Hamm Speed Fab-Crete Corporation 1150 E Kennedale Parkway Fort Worth, Texas 76060 Via: Certified Mail# Email—rhamm�a�speedfab-crete.com Re: Contract Termination Notice City Secretary Contract No. 52867 ("Contract") Dear Mr. Hamm: Pursuant to Article 9.3 of the Contract, the City of Fort Worth ("City") has the right to terminate the Contract. This letter is to inform you that City is exercising its right to terminate the Contract. The purpose of the Contract was for Speed Fab-Crete Corporation ("Contractor") to design and build the South Patrol Division Facility ("Project"). This termination will be effective upon the completion of the Final Design of the Project, as defined by Article 2.2 of the Contract. Contractor is hereby directed not to incur any additional costs related to construction of the Project. The only costs from the date of this termination notice shall be related to the design of the Project. City intends to complete the construction of the Project through a request for proposal. City will pay Contractor for all work performed up to the date of this termination notice, as well as all work directly associated with the completion of the design construction documents, however, City will not pay for any lost or anticipated profits. In the first payment to Contractor under this Contract, City paid for the purchase of Payment and Performance Bonds ("Bonds"). If the bond premiums associated with the Bonds have not been paid, Contractor is directed to not pursue purchasing the Bonds. If the premiums for the Bonds have been paid, Contractor shall terminate the Bonds and recapture any available prorated premiums for remittance to City.
