HomeMy WebLinkAboutContract 36740 CITY SECRETARY CONTRACT NO. 0 740 Memorandum of Understanding And Agreement Between City of Fort Worth And Recovery Resource Council This Memorandum of Understanding and Agreement (Memorandum and Agreement) is made and entered into this -Lj- day of 7nA r , 2008 by and between the City of Fort Worth (the City), a home-rule municipal corporation located in Tarrant, Denton, Parker, and Wise Counties, Texas, acting by and through its duly authorized Assistant City Manager and Recovery Resource Council (RRC), a Texas non-profit corporation, acting by and through its duly authorized Chief Operating Officer. The purpose of this Memorandum and Agreement is to clarify responsibilities between the City's Public Health Department and RRC with regard to the Encouraging WoMen by means of Referrals, Access, Coordination, and Education (EMBRACE) Intervention. EMBRACE was created to address local infant mortality rates among women who have experienced or are at risk for adverse pregnancy outcome due to substance abuse issues and other health- related issues. EMBRACE provides referrals, education, resources, and skill training to in an effort to improve health and reduce the possibility of a subsequent poor birth outcome. This Memorandum and Agreement addresses coordination of outreach services for pregnant and postpartum women who suffer from substance use and establishes a continuum of care for both agencies' populations in order to help reduce poor pregnancy outcomes by addressing and intervening in the areas of substance use for women in our community. 1. SCOPE OF PERFORMANCE City agrees to perform the following: 1) Provide outreach and enrollment for women between the ages of 18-44 at risk for poor pregnancy outcome into the EMBRACE Intervention. 2) Assess enrolled women for substance use problems and refer them to the Resource Recovery Council as needed. 3) Refer all enrolled women for medical, dental or other physical health services as identified in the assessment and as available in the community. 4) Assess and refer women for mental health services as needed. 5) Assess and refer women for other identifiable needs, including employment, education, social services, etc. 03-13-08 P03: 01 IN Memorandum of Understanding and Agreement Page 1 of 4 6) Assist RRC pregnant and postpartum substance abuse clients with present or future pregnancy decisions. 7) Provide access to other services including referrals for pediatric health care; referral to services for family members for issues including substance abuse and social, psychological, vocational, and medical evaluation and treatment. 8) Assist clients with locating additional resources including Federal, State, and local programs that provide a range of treatment and assistance services, including substance abuse, health, mental health, housing, employment, education and training. RRC agrees to perform the following: 1) Refer pregnant and post-partum women presenting for substance use problems into the EMBRACE Intervention. 2) Provide expedited processing of referrals from the EMBRACE Intervention. 3) Communicate with EMBRACE staff to ensure that necessary services are being provided. 4) In coordination with the City, assist with community site (at hospitals, street locations etc.) interventions to encourage or facilitate substance abuse treatment. 2. TERM: The term of this Memorandum and Agreement shall commence on RRC receiving federal funding from the Substance Abuse and Mental Health Services Administration (SAMHSA) and shall continue until such time as terminated in accordance with paragraph four of this Memorandum and Agreement. 3. MODIFICATION: Amendments to this Memorandum and Agreement may be proposed by either party and shall take effect on written approval by both parties. 4. TERMINATION: Either party may terminate this Memorandum and Agreement by providing thirty (30) days written notice to the other party. Memorandum of Understanding and Agreement Page 2 of 4 5. INDEPENDENCE OF PARTIES: Each party shall operate independently and not as an officer, agent, servant, or employee of the other party. Each party shall have exclusive control of and the exclusive right to control the details of performance hereunder, and all persons performing same, and shall be solely responsible for the acts and omissions of its officers, agents, servants, employees, subcontractors. The doctrine of respondent superior shall not apply as between the City and RRC, their officers, agents, servants, employees, subcontractors, or program participants, and nothing herein shall be construed as creating a partnership or joint enterprise between City and RRC. it is expressly understood and agreed that no officer, agent, employee, or subcontractor of RRC is in the paid service of City, and neither party's employees shall be considered joint employees. 6.
