INTERLOCAL AGREEMENT FOR HEALTH OFFICER
THIS AGREEMENT is entered into this day of

WorfA, a home rule municipal corporation situated in Tarrant
County, Texas, hereinafter called "City", acting herein by and
through Libby Watson, its duly authorized Assistant City Manager,
and Tarrant County, Texas , hereinafter called "County", acting
herein by and through Tom Vandergriff , its duly authorized County
Judge as directed by the Commissioners Court of Tarrant County,
Texas ,
W I T N E S S E T H
WHEREAS, Chapter 791 of the Government Code of Texas
authorizes the formulation of interlocal cooperation agreements
between and among municipalities and counties; and
WHEREAS, County wishes to participate in an interlocal
agreement with City, whereby the Director of Public Health of the
City of Fort Worth is designated as the County Health Officer and.
Chief Administrative Officer of the County Health Department; and
WHEREAS, County and City mutually desire to be subject to
the provisions of Chapter 79.1 of the Government Code of Texas,
also known as the Interlocal Cooperation Act; NOW, THEREFORE, it
is agreed as follows;

Purpose
The purpose of this Interlocal Agreement is to . enter into an
agreement between City and County whereby City agrees that County
may name City's Director of Public Health as the County Health
. Officer and Chief Administrative Officer of the County Health
Department, for the benefit of County alone.
2.
Term
The term of this Agreement is for a period of one (1) year
beginning October 1 , 1994 and ending September 30 , 1995 .

3.
Designation of Officer
The Director of the Department of Public Health of the City
of Fort Worth is hereby designated to act as and perform the
functions and duties of the County Health Officer and Chief
Administrative Officer of the County Health Department .
4.
Performance of Duties
The relationship between the City and its Director of the
Department of Public Health of the City of Fort Worth shall be
unaffected hereby. While in the performance of his functions and
duties on behalf of the County, the County health Officer and
Chief Administrative Officer of the County Health Department
shall not be considered an officer, agent ' or employee of the City
of Fort Worth. While in the performance of his functions and
duties as Director of the Department of Public Health of the City
of Fort Worth, Texas, said Director shall not be considered an
officer , agent or employee of Tarrant County, Texas .

Powers of Officer
The Chief Administrative Officer of the County Health
Department shall have the power and authority to plan, direct,
supervise and modify the activities of the County Health
Department and to designate such employees of the County Health
Department as custodians of County property or as other official
designees as he. may deem necessary or appropriate, subject to
such discretionary review and approval by the Commissioners '
Court of Tarrant County as it deems necessary. Within the
limitations of the County budget and consistent with County
personnel policies , the County Health Officer, appointed hereby,
together with the Commissioners' Court of Tarrant County or its
designee, shall together be vested with full authority to hire,
direct and terminate employees of the County Health Department
along with their other functions and duties in compliance with
appropriate personnel policies of the County.
6.
Consideration
To help defray the cost of the additional administrative
burden on the City, County agrees to pay City Forty-Four Thousand
Dollars ($44,000) for the administrative services of the Director
of the Department of Public Health of the City of Fort Worth
while serving in the capacity of County Health Officer and Chief
Administrative Officer for Tarrant County during the period from
October 1, 1994 to September 30 , 1995 . The sum of Forty-Four
Thousand Dollars ($44, 000 ) payable hereunder shall be paid in a

lump sum payment due forty-five (45) days after execution of the
contract . Payment shall be from revenues currently available to
the County .
7 .
Immunity
It is expressly understood and agreed that , in the execution
of this Agreement, neither City nor County waives , nor shall be
deemed hereby to waive, any immunity or defense that would
otherwise be available to it against claims arising in the
exercise of governmental powers and functions .
8.
Entirety
This Agreement contains all commitments and agreements of
the parties hereto, and no other oral or written commitments
shall have any force or effect if not contained herein.
9.
Seyerability
In case any one or more of the provisions contained in this
Agreement shall for any reason be held to be invalid, illegal , or
unenforceable in any respect, such invalidity, illegality, or
unenforceability shall not affect any other provision thereof and
this Agreement shall be construed as if such invalid, illegal , or
unenforceable provisions had never been contained herein.

Authority
This Agreement- is made for City and County as an Interlocal
Agreement pursuant to Chapter 791 of the Government Code of
Texas.
11.
Authorisation
The undersigned officer and/or agents of the parties hereto
are properly authorized officials and have the necessary
authority to execute this Agreement on behalf of the parties
hereto, and each party hereby certifies to the other that any
necessary resolutions extending such authority have been duly
passed and are now is full force and effect .

SUBJECT I HEALTH SERVICES CONTRACTS WITH TARRANT COUNTY, FISCAL YEAR 1994-95

RECOMMENDATIONS:
It is recommended that the City Council authorize the City Manager to accept and execute
two health services contracts with Tarrant County Commissioners Court in the areas
described below. j
DISCUSSION:
On a yearly basis, the City of Fort Worth and Tarrant County have entered into contracts
authorizing City participation in a cooperative arrangement with the Tarrant County
Commissioners Court. These annual agreements detail specific County contributions to
the City for the provision of county-wide health services by the Fort Worth Health
Department. Terms for two contracts for the period October 1, 1994 through
September 30, 1995 have been drafted.
The two contractual agreements are as follows:
1 . City Health Director to Serve as Chief Administrative Officer of the County Health
Department - This agreement provides for the City Health Director to serve as the
Chief Administrative Officer of the County Health Department acting as and per-
forming the functions and duties of the County Health Officer with the power and
authority to plan, direct and supervise activities of the County Health Department.
For this arrangement, the County agrees to pay the City the sum of $44,000.00.
2. Building Maintenance, Janitorial, Utility and Telephone Services - Under the terms
of this contract, the City will provide building maintenance, utilities and telephone
services to County Health Department staff and clients at the Public Health Center.
In return for this consideration, the County agrees to pay the City the sum of
F $43,360.00.
FISCAL INFORMATION/CERTIFICATION:
The Cash Management Division of Fiscal Services is responsible for collection and deposit
of all fees due the City under these health services contracts.
