IN THE CITY OF FORT WORTH, TEXAS; ILCLARING TIFT CONTRACT WITH

EXECUTION AND DELIVERY OF CERTIFICATES IN 'z'VIDE'NCR OF SPECIAL ASSESS-
MENTS LEVIED ASTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOMv_ OF SAID ASSESSM'MTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND MIROLL THIS OP I'TANCM BY COPYING THT CAP-
TION OF SAME IN THE MINUTE BOOK OF THE .CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AMD E'FF-'OTIVE DATE.
1 'EAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with -E. Brittain, Inc. for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public places
in said City, to-wit;
1. From Craig Street to Brent.,00d Drive,
known anc designated as Unit no. 1, a
1-' inch hot-mix asphaltic concrete
surface on an 8" cement stabilized gravel
base.
2. B:'F_NT.lGCD D cIVE: From Handley i rive to East Loop IH-2,,20, known
anu designated as unit no. 2, a 12 inch
hot-mix asphaltic concrete surface on an
3 inch cement stabilized gravel base.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Port Worth, Texas, including Ordinance No. 5005 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting on each
of the above described portions of streets, avenues and public places and against the real
and true owners thereof; and,
WFI�"2rE1S, the City Council of the City of Fort Worth, Texas, has, upon re—
view, found and determined that, in some instances, in order to effect substantial ,justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5005 , and
'ATMAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described, and
have been inspected and found to be in complete accordance with the contract therefor;
NOW, TH7M_3FORE0
BE IT ORDAI'3D BY TIE CITY COUNCIL OF THE CITY OF FORT WORTH,
TI'XAS, TEAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with re—
ference thereto be, and it is hereby, found and declared fully completed and performed.
I I.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true, owners of the respective parcels of pro—
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The numbers
of the certificates, with the property descriptions to be shown on the respective certifi—
cates, toTether with the names of the owners of said property, the principal amount of the
assessment, the respective credits, if any which are hereby authorized, granted and allowed
against the principal amount of some one or more of the assessments heretofore levied, and the
principal amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

Project Description:
Name: Handley Drive Paving and Storm Drain Improvements, Units I and II

Contract Awarded: July 29, 1963 (M&C C-118)
Work Order Issued: September 27, 1963
Date of Final Inspection and Approval: April 30, 1964
Working Time Bid: 60 Working Days
Two additions were made to the scope of the work: The channelization
at the intersection of Handley Drive and Brentwood Drive (M&C C-118),
and the lime stabilization- of the subgrade at certain locations.
Because lime stabilization is a separate and distinct operation from
the construction called for in the contract, the contractor was re-
quired to reschedule both his personnel and equipment. Therefore, it
is proposed by the Public Works Department that the working time be
increased 15 days, from 60 working days to 75 working days, as an
equitable adjustment to cover the additional work.
Working Time Used: 83 Working Days
On projects ranging in price from $100,000 to $250,000, the contract
provides for a deduction from payment due the contractor of $50.00
for each day used in excess of the working time as bid or adjusted
for liquidated damages.
Project Cost and Financing:
Original Bid Price $131,551.40
Added by Council Action 1,000.00
Adjusted Bid Price $132,551.40
Final Contract Cost $138,334.67
Less 8 Days liquidated
damages @ $50.00 per day 400.00

in was necessary to lower existing sanitary sewer
service lines. + $1,812.66

Compliance with Specifications: -
Attached is a tabulation of paving test cores showing results of depth
thickness. Test cores were made of, the cement stabilized base and
axphalt surface after construction. As shown on the core test report,
some depth thickness of the asphalt showed marginal compliance to surface
depth requirements. Based on additional cores taken, areas where the
HMAC surface were found deficient in excess of k inch in thickness were
removed and replaced to specified plan thickness as shown on the core
tabulations. Tests showed that the sub-base, base, and pavement
material used was in compliance with specifications.
Recommended Council Action:
1. That the above project be accepted by adoption of an ordinance.
2. That final payment of $13,316.06 be authorized to W. B. Brittain, Inc.
