HomeMy WebLinkAboutContract 36727 i AMENDMENT NO. 9 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. r�"f7 (M&C C-22629) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Prime Strategies, Inc. , (Engineer) made and entered into City Secretary Contract No. 27553, (the Contract) which was authorized by the City Council by M&C C-18986 on the 5th day of March 2002 ; and subsequently revised by eight previous amendments in the amount of $4,524,496. 38; and WHEREAS, the Contract involves engineering services for the following project: Project Planning and Design Services for the S.H. 121T (Southwest Parkway) WHEREAS, it has become necessary to execute Amendment No. 9 to said Contract to include an increased scope of work and the same maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include other services as specified in Attachment A and Attachment B, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $800,000 .00 . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $5,483, 609.38 . 03-1 0-08 P01 13 I N CI VHROY 3. It should also be noted that this Scope of Services is based on the best available information at this time and may change within individual tasks, subject to City of Fort Worth approval, from time to time. These changes would also be reflected in modifications to the task budget allocations in Attachment B. TASK B — Technical Analysis and PS&E Amendment No. 2 to the Tri-Party Agreement expanded the roll of the City of Fort Worth in the review and approval of the Plans, Specifications and Estimates (PS&E) for SH 121. Prime Strategies, Inc. continues to work with the NTTA's General Engineering Consultant and 5 section engineers in the SH 121 PS&E packages. This review will ensure that all of the elements of the approved Corridor Master Plan, the mitigation recommended in the Record of Decision, and the architectural/landscaping agreements in Amendment No. 2 are included in the PS&E. The final PS&E submittals and reviews have been delayed to allow completion of the Corridor-wide Master Landscape Plan. The components of the landscape plan need to be integrated into the final PS&E to assure full implementation of the Corridor Master Plan. A PS&E approval process, which includes CAG presentations, two public meetings, a City Council work session and final City Council approval, has been established. The approval process is estimated to take to 8 to 12 weeks, once the Project Team reviews and recommends approval of the final PS&E when submitted by NTTA. TASK C — Public Involvement As directed by the City Manager's office, Prime Strategies, Inc. will prepare project updates and mailers. These materials will coincide with major milestones relating to the approval of the PS&E (TASK B) and other major project activities. The SH 121T website will be maintained and updated. Periodic city page articles will be drafted. Other press related activities, requested by the City of Fort Worth, will also be covered by this Task. TASK D — Financing Alternatives (Complete) TASK E — Negotiate Tri-Party Agreement Amendment No. 2 of the Tri-Party Agreement contemplates future amendments and specifically calls for a final agreement outlining the financial participation and responsibilities of the three (3) partners. The final funding agreement process has been delayed and complicated by the Union Pacific Railroad issues as well as SIB 792. Major issues which still need to be resolved include the Southwest Parkway ownership and design between Dirks and FM 1187 along with revenuu�;���i�� sharing discussions. Prime Strategies, Inc. will also assist in the presentation of the City Council and individual briefings (as required) of mayor and council during and up to completion of the final Tri- Party Agreement. TASK F — Priority Parcel Activities (Complete) TASK G — Financial Plan Implementation (Complete) TASK H — Utility Relocation Coordination (Complete) TASK I — Bellaire Project Team Mgmt./Public Involvement (Complete) TASK J — Citizen's Advisory Group (CAG) — (Complete) TASK K — Right-of-Way Acquisition All right-of-way, except those parcels and easements from the Union Pacific Railroad (UPRR) have been acquired. In addition, there are several outstanding relocations and long term lease parcels remaining. All activities will be in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (Uniform Act). This task, in coordination with City Legal, Real Property, Finance and Environmental Services will assist in finalizing the right-of-way required for SH 121T. Activities in the Task, while not included in the budget, will coordinate environment clean- up/mitigation, clearing of property and title insurance. In addition, the PSI team will assist, as necessary, in any remaining management and demolition/clearing activities. The right-of-way team, as necessary, will also serve as expert witnesses for Special Commissioner Hearings and Jury Trials for condemnation proceedings. TASK L — Corridor Master Plan (Complete) TASK M — EGL Development (Complete) TASK N — Union Pacific Railroad Acquisition of three (3) UPRR parcels and two (2) easements continue negotiations for a global settlement between the Project Partners and the UPRR have not been able to reach an agreement on costs and potential mitigation to construct the Southwest Parkway and Hulen Street Bridge over the Davidson Yard. Activities are proceeding that could result in condemnation and possible action before the Surface Transportation Board. DISCUSSION: On March 5, 2002, (M&C C-18986) the City Council authorized the City Manager to enter into City Secretary Contract No. 27553 with Prime Strategies, Inc., for the project management of the State Highway 121 Project in the amount of$519,113.00. Since that date Council has approved eight amendments bringing the total contract amount to date to $5,043,709.30. Amendment No. 9 provides funding and authorization for professional services for an additional year to December 31, 2008. Prime Strategies, Inc., and their sub-consultants will support the City of Fort Worth Project Team in the continued development of the Southwest Parkway. The anticipated professional services will include general project management and public involvement, public meetings, and open house events as necessary. With the addition of Amendment No. 9 the total authorized contract amount will be $5,843,709.30. Amendment No. 9 also includes several major sub-consultant tasks: 1. The expansion of the scope of work for the Right-of-Way (ROW) team to provide expanded business relocation services that have allowed the City to retain 51 of 56 businesses in Fort Worth; 2. An expanded role in the review of the plans for the Southwest Parkway (SWP) to ensure compliance with the expectations of the Council and community; and 3. Consultant services to support the Project Partners negotiations with the Union Pacific Railroad. With the approval of Amendment No. 9, Prime Strategies, Inc., will have committed to providing for 20 percent M/WBE participation. The State Highway 121T Southwest Parkway will be constructed in COUNCIL DISTRICTS 3, 6 and 9.
