AMENDMENT# 9
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas,acting through the Texas Department of
Transportation, hereinafter called the State,and City of Fort Worth,acting by and through its duly authorized officials,
hereinafter called the Local Government.
WITNESSETH
WHEREAS,the State and the Local Government executed a contract on the 3`dof August,2007 to effectuate their
agreement to review the Plans,Specifications.and Engineering(PS&E)package for the North Tarrant Parkway/US 287
Interchange;and,
WHEREAS, it has become necessary to amend that contract;
NOW THEREFORE,in consideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Local Government do agree as follows:
AGREEMENT
Article 1. Description of Amended Items
The second and third Whereas are deleted in its entirety and replaced with the following:
WHEREAS,Commission Minute Order Number 108812 and 109460 authorizes the State to undertake and complete a
highway improvement generally described as review PS&E package schematic and environmental at US 81/287 to FM
3479/1-larman Road/North Tarrant Parkway;and,
WHEREAS,the Local Govemment has requested that the State allow the Local Government to participate in said
improvement by funding that portion of the improvement described as review PS&E package,schematic and
environmental.at US 81/287 to FM 3479/1-larman Road/North Tarrant Parkway, hereinafter called the"Project;and,
Attachment A is deleted in its entirety and replace with Attachment A-1 which is attached to this amendment.
All other provisions of the original contract are unchanged and remain in full force and effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the
organization they represent.

The City will pay for the cost to review the review PS&E package, schematic and environmental at
US 81/287 to FM 3479/1-larman Road/North Tarrant Parkway. The City's participation is 100% of the
cost of this particular review. The State has estimated the project to be as follows:

Work Responsibilities
The Local Govemment is responsible for the cost of the review PS&E package schematic and
environmental for US 811287 to FM 3479/1-larman Road/North Tarrant Parkway.
The State will review and comment on the schematic, environmental and PS&E package.

SUBJECT: Authorize Execution of Amendment No. 1 to City Secretary Contract No. 29608 with the
Texas Department of Transportation, and Authorize Execution of an Advance Funding
Agreement with Diversified Asset Planning, LLC, for Texas Department of Transportation's
Review of Schematic Design Plans for North Tarrant Parkway/US Interchange and Adopt
Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute an Advance Funding Agreement accepting $20,000 from
Diversified Asset Planning, LLC;
2. Authorize the City Manager to execute Amendment No. 1 in the amount of$20,000 to City
Secretary Contract No. 29608 with the Texas Department of Transportation; and
3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in
the Critical Capital Projects Fund by$20,000.
DISCUSSION:
On January 13, 2004, (M&C C-19929) the City Council authorized the City Manager to execute an
Advance Funding Agreement with Presidio Vista I, Ltd. and a Local Project Advance Funding
Agreement with TxDOT for the review of the schematic design plans for the North Tarrant Parkway/US
287 Interchange.
In May 2006, Presido Vista 1, Ltd., sold the property to Diversified Asset Planning, LLC. TxDOT has
since requested an additional $20,000 for the review of the schematics due to an increase in project
scope of services.
TxDOT prepared Advance Funding Agreement Amendment No. 1 in the amount of an additional
$20,000 to complete its review. City Staff prepared an Advance Funding Agreement with Diversified
Asset Planning, LLC, to memorialize the developer's commitment to reimburse the City for costs
incurred by the City under its agreement with TxDOT to review the schematics for this project. The
Transportation and Public Works Department will be responsible for the collection and expenditure of
these funds in the N. Tarrant Parkway Project of the 2000 Critical Capital Projects Fund.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance funds will be available in the current capital budget, as appropriated,
of the Critical Capital Projects Fund.
