HomeMy WebLinkAboutOrdinance 7207 ORDINANCE NO. 7207 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED, BY ADDING A NEW CHAPTER THERETO DESIGNATED AS CHAPTER 40, DE- PARTMENT OF PUBLIC LIBRARIES, PROVIDING FOR THE ESTABLISHMENT AND REGULATION OF A DEPARTMENT OF PUBLIC LIBRARIES, PROVIDING FOR A DIRECTOR THERE- OF TO BE APPOINTED BY THE CITY MANAGER AND FIX- ING THE FUNCTIONS AND DUTIES OF SAID DEPARTMENT AND ITS DIRECTOR; AND NAMING AN EFFECTIVE DATE. WHEREAS, on April 8, 1975, a majority of the elec- torate of the City of Fort Worth voting in a Charter Amend- ment election found and determined that Sections 1 through 11, inclusive, of Chapter XVII, Department of Public Li- braries, of the Charter of the City of Fort Worth should be amended so that said chapter shall hereafter read and be as follows: "CHAPTER XVII. DEPARTMENT OF PUBLIC LIBRARIES. "The City Council shall provide by ordi- nance for the establishment and regulation of a Department of Public Libraries."; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the Code of the City of Fort Worth, Texas (1964), as amended, be and the same is hereby amended by adding there- to a new chapter designated as Chapter 40, Department of Public Libraries, which chapter shall read and be as follows: "CHAPTER 40. DEPARTMENT OF PUBLIC LIBRARIES "Sec. 40-1. Department Established. A Department of Public Libraries is hereby established, which department shall be under the supervision of a Librarian, who shall be subject to appointment and removal by the City Manager. The salary of the Librarian shall be in accordance with the compensation plan of the City. "Sec. 40-2. Duties of the Librarian. The Librarian shall have charge of the Central Library and all branch libraries and reading rooms, and shall be responsible for the care of the books and other library property, classi- fy and arrange all books and literature, and keep same catalogued and indexed consistent with approved library techniques and practices. The Librarian shall promptly report any delin- quencies, keep exact account of all moneys from all fines, et cetera, and deposit the amounts with the City Treasurer, and perform and dis- charge such other -duties as may be prescribed by the City Manager. The Librarian shall be respons- ible to the City Manager for administration and implementation of the policies established by the City Council for the operation of the Depart- ment of Public Libraries. "Sec. 40-3. Appointment of Employees. The Librarian shall have the power to appoint, employ and remove such assistants, employees and personnel as he may deem necessary for the efficient administration of the affairs of the Department of Public Libraries, and to prescribe and fix their duties, scope of authority and qualifications in accordance with the annual budget of the Department of Public Libraries as finally adopted by the City Council and the classification and compensation plan established by the City Council. All assistants, employees and personnel of the Department of Public Libraries shall be governed by the same personnel rules and classification and compensation plan as is estab- lished for all other employees of the City. "Sec. 40-4. Limitation of Expenditures. The Department of Public Libraries shall not make any expenditure of money or incur any lia- bility during any fiscal year beyond the amount appropriated or set apart in the annual budget of the Department of Public Libraries as approved by the City Council for such purpose. "Sec. 40-5. Forms and Methods of Budgeting and Accounting. The Department of Public Li- braries shall conform to such rules and regula- tions regarding financial affairs as are promul- gated by the Director of Finance, including rules and procedures governing preparation and review of the annual budget and control of budgeted ex- penditures. "Sec. 40-6. Management of Gifts and Be- quests. In the event gifts, bequests or endow- ments are made for the benefit of the Depart- ment of Public Libraries, such gifts, bequests or endowments shall be administered by the Librarian for the benefit of the Department of Public Libraries of the City of Fort Worth. "Sec. 40-7(a). Advisory Board. The City Council shall appoint an advisory board to be comprised of thirteen citizens to act in an ad- visory capacity to the City Manager and City Council in conjunction with the Library Depart- ment. The members of such advisory board shall each serve for a two year term, shall serve with- out compensation and may be removed at any time by the City Council. "Sec. 40-7(b). Responsibilities of Advisory Board. The Advisory Board will be responsible for providing policy recommendations and informa- tion to the City Manager and the City Council about citizen needs and requests that will improve the services of the department. "Sec. 40-7(c). Duties of Advisory Board. The Advisory Board will recommend to the City Manager and the City Council plans for develop- ment of facilities and services to meet the needs of the City. The Board will review and comment on the annual operating budget and capital improve- ment requests. Recommendations made by the Board will be presented to the City Manager and the City Council for consideration." SECTION 2. Attached is an ordinance prepared by the City Attorney. There are no substantive changes from the proposed ordinance previously presented to the City Council on April 23, 1975. Recomatendat ion It is recommended that the City Council approve the ordinance as prepared by the City Attorney and authorize the City Manager to establish guide- lines fot the operational duties and responsibilities of the Advisory Library *oard.
