Brittain FOR THE CONSTRUCTION OF SAIMPROV71-(TTNTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSU. TEX. EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ME'R1TS LEVIED AFTER GIVING EFFECT TO S=_ Y CREDITS HEYmIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSM'INTS; DIPTOTING THE CITY SECRETARY TO ENGROSS AND F?UiOLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING A*1D 7FMTIVE DATE. ttiIMEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with W E. Brittain for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. Ray Alvin Street From Sarah Jane Lane to the North Line of Lot 1, Block 7, Tarrant Addition, Known and designated as Unit No. 1 2. Burchill Road South From Thrall Street to Binkley St. known and designated as Unit No. 2 3. Thrall Street From Burchill Road North to Bideker Street, known and designated as Unit No. 3 4. Erath Street From Martin Street to Knox Street known and designated as Unit No. 4 5- Sarah Jane Lane From Ray Alvin Street to Lot 10-C Peaceful Acres Addition, Known and designated as Unit No. 5 6. Rodeo Street From El-Rancho Road to Ray Alvin Street, known and designated as Unit No. 6 7. Turner Street From Walker Street to Stallcup Road, known and designated as Unit No-7 S. Knox Street From Erath Street west 1501 to existing pavement, known and designated as Unit No. S WHMEAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 46 37 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHr�iFS, the City Council of the City of Fort Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial ,justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 14611 , and WHM,AS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and puUic places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, T=FORE, BE IT 01RDAI73"D BY TV. - CITY COUNCIL OF TIE CITY OF JWT WORTH, TE'RAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. Iv. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
