ORDINANCE NO. D
ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EVANS AVENUE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
FOR THE CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY
COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with AUSTIN ROAD CONPANY , for the making and construction of
certain street improvements on a hereinafter described portions of streets, avenues and
public places in said City, to-wit:
UNIT 1: EVANS AVENUE From 150' south of E. Jessamine Street to E. Baltimore
Avenue, known and designated as Unit 1, Project No.
061-21304-4553, Phase IV Echo.
UNIT 2: NEW YORK AVENUE From 150' south of E. Jessamine Street to E. Davis
Avenue, known and designated as Unit 2, Project No.
061-21304-4553, Phase IV Echo.
UNIT 3: NEW YORK AVENUE From E. Davis Avenue to E. Baltimore Avenue, known
and designated as Unit 3, Project No. 061-21304-
4553, Phase IV Echo.
UNIT 4: EAST ARLINGTON AVENUE From New Orleans Avenue to Evans Avenue, known and
designated as Unit 4, Project No. 061-21304-4553,
Phase IV Echo.
UNIT 5: EAST ARLINGTON AVENUE From Evans Avenue to New York Avenue, known and

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 6713 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 6713 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
HE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THATr
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
Ii.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary, is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:
III.
When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

aOJECT NO. 061-21304-4553, PHASE IV ECHO, UNIT 1, EVANS AVENUE FROM 150' SOUTH OF EAST
JESSAMINE STREET TO EAST BALTIMORE AVENUE, to be improved by widening the existing thirty-foot
wide roadway to a fifty-foot roadway by constructing a one and one-half inch thick hot-mix
asphaltic concrete surface course on the existing concrete base. The base is to be repaired
and widened with six and one-half inch thick reinforced concrete. The roadway will be complete
with seven-inch high concrete curb and eighteen-inch wide concrete gutter. Four-foot wide
concrete sidewalk and six-inch thick concrete driveways will be constructed where specified.

RAMSEY AVENUE TO 165' NORTH OF EAST RAMSEY AVENUE, to be improved by widening the ecisting
thirty-foot roadway to a fifty-foot roadway by constructing a one and one-half inch thick
hot-mix asphaltic concrete surface course on existing concrete base. The base is to be
repaired and widened with six-and one-half inch thick reinforced concrete. The roadway
will be complete with seven-inch high concrete curb and eighteen-inch wide concrete gutter.
Four-foot wide concrete sidewalk and six-inch thick concrete driveways will be constructed
where specified.

Deviation from Bid Price: This project being a reconstruction type
project, where many items are to be repaired or partially salvaged,
inherently has a chance of many unforeseen circumstances during con-
struction. Some items are unforeseen and unexpected until discovered
during construction. Some items are known to be needed but the quan-
tity is unknown and is estimated until such time during construction
that such items are uncovered or exposed and the exact extent of
work concerning that item of construction is determined. During
design these items are estimated, and the final payment is based on
final quantities actually constructed.
The final cost of this project is $71,986.01 under the bid price.
The major savings resulted from actual quantities being less than
estimated as follows:
1) Less utility adjustments $13,018.13
2) Less concrete base repair 17,832.18
3) Less lime stabilization 5,035.48
4) Less 6" subdrain pipe 12,890.00
5) Less hot mix asphalt concrete 20,312.88
