HomeMy WebLinkAboutOrdinance 7708 ORDINANCE NO. -�f AN ORDINANCE VACATING, ABANDONING AND CLOSING THE EAST/WEST ALLEY A WIDTH OF 12' AND A LENGTH OF 125' ADJACENT TO LOTS 1R, 3, 4 AND 5, AND THE NORTHERN 113' OF THE NORTH/SOUTH ALLEY A WIDTH OF 13' ADJACENT TO LOTS 1R, 5 AND 6, BLOCK 27, AND LOT 1R1, BLOCK 28-R, RYAN AND PRUITT ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the east/west alley a width of 12' and a length of 125' adjacent to Lots 1R, 3, 4 and 5, and the northern 113' of the north/south alley a width of 13' adjacent to Lots 1R, 5 and 6, Block 27, and Lot 1R1, Block 28-R, Ryan and Pruitt Addition to the City of Fort Worth, be and the same are hereby vacated, abandoned and permanently closed as alleys, SAVE AND EXCEPT easements are reserved therein for any and all existing utilities including the existing sanitary sewer, telephone and electric distribution facilities. SECTION 2. That the fee to the lands in the above described vacated alleys is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT easements are re- served therein for any and all existing utilities including the existing sanitary sewer, telephone and electric distribution facilities. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Blk. 27, Lots Irk ZONE BOUNDARY `r•'.3 thiu 6, Blk. -28, Lot-1R1 St. Louis Ave. north of Bowie Street REQUESTED VACATION COMMISSION MEETING ORDINANCE NUMBER SECTOR ' November 30, 1977 South Side V�77- 61 CITY PLANNING DEPARTMENT FORT WORTH, TEXAS City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Vacation of Alley - Ryan and PAGE NUMBER Pruitt Addition, Block 27, St. Louis 1 2/28/78 PZ-839 Avenue North of Bowie Street (V-77-61) IOf Hydraulics, Inc,, owner of Lots 3, 5, 6 and 1R, Block 27, Ryan & Pruitt Addi- tion, with consent of all other abutting property owners, has requested that the City vacate the east/west alley a width of 12' and a length of 125' adjacent to Lots 1R, 3, 4 and 5,and to vacate the northern 113' of the north/south alley a width of 13' adjacent to Lots 1R, 5 and 6, Block 27; and Lot 1R1, Block 28R, Ryan and Pruitt Addition, as shown on the attached map. The subject alley, acquired by dedication, is neither paved nor open, but con- tains a sanitary sewer, telephone and electric distribution facilities. Reloca- tion of the sanitary sewer is underway, and appropriate arrangements have been made regarding the other two utilities. The Plan Commission has also required dedication of a new 12' wide alley between Lots 6 and 7, Block 27, for access to St. Louis Avenue, a 15' x 15' public open space easement at the intersection of the new alley and St. Louis Avenue, and a replat which incorporated the vacated alley right-of-way. Such a replat, incorporating the above require- ments, has been submitted and has been reviewed by City staff. Recommendation It is recommended that an ordinance be adopted vacating the subject alley as requested.
