Home My WebLink AboutContract 52008-A1 02/27/20 CSC No.52008-A1 9:57 am FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 52008 A COMMUNITY FACILITIES AGREEMENT AND ESCROW AGREEMENT BETWEEN THE CITY OF FORT WORTH AND CASSCO DEVELOPMENT COMPANY, INC. This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 52008 ("First Amendment") is made and entered into by and between the City of Fort Worth, a home-rule municipal coiporatioii of the State of Texas ("City), Cassco Development Company, Inc., a Texas corporation ("Developer"), and Rattikin & Rattikin, L.L.P. ("Escrow Agent"). WHEREAS, the City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure improvements for a project generally described as Ozona Boulevard, City Project Number 101596 ("CFA"); and WHEREAS, the City, Developer, and Escrow Agent entered into an Escrow Agreement as the financial guarantee for the CFA ("Escrow Agreement"); and WHEREAS,the CFA and the Escrow Agreement are on file with the City Secretary as City Secretary Contract Number 52008 ("CSC 52008"); and WHEREAS, after executing CSC 52008, but before proceeding to construction, Developer submitted a revisions to the construction plans for the CFA; and WHEREAS, Developer desires to amend CSC 52008 to reflect the revisions to the construction plans and corresponding changes to the CFA and Escrow Agreement in order to proceed to construction; NOW THEREFORE, City, Developer, and Escrow Agent, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the City Secretary Contract No. 52008: 1. The Cost Summary Table of the CFA is amended to be and read as set forth in Exhibit "A" of this First Amendment. 2. The Water, Paving and Storm Drain Cost Estimates of the CFA are amended to be and read as set forth in Exhibit"B" of this First Amendment. 3. Exhibit A: Water Improvements of the CFA is amended to be and read as set forth in Exhibit "D" of this First Amendment. 5. Exhibit B: Paving Improvements of the CFA is amended to be and read as set forth in Exhibit "E" of this First Amendment. 6. Exhibit B-1: Storm Drain Improvements of the CFA is amended to be and read as set forth in Exhibit "F" of this First Amendment. 7. The definition of"Security Funds" in Section 1 of the Escrow Agreement is amended to be and read as follows: "Security Funds" shall mean the cash deposit of four hundred seventy-one thousand, three hundred fifty-seven dollars and eight-three cents ($471,357.83), which sum represents one hundred twenty-five percent (125%) of the estimated Developer's cost of constructing the CFA Obligations (the "Estimated Developer's Cost"). 8. a. All other provisions of City Secretary Contract Number 52008 which are not expressly amended herein, shall remain in full force and effect. b. All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in City Secretary Contract Number 52008.
