WHEREAS, the City of Fort Worth (City) and Brown & Gay Engineers,
Inc. (Engineer) made and entered into City Secretary Contract No. 34091
(the Contract) which was authorized by the City Council by M&C G-15409 on
the 26th day of September 2006, and subsequently revised by one previous
amendment; and
WHEREAS, the Contract involves engineering services for the following
project:
Engineering Design Services: Street Reconstruction, Water and Sewer
Replacement on Merritt Street (White Settlement to 150' N. of Melbourne) ,
Priddy Lane (White Settlement to Melbourne) and Westwind Drive (Lake
Country Dr. to Skylake Dr.) , 2004 CIP Contract Year 4 & 5, Contract 50,
Project No. 00452; DOE No. 5401.
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated December 21,
2007, a copy of which is attached hereto and incorporated herein. The cost
to City for the additional services to be performed by Engineer total
$11,485.
2.
Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for
all work and services shall not exceed the sum of $165,051.

All other provisions of the contract, which are not expressly amended
herein, shall remain in full force and effect.

Dear Mr. Sahu:
On December, 11, 2007,we met to discuss the removal of sidewalks on Westwind Drive. You stated that
based on the public's wishes to not construct sidewalks,the grades in excess of 10%,the associated
expenses with impacts to existing improvements and the expenses related to extensive retaining walls, the
City has decided to remove sidewalks from the scope of the Westwind Drive project.
During this meeting we discussed how to proceed with finalizing the plans for Westwind Drive. The
existing Westwind Drive typical section does not comply with the City's standard typical section. The
proposed vertical profile for Westwind Drive was designed to conform to the City's 10-foot parkway
typical section. The proposed design resulted in cut on the south side of the road,a curb split in excess of
the 0.6 feet recommended for a 28 foot roadway, extensive retaining walls and driveway reconstruction
on private property. Removing the sidewalks without revising the vertical profile will not reduce the
need for retaining walls and the impacts to private property.
We agreed that the redesign of the vertical profile allows the opportunity to reconstruct the roadway in a
manner that minimizes cut and matches the existing roadway as close as possible. BGE proposed a
revised typical section(See Enclosed Exhibit)that will reduce the curb split to within the recommended
parameters,reduce the amount of retaining walls required for construction, and will reduce the extents of
driveway reconstruction on private property. The proposed design change is estimated to save the City
approximately$100,000 in construction related expenses. It will also minimize the impact on the private
property along the street resulting in potentially fewer complaints from residents during construction.
Based on the benefits described in the preceding paragraph, we agreed that Brown&Gay Engineers, hlc.
will redesign vertical profile for Westwind Drive. Along with redesigning Westwind Drive,you
requested that we resubmit one set of construction plans for Utility Clearance Information because of
revised grades on Westwind Drive. Upon your request,I informed you that this constituted a scope
change and that BGE would submit a contract amendment to complete the requested chan es.

Preliminary Plans were returned by the City with comment on July 18, 2007. Immediately BGE finalized
construction plans based on the comments provided. Preliminary plans were reviewed and approved and
two neighborhood meetings were scheduled for October 8,2007 (Merritt and Priddy) and October 18,
2007 (Westwind).
In accordance with our contract,Article V, Section K of the STANDARD AGREEMENT FOR
ENGINEERING SERVICES,Brown&Gay Engineers, Inc.,requests an equitable adjustment to our
contract to account for the additional cost required to perform the City's requested scope change for
Westwind Drive.
The enclosed man hour breakdown to revise the existing design and revise the previously approved
preliminary plans and cross sections includes the time required to make the requested changes. The
proposed$11,485 for these services was determined based on the time estimated to complete at the hourly
rates outlined Exhibit B-2, Hourly Rate Schedule from the STANDARD AGREEMENT FOR
ENGINEERING SERVICES.
