AN ORDINANCE ORDERING A SPECIAL HOME RULE ELECTION IN THE CITY
OF FORT FORTH, TEXAS, TO BE HELD ON THURSDAY, THE 31TH DAY OF
SEPTEMBER, 1958, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED
VOTERS OF SAID CITY, FOR ADOPTION OR REJECTION, PROPOSED AMEND-
MENTS TO THE EXISTING CHARTER OF THE CITY OF FORT FORTH, INCLUD-
ING IN SAID PROPOSED AnNDMrNTS AN AMEBIDNf= AUTHORIZING THE
CITY COUNCIL TO LEVY A TAX, TO PROVIDE FUNDS FOR THE PURPOSES
OF THE RETIREMENT OF CERTAIN DEBTS, GENERAL MUNICIPAL OPERATIONS,
DEFERRED MA32MMANCE AND CAPITAL IMPROVEMENTS, ON ALL SALARIES,
WAGES, COMMISSIONS AND OTHER COMPENSATION EARNED BY RESIDENTS
OF THE CITY OF FORT WORTH IN THE CITY OF FORT WORTH; ON ALL SAL-
ARIES, WAGES, COMMISSIONS AND OTHER COMPENSATION EARNED BY NON-
RESIDENTS OF THE CITY OF FORT FORTH FOR WORK DONE OR SERVICES
PERFORMED OR RENDERED IN THE CITY OF FORT FORTH; ON THE NET PROFITS
EARNED IN THE CITY OF FORT FORTH ON ALL BUSINESSES, PROFESSIONS
OR OTHER ACTIVITIES CONDUCTED BY RESIDENTS OF THE CITY OF FORT
WORTH; ON THE NET PROFITS EARNED ON ALL BUSINESSES, PROFESSIONS
OR OTHER ACTIVITIES CONDUCTED IN THE CITY OF FORT WORTH BY NON-
RESIDENTS; AND ON THE NET PROFITS EARNED BY ALL CORPORATIONS HAV-
ING AN OFFICE OR PLACE OF BUSINESS IN THE CITY OF FORT FORTH AS
A RESULT OF WORK DONE OR SERVICES PERFORMED OR RENDERED IN THE
CITY OF FORT FORTH, AND PROVIDING REGULATIONS FOR THE COLLECTION
OF THE TAX, AND AN AMENDMENT PROVIDING FOR AN INCREASE IN THE
TAX LIMITA21ON WITH RESPECT TO AD VALOREM TAXES AS NOW PROVIDED
IN THE CHARTER OF SAID CITY; DESIGNATING THE PLACES AT WHICH SAID
ELECTION IS TO BE HELD; APPOINTING PRESIDING OFFICERS THEREOF;
AND DECLARING AN EMERGENCY.
WHEREAS, on Friday, the 13th day of Ji;ne, 1958, an ordinance was duly
passed by the City Council of the City of Fort Worth, Texas, giving due
notice, in strict compliance with the statutes of the State of Texas and
the Charter of the City of Fort Worth, Texas, of its intention to pass an
ordinance providing for the submission to the qualified voters of the said
City of Fort Worth of proposed amendments to the existing charter; and,
WHEREAS, the notice of intention to submit such charter amendments
was duly given by publication in the Fort Worth Press, a newspaper published
daily except Saturday in the City of Fort Worth and the official newspaper
of said City, which notice was published for ten (10) days, the date of the
first publication thereof being not less than twenty (20) days next preced-
ing the date of this ordinance; and,
WHEREAS, the City Council of the City of Fort Worth, in the exercise
of the discretion reposed in it by the Constitution and the laws of this
State relating to the amendment of city charters by cities having more than
five thousand inhabitants, deems it wise and expedient to submit the proposed
amendments to the existing charter of said City, hereinafter set forth, at
a special election to be held in said City on Thursday, the llth day of Sep-
tember) 1958; and,
WHEREAS, it appears that no regular municipal election will be held in
said City within the time specified in Article 1166 of Vernon's Civil Stat-
utes after the passage of this ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That a special election be held in the City of Fort Worth, Texas, on
Thursday, the llth day of September, 1958, for the purpose of submitting to
the qualified voters of said City, for adoption or rejection, the following
proposed amendments to the existing charter of the City of Fort Worth:
AMENDMENT I.
Shall Chapter XXV of the Charter of the City of Fort Worth
be amended by adding thereto Section 37, reading as follows:
The City Council is authorized each year, when adopting the
appropriation ordinance, to levy a tax, to provide funds for
the purposes of the retirement of certain debts, general munici-
pal operations, deferred maintenance and capital improvements,
on all salaries, wages, commissions and other compensation earned
in the City of Fort Worth by residents of the City of Fort Worth;
on all salaries, wages, commissions and other compensation earned
by nonresidents of the City of Fort Worth for work done or services
performed or rendered in the City of Fort Worth; on the net profits
earned in the City of Fort Vorth on all businesses, professions or
other activities conducted by residents of the City of Fort Worth;
on the net profits earned on all businesses, professions or other
activities conducted in the City of Fort Worth by nonresidents; and
on the net profits earned by all corporations having an office or
place of business in the City of Fort Worth as the result of work
done or services performed or rendered in the City of Fort Worth;
to require the filing of returns and the furnishing of information
by employers and all those subject to said tax; to impose on employ-
ers the duty of collecting the tax at the source and paying the
same to the City of Fort Worth; to provide for the administration,
collection and enforcement of said tax; to authorize the imposition
of penalties for the violation of the ordinance creating the tax;
to provide that said tax shall not exceed the rate of one per cent
(1%); and to provide that not less than fifty per cent (50%) of the
above tax paid by the taxpayer shall be allowed as a credit on all
ad valorem taxes paid by the taxpayer on property located in the
City of Fort Worth?
AMENDMENT II.
Shall Section 23, Chapter XXVIII of the existing Charter of the
City of Fort Worth, be amended and, after being amended, read as
follows:
.Each year when the City Council adopts the appropriation ordi-
nance and determines the amount of the tax levy for general munici-
pal purposes, it shall never levy a tax for all municipal purposes
in excess of Two and 20/100 Dollars ($2.20) on each One Hundred Dol-
lar ($100.00) valuation of property subject to taxation situated
within the City of Fort Worth?
SECTION 2.
That the polling places and presiding officers of said election shall
be, respectively, as follows:

SECTION 3.
That said election shall be held in the manner and within the hours
prescribed for general elections by the laws of the State of Texas so far
as they may be practicable, and all persons qualified to vote in said City
under the laws of this State regulating general elections shall be allowed
to vote.
SECTION 4.
That it shell be the duty of the City Secretary to'prepare the official
ballot, on which official ballot shall appear the proposed amendments set
out in Section 1 of this ordinance, and after each of said proposed amend-
ments shall be printed the words "Yes," "No," in order that the voter may
vote "Yes" or "No" on each of said proposed amendments.
SECTION 5.
That all voters desiring to vote for the adoption of any of the proposed
amendments shall permit to remain on their ballot, with respect to each
proposed amendment which they desire to have adopted, the word "Yes"; and
those opposed shall permit to remain on their ballot, with respect to each
amendment which they desire to have rejected, the word "No."
SECTION 6.
That the City Secretary shall, in accordance with the provisions of
Article 1170 of Vernon's Civil Statutes, mail a copy of each of the pro-
posed amendments to every qualified voter in the City of Fort Worth as ap-
pears from the rolls of the Tax Collector of Tarrant County, Texas, for the
year ending January 31, 1958.
SECTION 7.
That a copy of this ordinance shall be sufficient notice of said elec-
tion, and thirty (30) days' notice of the time and places of holding the
said election shall be given by publication of such notice in the official
newspaper of said City each week for four (4) weeks, the date of the first
publication being not less than thirty (30) full days prior to the date of
the election.
SECTION 8.
That each proposed amendment as is set forth hereinabove, if approved
by a majority of the qualified voters voting upon said amendment, shall
become a part of the Charter of the City of Fort Worth as soon as an official
order and ordinance has been entered on the records of said City by the
governing body thereof, declaring the same adopted.
SECTION 9.
The fact that the present Charter of said City is inadequate and the
importance of the proposed charter amendments creates an emergency and an
imperative public necessity for the immediate taking effect of this ordi-
nance, and it is hereby ordained that this ordinance shall take effect and
be in full force and effect from and after the date of its passage.
