HomeMy WebLinkAboutOrdinance 5708 ORDINANCE, NO. -57/ ©,9 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF CUR70N AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH FOR THE CONSTRUCTION OF SAID IMPROVEME S F Y LETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with S.R.O. As hn alt, Inc_, Arltngtnn rP� Ys for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. CURZON AVENUE: From the East line of Lackland Road to the est line of Sappington Place, known and designated as Unit 1, Project No. 104-24000-151. 2. CURZON AVENUE: From the East line of Sappington Place to the West line of Olive Place, known and designated as Unit 2, Project No. 104-24000-151. 3. BOURINE STREET: From the North line of Libbey Avenue to the South line of Goodman Avenue, known and designated as Unit 3, .Project No. 104-24000-151. 4. PREVOST STREET: From the South line of Humbert Avenue to the South line of Blackmore Avenue, known and designated as Unit 4, Project No. 104-24000-151. 5. PREVOST STREET: From the South line of Blackmore Avenue to the South line of Libbey Avenue, known and designated as Unit 5, Project No. 104-24000-151. 6. PREVOST STREET: From the North line of Libbey Avenue to the South line of Goodman Avenue, known and designated as Unit 6, Project No. 104-24000-151. 7. IiEVI.LE :'.-,e ..orr,i line o: Co11inv;coc, r.venue to 12�)' dort-n of ;:yers _.venue, }:nozrn and designated as snit 1 , i-roject io. 104-2 C-1 1, 14. �3YCE sofa the East line of .;ulen Street to the ..es-' line of .estern ,venue, l:nozrn and : esi nated as unit. 14, roject :.a, 104-24_�20-151, m WHEREAS, by sundry proceedings heretofore passed by the City Council of.the City of Fort Worth, Texas, including Ordinance No. 5641 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5641 a and WKEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT; I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the-true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III, When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
