AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
AN UN -NAMED 30 FOOT WIDE RIGHT -OF -WAY LYING EAST OF LOT
10, BLOCK 2, LINCOLN PLACE, LOCATED IN THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN VOLUME
1627, PAGE 351, OF THE PLAT RECORDS OF TARRANT COUNTY,
TEXAS; CONTAINING APPROXIMATELY 2,603 SQUARE FEET OR
0.060 ACRE OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of an un -named thirty (30) foot right -of -way lying east of Lot 10, Block 2,
Lincoln Place, located in the City of Fort Worth, Tarrant County, Texas, as recorded in Volume
1627, Page 351, of the Plat Records of Tarrant County, Texas, and containing approximately
2,603 square feet or 0.060 acre of land more or less, and as more specifically described in
Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above - described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION OF STREET PROPOSED FOR VACATION
SITUATED in the City of Fort Worth, Tarrant County, Texas, and being a portion of an un -named 30 foot
wide street right -of -way lying east of Lot 10, Block 2, LINCOLN PLACE, as shown on plat there recorded in
Volume 1627, Page 351, of the Tarrant County Deed Records, and said portion being more fully
described as follows:
BEGINNING at the southeast corner of said Lot 10, at the point of intersection of the north line of East
Twelfth Street with the west line of said 30 foot street;
THENCE North 1 degree, 39 minutes, 40 seconds West with said west line of un -named 30 foot wide street
and the east line of said Lot 10, 87.09 feet to the northeast corner of said lot in the south line of Lot 1 -R,
Block 1 -A, Mary A. Adams Heirs Subdivision, as shown on plat thereof recorded in Volume 388 -107, Page
21, of the Tarrant County Plat Records;
THENCE East with the north end of said 30 foot street right -of -way and partially with said south line of Lot
1 -R, 30.0 feet to the northeast corner of said street right -of -way;
THENCE South 1 degrees, 39 minutes, 40 seconds East with the east line of said un -named street right -of-
way, 86.54 feet;
THENCE South 89 degrees, 00 minutes West with the projected north line of said East Twelfth Street and
the projected south line of said Lot 10, 30,0 feet to the PLACE OF BEGINNING, and containing 2603
square feet (0.060 acre).

Adopt Ordinance Vacating a Portion of an Unnamed Street Near the Intersection of East 12th Street and
Riverside Drive (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of an unnamed street near the intersection of East 12th Street
and Riverside Drive; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M &C G-
15624).
DISCUSSION:
Gerry Curtis and Associates, Inc., on behalf of Stuart Hose and Pipe has requested the vacation of this
unnamed right -of -way to replat it with the adjoining property to expand parking for future
development. The City Plan Commission recommended approval of this request at its meeting on
February 22, 2012. An acceptable replat (FS- 012 -007) has been received.
The City of Fort Worth (City) originally obtained the above mentioned right -of -way through the platting
process. The City does not own land under or adjacent to the above referenced street. Since no City
funds have been expended to purchase property or easement rights, collection of the fair market value or
any portion thereof is recommended by Staff to be waived.
This project is located in COUNCIL DISTRICT 8.
