AN ORDINANCE REPEALING ORDINANCE NO. 4290 AND AMEND-
ING ORDINANCE NO. 4283, WHICH ORDINANCES REGULATED
THE RATES AND CHARGES MADE BY PERSONS, CORPORATIONS
OR ASSOCIATIONS ENGAGED IN THE BUSINESS OF FURNISHI-
ING, DISTRIBUTING OR DELIVERING NATURAL GAS TO
DOMESTIC OR COMMERCIAL CONSUMERS DURING THE PERIOD
BETWEEN THE METER READING DATES IN MAY AND OCTOBER
OF EACH YEAR, BY PROVIDING NEW AND ADDITIONAL
SCHEDULES RELATING TO GAS SERVICE FOR AIR CONDITION-
ING; PRESCRIBING A PENALTY; AND NAMING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTIi,
TEXAS:
SECTION 1.
That Ordinance No. 4290 is hereby expressly repealed.
SECTION 2.
That all persons, firms, corporations or associations of persons
engaged in the business of furnishing, distributing or delivering natural
gas to domestic and commercial consumers in the City of Fort Worth may
charge for such service, during the periods of time and from the dates
hereinafter set out, in accordance with the following schedules:
(a) For quantities of natural gas less than 8,000 cubic
feet consumed by residential customers using gas for
air conditioning purposes during billing periods
between the meter reading dates in May and October of
each year, the rates prescribed in Ordinance No. 4283
shall be charged.
(b) For quantities of natural gas in excess of 8,000 cubic
feet consumed by residential customers using gas for
air conditioning purposes during billing periods between
the meter reading dates in May and October of each
year
$0.05933 gross per 100 cubic feet and
$0.0534 net per 100 cubic feet for payment
of bill within ten (10) days from the date
of billing shall be charged.
(c) For quantities of natural gas separately metered and
consumed by commercial customers for air conditioning
purposes during billing periods between the meter
reading dates in May and October of each year
$0.05933 gross per 100 cubic feet and
$0.0534 net per 100 cubic feet for payment
of bill within ten (10) days from the date
of billing shall be charged.
SECTION 3.
That the adoption of this ordinance shall constitute an amendment
of Ordinance No. 4283, but except as hereby amended, Ordinance No. 4283
shall remain in full force and effect.
SECTION 4.
That .any person, firm or corporation who refuses to comply with
the terms and provisions of this ordinance shall be deemed guilty of a
misdemeanor and, upon conviction, may be fined not to exceed Two Hundred
Dollars ($200.00) , and each day's violation shall constitute a separate
offense.
SECTION 5 .
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage and publication as provided
by law.

'F Amendment of Ordinance 4283
On May 20, 1960, Ordinance No. 4290 was adopted prescribing rates
for seasonal gas air-conditioning service for commercial and resi-
dential customers. This ordinance was re-exeained in connection
with the recently completed investigation of the renewal of the
proposed consent agreement with Lone Star Gas and it was found
that the special air-conditioning rate set in sections (a) and,
(b) of the ordinance is approximately three times higher than that
actually charged to customers for gas being used for air-conditioning
purposes.
A draft ordinance, which is attached, has been prepared which will
correct the errors in sections (a) and (b) of the r4U ordinance
approved on May 200 1960. Below is a tabulation of the rates pre-
viously set by ordinance, comxpared with the rates the company has
been and is now charging for seasoned commiercial and residential
air-conditioning service.
Ordinance 4290 now reads- and should read-
$.1760 gross per 100 cubic feet $005933 gross per 100 cubic feet
$.1584 net per 100 cubic feet $.0534 net per 100 cubic feet
The following is the amending language of the proposed ordinances
"(a) For all natural gas consumed by residential customers using
natural gas for air-conditioning in excess of 8,000 cubic feet per
month per dwelling unit for each meter reading period between the
meter reading dates in May and October of each year, $.05933 gross
per 100 cubic feet and $.0534 net per 100 cubic feet for payment of
bill within ten days from the date of monthly billing. For consump-
tion of gas in quantities less than 8,000 cubic feet, the Fated pre-
scribed in Ordinance 4283 shall be charged.""
"(b) For all natural gas consumed by commercial customers for air-
conditioning during each meter reading period between the meter read-
ing dates in May and October of each year, $.05933 gross per 100 cubic
feet and $.0534 net per 100 cubic feet for payment of bill within ten
days from the date of monthly billing."

In addition to correction of the rate amount figures, the rate
schedule is also clarified by adding a sentence to section (a)
which provides as follows: "For consuaption of gas in quantities
less than 8,000 cubic feet, the rates prescribed in Ordinance 4283
shall be charged." Attached is a tabulation which shows the effect
upon customer utility gas bills of the summer gas air-conditioning
rates.
In order to rectify errors made in the enactment of Ordinance 4290
and further clarify the intent of the City Council in setting gas
utility rates in Ordinance 4283, it is recommended that the pro-
posed ordinance be adopted. This change has been reviewed by
Lone Star Gas Ccmip=W officials who have agreed to the proposed
new ordinance.
