Statute of Texas as amended. Project Description Name: Assessment Paving at 10 Locations on the South Side, Project No. 104-24000- 194 Contractor: Glade, Inc Contract Awarded: November 24, 1969 (M&C C-1623) Work Order Issued: January 9, 1970 Work Order Effective: January 19, 1970 Date of Final Inspection and Approval: April 22, 1970 Working Time Bid: 95 Working Days Working Time Used: 28 Working Days Project Cost and Financing Original Bid Price: $77,928.00 Change Order No. 1 (M&C C-1623, 11/24/69 - 8,925.00 Revised Bid Price: 69,003.00 Change Order No. 2: (AR, 1-15, 4/9/70) + 1,598.50 Final Bid Price: 70,601.50 Final Contract Cost: $62,766.93 ,Partial Payments Previously Made: 3 Amount: $47,105.31 Final Payment Due: $15,661.62 Final Payment to be made from Project Account No. 104-24000-194 Deviation from Bid Price: The under-run of $7,834.57, was a result of the following: Item 20. 6" HMAC Pavement at $3.25 per S.Y. , 259 S.Y. of the total estimated in the contract was not required for project completion for a savings of $ 841.75 Item 21. 7" HMAC Pavement at $3.80 per S.Y. , 189 S.Y. of the total estimated in the contract was not required for project completion for a savings of $ 718.20 Item 24. 6" Metal Pipe Sub-drain at $4..00 per L.F. , 753 L.F. of the total estimated in the contract was not required for project. completion for a savings of $3,012.00 $4,571.95 DATE REFERENCE SUBJECT: Final Payment, Assessment Paving PAGE NUMBER 5/25/70 FP-708 at Ten Locations on the South Side 2_ or Z The remaining under-run of $3,262.62 occurred because of minor variations between quantities estimated in the contract documents and quantities actually measured and used at the job site. Compliance with Specifications During testing on this project 10 corings were made on Units 1 and 5 with the following results: Exceeds Even with Under Specs but Below Specs Specs within Tolerance Tolerance Paving 7 2 1 0 Sub-grade 1 9 0 0 On Units 1 and 5 the average thickness of the HMAC paving is 7.59 inches as compared to the 7.00 inches specified, and the average thickness of the stab- ilized sub-grade is 6.01 inches as compared to the 6.00 inches specified. Seven corings were made on Units 2,3,4,6 and 7 with the following results: Exceeds Even with Under Specs but Below Specs Specs within Tolerance Tolerance Paving 5 0 2 0 Sub-grade 2 5 0 0 On these units the average thickness of the HMAC paving is 6.40 inches as compared to the 6.00 inches specified, and the average thickness of the lime stabilized sub-grade is 6.03 inches as compared to the 6.00 inches specified, Tests made during construction show that materials used were in compliance with contract specifications. Recommendations It is recommended that the project described above be accepted by the adoption of an ordinance and that final payment of $15,661.62 be authorized to Glade, Inc.
