AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS, RESCINDING ALL PROCEEDINGS HERE-
TOFORE HAD ORDERING THE IMPROVEMENT OF A PORTION
OF WEST TENTH STREET IN SAID CITY; AND AUTHORIZING
AND DIRECTING THE FILING OF NOTICE OF SUCH ACTION.
WHEREAS, by Ordinance No. 2615, passed and adopted on November 24,
1948, the City Council of the City of Fort Worth, Texas, determined the
necessity for and ordered the improvement of a portion of West Tenth Street
in said City within the limits hereinafter defined, to wit:
West Tenth Street from the easterly line of Penn
Street to the westerly line of Cherry Street,
save and except the intersection of Henderson Street;
and,
WHEREAS, by the terms of said ordinance, the City Council further
ordered and directed the City Secretary of the City of Fort Worth, Texas, to
give notice, by filing under Article 1220a of the Revised Civil Statutes of
Texas, that a portion of the cost of said improvements would be specially as-
sessed against properties abutting upon said street within the limits above
defined and against the owners thereof, and would be secured by special as-
sessment liens against said properties and a personal claim of liability as-
sessed against the real and true owners thereof; and,
WHEREAS, pursuant to said instructions, notice was duly filed in the
office of the County Clerk of Tarrant County, Texas, and duly recorded in
Volume -.za.' page ' , of the Mortgage Records of said County; and,
WHEREAS, the City Council has found and determined that it is imprac-
ticable at the present time to improve West Tenth Street within the limits
above defined under the terms of the ordinance above referred to; NOW, THERE-
FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That the City Council of the City of Fort Worth, Texas, finds it im-
practicable to proceed further with the improvement of West Tenth Street
within the limits provided in said Ordinance No. 2615, and hereby rescinds
and repeals said Ordinance No. 2615, passed and adopted November 24, 1948,
which determined the necessity for and ordered the improvement of such por-
tion of West Tenth Street in said City, and in view of the fact that the
City Council has heretofore caused to be filed for record a statutory notice
as hereinabove stated, the Mayor and City Secretary of said City are hereby
authorized and directed to cause to be filed for record in said Mortgage
Records a written notice of the action of the City Council rescinding its
former action ordering the improvement of West Tenth Street within said
limits and of its intention not to proceed any further with the improvement
of said street within said limits for the purpose of evidencing a release
of any prospective assessment lien proposed to be levied by said ordinance
against properties abutting upon said portion of West Tenth Street and any
prospective personal claim of liability against the owners of said properties.
SECTION 2.
That this ordinance shall take effect and be in full force and effect
from and after the date of its passage, and it is so ordained.
