AN ORDINANCE EXTENDING THE BOUNDARY LIMITS AND ANNEXING CERTAIN TERRITORY LYING ADJACENT TO THE CITY OF FORT WORTH; PROVIDING THAT THE ORDINANCE BE ADVERTISED IN A DAILY NEWSPAPER PUBLISHED IN SAID CITY IN ACCORDANCE WITH THE PROVISIONS OF SECTION 4.0, CHAPTER XXVIII OF THE CITY CHARTER; AND PRESCRIBING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASt SECTION 1. That the hereinafter described territory lying adjacent to the City of Fort Worth is hereby annexed and brought within the corporate limits and made an integral part of said City of Fort Worth, said territory being situated in Tarrant County, Texas, and being described by metes and bounds as follows: Being a tract of land south of the City of Fort Worth and lying in the G. Hernandez, J. Asbury, J. Van Riper, A. Rhodes, G. Herrara, Ge Hamilton, John Sise, Charles Martin, J. Wilcox, To 0. Moody, Jose A. Gill, Hiram Walker, Jo Jennings, S. A. & Me G. R.R. Co., J. Me Robinson, J. E. Phillips, He Lane, J. He Lucas, J. Steele, Wm. Stone, J. Martin, Sarah Gray, Re We Waggoner, I. & G. We R.R. Co., He G. Catlett, He Asbbury, Me Hunt, and J. We Haynes Surveys. BEGINNING at a point in the present City of Fort Worth City Limit Line at its intersection with the east line of the Me A. & T. R.R. Co. right of way in the G. Hernandez Survey; THENCE southerly along the east line of the M. B. & T,,, R.R. Co. right of way to its intersection with the north line of the John Siee Survey; THENCE east along the north line of the John Sise Sur- vey, and continuing along said line produced east to its intersection with the west line of U. S. Highway No. 81; THENCE southerly along the west line of Ue S. Highway No. 81 to its intersection with the south line of. Tarrant County; THENCE west along the south line of Tarrant County to its intersection with the northeasterly line of the He G. Catlett Survey; THENCE northwesterly along the northeasterly line of the He G. Catlett Survey to its north corner; THENCE southwester4 along the northwesterly line of the He Go Catlett Survey to its intersection with the south line of Tarrant County; THENCE west along the south line of Tarrant County to its intersection with the east line of County Road No. 1011; THENCE north, northwest, and north along the east line of County Road No. 1011 to its intersection with the north- westerly line of the Me Hunt Survey; THENCE northeasterly along the northwesterly line of the Me Hunt Survey to its north corner, a southwest corner of the R. We Waggoner Survey; THENCE north along the west line of the R. W. Waggoner Survey to the south corner of the A. W. Reynolds Survey; THENCE northeast along a southeast line of the A. W. Reynolds Survey to its southeast corner; THENCE north along the east line of said Reynolds Sur- vey to its northeast corner and continuing north across the J. H. Lucas Survey to its north line; THENCE Rest along said line to the centerline of State Farm to Market Road No. 731; THENCE northerly along the centerline of said road to the north line of the T. H. Toler Survey; THENCE west along said line to the east line of the G. C. & S. F. R.R. Co. right of way;, THENCE northerly along said line to its intersection with the north line of the E. E. Disham (B. B. Dishman) Survey or S. A. & M. G. R.R. Co. Survey; THENCE east along the north lines of the E. E. Disham (E. B. Dishman) and S. A. & M. G. R.R. Co. Surveys to the northeast corner of the S. A. & M. G. R.R. Co. Surveys and continuing east to its intersection with the west line of the M. K. & T. R.R. Co. right of way; THENCE northerly along the west line of M. K. & T. R.R. Co. right of way to its intersection with the present City of Fort Worth City Limit Line; THENCE southeasterly along the present City of Fort Worth City Limit Line to the place of beginning and con- taining approximately 8.8 square miles. SECTION 2. That this ordinance shall and does hereby repeal every prior ordinance in conflict herewith and more particularly this ordinance expressly repeals Ordinance No. 3839 heretofore adopted and passed on May 16, 1958, but as to all other ordinances or sections of ordinances not in direct conflict here- with this ordinance shall be and is hereby, made cumulative. SECTION 3. That this ordinance is not intended to annex any part of any area legally within the existing corporate boundaries of any other incorporated municipality at the time of its passage; in the event a portion of this ordinance be found to be void and in conflict with any such area then the voiding of any such conflicting portion shall have no effect on the ordinance as a whole, other than the portion found to be void. SECTION u. That this ordinance shall be published one time in a daily news- paper published in the City of Fort Worth, Texas, in accordance with the provisions of Section 40, Chapter XMII of the City Charter. SECTION 5. WAS PL�LJ NT,} „T TH7 PITY COUNCIL TEXAS AND WAS �JJ❑3ICY APPROVED OFFICE OF THE CITY MANAGER Communication to Mayor and Council No.PZO-2 June 22, 1960 City Secretary Honorable Mayor and Re: Request for deletion from Members of the City Council First Reading near Burleson City of Fort Worth Mrs. McKnight and Gentlemen: The City Planning Department has studied the request from the City of Burleson for release from first reading of a certain area adjacent to Burleson, has coordinated reports from interested City Departments and reports as follows: HISTORY All area lying within Tarrant County which is north of and adjacent to the City of Burleson was placed under first reading annexation by appropriate ordinances, adopted in May of 1958. In February of I960, the City of Burleson requested that a certain area under first reading be released in order that it could be annexed by the City of Burleson. The area embraced in this request was extensive and was placed under study and investigation by various departments of the City. On April 30, 1960, the City of Burleson requested that a considerably smaller area be considered for release, due to immediate plans for develop- ment. This report concerns the subsequent request for the smaller area • amounting to approximately 51 acres. LOCATION The 51 .acres requested for release is located immediately adjacent to the south line of Tarrant County and immediately north of the City of Burleson and comprises a triangular tract of land in the north portion of the H. G. Catlett Survey, and is further located as being slightly less than one mile west from U. S. Highway 81 South. WATER A recommendation on this request was sought froth the Water Director, who advises that it is not practical or economical for the City of Fort Worth to provide water service to the tract, that Burleson can and will supply the necessary water, and that based on these reasons the Water Department recommends that the subject tract be released. 4 MLC PZO- 2 June 22 1960 Page 2 SANITARY SEWER The Sanitary Sewer Division of the Public Works Department reports that the subject tract is located II miles from the nearest City of Fort Worth Sanitary Sewer facilities, and that it is not economically feasible to extend sanitary sewer service for such a small tract. FIRE PROTECTION The City Fire Department reports that the nearest fire station is located about 9 miles from the subject tract with a travel time of approximately ten minutes. Further plans by the Fire Department will recommend that a fire station be erected in the vicinity of Highway 81 South and the South- west loop 217, which would reduce the distance to about 6} miles. PLANNING AND ZONING There are no planning and zoning proposals presently contemplated which would interfere with the release of this tract from First Reading. DEVELOPMENT The City of Burleson states that the tract is controlled by two developers, who are now progressing with plans for this area and one of the owners is in the progress of developing streets and lots that are within Tarrant County. SUMMARY is is a relatively small tract too far removed from the City of Fort Worth utilities and services to warrant holding within the first reading, since the proposed development would thereby be unnecessarily delayed. RECOMMENDATION The City Planning Department recommends that the request of the City of Burleson, as to the release of the specific 51 acres be granted, and that the remainder of the area included in the original request for de-annexa- tion be continued under study. A new ordinance repealing the existing first reading ordinance and annex- ing the area, less the 51 acres, has been prepared by the Planning Depart- ment, and approved as to form and legality by the Department of Law. Be- cause of the remoteness from existing city facilities and services and because of the relatively small area involved, it is recommended that the request of the City of Burleson be approved.
