AN ORDINANCE TO ADJUST RECEIPTS AND APPROPRIATIONS IN THE
STORMWATER CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS
AND APPROPRIATIONS IN THE STORMWATER HAZARDOUS ROADWAY
OVERTOPPING PROGRAMMABLE PROJECT IN THE AMOUNT OF $1,042,958.00,
FROM AVAILABLE FUNDS, FOR THE PURPOSE OF STORMWATER HAZARDOUS
ROADWAY OVERTOPPING MITIGATION; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the
Budget of the City Manager, there shall also be an increase in estimated receipts and appropriations in the
Stormwater Hazardous Roadway Overtopping programmable project in the amount of$1,042,958.00, from
available funds, for the purpose of stormwater hazardous roadway overtopping mitigation.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of an Engineering Services Agreement with Freese and Nichols, Inc.,in an Amount Not to Exceed$1,300,000.00 for
Stormwater Hazardous Roadway Overtopping Mitigation Prioritization, Feasibility Assessment,and Project Development,Adopt Appropriation
Ordinances and Update the FY 2020-2024 Capital Improvement Plan(ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Appropriation Ordinance to adjust the receipts and appropriations in the Stormwater Capital Projects fund by decreasing
receipts and appropriations in the Flooding Assessments programmable project(City Project No. P00046)in the amount of$250,000.00;
2. Adopt the attached Appropriation Ordinance to adjust the receipts and appropriations in the Stormwater Capital Projects fund by decreasing
receipts and appropriations in the Stormwater Hazardous Roadway Overtopping Safety Improvements programmable project(City Project
No.P00121)in the amount of$28,426.00;
3. Adopt the attached Appropriation Ordinance to adjust the receipts and appropriations in the Stormwater Capital Projects fund by increasing
✓ appropriations in the Stormwater Hazardous Roadway Overtopping programmable project(City Project No.P00120)in the amount of
$1,042,958.00 from available funds; and
4. Authorize execution of an Engineering Services Agreement with Freese and Nichols, Inc.,in an amount not to exceed$1,300,000.00 for
Stormwater Hazardous Roadway Overtopping Mitigation, Prioritization, Feasibility Assessment,and Project Development assignments.
This Agreement may be renewed up to two additional terms.
DISCUSSION:
The Engineering Services Agreement recommended by this Mayor and Council Communication will provide task-ordered engineering services for
Stormwater Hazardous Roadway Overtopping Mitigation(HROM)Prioritization,Feasibility Assessment,and Project Development assignments.
Freese and Nichols, Inc. (Freese and Nichols)will assess potential HROM projects citywide to determine strategic priorities,to ascertain
feasibility,and to develop basic project scopes,schedules and budgets for selected projects that are acceptable,effective and constructible
solutions.These solutions will be the bases for the final project designs to be completed by engineers selected through a qualification-based
process.
Freese and Nichols proposes to perform the scope of work for this contract for a not-to-exceed fee of$1,300,000.00. The City will issue individual
task orders to authorize the consultant to perform work under this agreement until such time as the contract funds have been expended. The City,
at its sole option,may renew this contract under the same terms and conditions up to two times. In no event shall a term of the contract exceed 5
years from its effective date. Staff considers the unit costs proposed to be fair and reasonable for the anticipated services to be performed.
This contract will not result in any additional annual operating cost for the Transportation& Public Works(TPW)Stormwater Management Division.
Funding for this project was included in the FY2020-2024 Capital Improvement Plan in the amount of$257,042.00. In light of the anticipated
revenue bond sale in Summer 2020 made possible by the recent Stormwater Utility Fee increase,staff recommends accelerating prioritization
and project development to expedite construction of critical Hazardous Roadway Overtopping Mitigation projects.The$1,042,958.00 in additional
funding being reallocated by this M&C will provide the needed funds.The action in this M&C will update the FY2020-2024 Capital Improvement
Plan.

Freese and Nichols, Inc.is in compliance with the City's BDE Ordinance by committing to 10.00%SBE participation on this project.The City's
SBE goal on this project is 10%.
This Stormwater Contract area is located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will
be available in the Stormwater Capital Projects Fund.Prior to an expenditure being made,the Transportation&Public Works Department has the
responsibility to validate the availability of funds.
