HomeMy WebLinkAboutOrdinance 5908 ORDINANCE N0. y© AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF WEST BERRY STREET AND PORTIONS OF SUNDRY OTHER STREETS AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS IN- TERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAM IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RE- CORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore or- dered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. WEST BERRY STREET From the west line of Cockrell Avenue to the east line of Univer- sity Drive, known and designated as Unit III-B, Project No. 104-23000-115, a 6k-inch Reinforced Concrete Base with a 12-inch Hot-Mix Asphaltic Concrete Surface and 2-inch Binder Base Course to widen existing road- way 6-feet each side. 2. WEST BERRY STREET From the west line of University Drive to the east line of Stadium, Drive, known and designated as Unit IV, Project No. 104-23000-115, a 7- inch Reinforced Concrete Pavement on a 66-foot roadway, and with a 5-inch thick concrete sidewalk where speci- fied. 3. STADIUM DRIVE From the north line of West Berry Street to the south line of Bellaire Drive North, known and designated as Unit V-A, Project No. 104-23000-115, a 7-inch Reinforced Concrete Pavement on a 44-foot roadway, and with a 5- inch thick concrete sidewalk where specified. 4. WEST BERRY STREET EXTENSION From the north line of West Berry Street to the west line of Westcliff Road West, known and designated as Unit V-B, Project No. 104-23000-115, a 7-inch Reinforced Concrete Pavement on a 48-foot roadway, and with a 5- inch thick concrete sidewalk where specified. together with concrete curbs, gutters, sidewalks and incidentals to such improve- ments on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with TEXAS BITULITHIC COMPANY; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street, avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: WEST BERRY STREET From the west line of Cockrell Avenue to the east line of Uni- versity Drive, known and designated as Unit III-B, Project No. 104-23000-115. The estimated cost of improvements is $37,180.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement widening is $5.28; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.28. WEST BERRY STREET From the west line of University Drive to the east line of Stadium Drive, known and designated as Unit IV, Project No. 104-23000-115. The estimated cost of improvements is $93,060.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $1.83; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $3.31; the estimated amount per front foot to be assessed against abutting property and the owners thereof for four-foot wide concrete sidewalk is $1.91; the total estimated ampunt per front foot to be assessed against abutting property and the owners thereof is $7.05. STADIUM DRIVE From the north line of West Berry Street to the south line of Bellaire Drive North, known and designated as Unit V-A, Project No. 104-23000-115. The estimated cost of improvements is $10,120.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $1.83; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $3.31; the esti- mated amount per front foot to be assessed against abutting property and the owners thereof for four-foot wide concrete sidewalk is $1.91; the estimated amount per front foot to be assessed against abutting property and the owners thereof for six-foot wide concrete sidewalk is $2.86; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.05, including four-foot wide sidewalk and $8.00, including six-foot wide sidewalk. 6 WEST BERRY STREET EXTENSION From the north line of West Berry Street to the west line of Westcl£ff Road West, known and designated as Unit V-B, Project No. 104-23000-115. The estimated cost of improvements is $356,941.91; the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $1.83; the estimated amount per front foot to be as- sessed against property and the owners thereof for pavement is $8.49; the estimated amount per front foot to be assessed against abutting property and the owners thereof for six-foot wide concrete sidewalk is $2.86; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $13.18. III. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on thel9th day of February , 19_g, at 9:30 A_M_ , in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be given notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Arti- cle 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Leg., p. 365, ch. 176, § 1, emerg. eff. May 12, 1967. Such notice shall be by advertisement inserted at least three (3) times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least twenty- one (21) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Mail at least fourteen (14) days before the date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the highways, streets, avenues and public places or portions thereof to be improved, as the names of such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions thereof which is to be improved is listed as 'unknown' on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be pre- pared and filed with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known addresses determined as aforesaid of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of each notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Nature of work: The widening and paving. of West Berry Street is proposed from Westcliff Road West to Cockrell Avenue, a total length of 6,300 feet. The roadway on Units IV, V-A & V-B will consist of a seven-inch reinforced concrete pavement with Unit III=$ being constructed of a six and one-half- inch reinforced concrete base with a one and one-half-inch hot mix asphaltic concrete surface, on a two-inch binder base course. Bertram Construction VV and Engineering, Inc. $499,,283.49 220 Schedule of Construction The normal procedure for assessment paving is to hold a Neighborhood meeting, conduct a post card survey, and hold the benefit hearing before issuing a work order. It is 'proposed, however, that the work order for the storm drainage improvements be issued upon the award of the contract in order to expedite completion of the project before activities begin at T.C.U. in the fall of 1968. A Neighborhood meeting will be held and post card survey made before the benefit hearing, which is suggested to be head on February 19, 1968, DATE REFERENCE SUBJECT: PAGE NUMBER Award of Contract - West Berry 2 2 1/22/68 C-1145 Street Extension (CIF A-115) °� Project Cost and Financing Based on the low bid, approximately $62,384 will be assessed against abutting property owners, and the cost to the City-at-Large will be approx- imately $435,000, including engineering and miscellaneous costs. The pro- perty owners' portion of the cost can be financed by transfer from the 'tevolving Fund" to the project account. Approximately $223,000 are available from prior sales, but a bond fund transfer from "Future Sales" of $215,000 will be necessary to complete financing the City's portion of the cost. Assessments will be in accordance with standard City policies.
