(Engineer) made and entered into City Secretary Contract No. 34414 (the Contract) which was authorized by the City Council by M&C C-21662 on the 14th day of November, 2006; and WHEREAS,the Contract involves engineering services for the following project: Sendera Ranch Pump Station and Ground Storage Tank Construction Management WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 2, 2007, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $62,000. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$320,640.00 3. All other provisions of the contract, which are not expressly amended herein, shall remain in full force and effect. CITY •l U. Job No. 014861.001 Dear Mr. Sewell: The purpose of this letter is to summarize our request for Amendment No. 1 for the Sendera Ranch Pump Station and Ground Storage Tank Construction Management project. We are requesting this amendment for compensation of additional scope activities. Carter & Burgess, Inc. (C&B) was awarded the Sendera Ranch Pump Station and Ground Storage Tank Construction Management on November 14, 2006. The original contract was awarded for $258,640.00. Additional Effort Performed to Date During the original budgeting effort, costs were calculated for the required geotechnical and materials testing that would be required for the project. These budget efforts were calculated based on the number of proposed tests for the construction and on a rate schedule provided by our subconsultant Mas-tek Engineering (a certified minority business). Due to additional testing required for the pre- stressed concrete tank, the original proposed budget of$20,430 has been exceeded. While construction of the concrete tank is complete, additional testing is required in association with the pump station building and valve vaults. We estimate that the required testing for the pump station and valve vaults will require an additional $27,000. We are requesting that this amount be added to the overall project budget. However, testing associated with the construction will continue to be billed based on the number of actual tests performed. The original scope and fee assumed a 12 month schedule for construction. Due to excessive rainfall amounts in the spring and summer, this has resulted in significant time delays for work completion. The estimated completion date of the project will 15 months for construction. We understand that weather delays were unavoidable. However, extending the project schedule will require the attendance at 3 months of additional monthly meetings, review of additional pay estimates and additional project coordination time. In anticipation of this effort we request an additional $15,000 be added to the contract. Carter& Burgess, Inc. is also performing on-site construction representation for an average of approximately 24 hours a week for the duration of the contract, or as required by field activities. For an additional 3 months of construction, we are requesting an additional $10,000 to cover the cost of on-site construction representation. Carter&Burgess,Inc. Carter&Burgess Consultants,Inc. July 2, 2007 Page 2 Additionally, the original contract included up to 80 hours of City/Developer coordination. Due to the important nature of this project for the City of Fort Worth, there has been extensive coordination required between various personnel within the City. This coordination has included the following activities: • Extensive coordination of the field operations review and input into the submittal process; • Coordination and set-up of the payment process between the developer and the City; • Coordination with the developer regarding land access and site access, including coordination with the gas company regarding the existing gas pipelines in the area; • Coordination with COFW inspection personnel and the COFW Water management team to achieve approvals and buy-in. In order to cover costs associated with the additional coordination, we are requesting an additional $10,000. This work has already been performed on the project on behalf of the COFW and the developer. A summary of the additional effort that should be included in this amendment is provided below: • Additional geotechnical testing required (MWBE) $ 27,000.00 • Three months of additional construction administration services $ 15,000.00 • Three months of additional on-site construction representation $ 10,000.00 • Additional coordination with City and Developer, extended schedule $ 10,000.00 Total Effort Additional Effort Required $ 62,000.00 Our total requested budget for Amendment No. 1 is $62,000.00. This would increase the authorized budget for the project to $320,640.00. This represents approximately 3% of the overall construction budget ($9.75M) which is within industry guidelines for engineering services of this size and scope. The original MWBE participation goal was 18%. The original contract for this project was $258,640.00 and the original contract included $60,340.00 for MWBE firms, meeting the participation goal with 23% participation. For amendment 1, the additional geotechnical testing proposed at $27,000 will be performed by Mas-tek, a MWBE firm. The MWBE participation represents 43% of the total proposed amendment and will increase the total MWBE commitment for the overall contract to 27%. DISCUSSION: On November 14, 2006, (M&C C-21846) the City Council authorized execution of an Engineering Agreement with Carter and Burgess, Inc., for Construction Management services during the construction of the Sendera Ranch Pump Station and Ground Storage Tank for $258,640. The facility, located in the Sendera Ranch development, will provide additional water capacity to the Northside III and Northside IV pressure plane, which includes recently annexed Zone 287 area. The original scope and fee of the contract assumed a 12 month construction schedule. Delays in construction have added three months to the schedule, which will require additional attendance at construction monthly meetings, review of additional pay estimates, additional project coordination with the City of Fort Worth, the contractor, the developer, gas pipeline utilities and additional on-site construction representation. Also, more geotechnical testing is required in association with the pump station building, valve vaults and the ground storage tank due to unexpected soil properties and site conditions. This development is zoned MU-2 and located in COUNCIL DISTRICT 7. Carter and Burgess, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 44 percent M/WBE participation on Amendment No. 1. The City's goal on this amendment is 10 percent. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Water Capital Projects Fund.
