HomeMy WebLinkAboutResolution 5198-03-2020 A Resolution NO. 5198-03-2020 AUTHORIZING THE CLOSURE OF PORTIONS OF EAST 1st STREET AND PEACH STREET AT UNION PACIFIC CROSSINGS WHEREAS, the City of Fort Worth Transportation and Public Works Department, has requested that the City Council approve the closing of portions of East 1st Street and Peach Street located in the R. Briggs Survey, Abstract No. 116, containing collectively 18,804 square feet, and WHEREAS, this street closure is required to permit the closure of two railroad crossings to enhance public safety; and WHEREAS,the City Plan Commission reviewed the request on August 28, 2019, and recommends that the request be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: 1. That a portion of Peach Street, lying at the intersection of said streets, situated in the R. Briggs Survey, Abstract No. 116, City of Fort Worth, Tarrant County, Texas, and containing approximately 10,139 square feet of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be physically closed with appropriate end-of-road treatment. 2. That a portion of East 1st Street, lying at the intersection of said streets, situated in the R. Briggs Survey, Abstract No. 116, City of Fort Worth, Tarrant County, Texas, and containing approximately 8,665 square feet of land more or less, and as more specifically described in Exhibits "C" and "D" attached hereto and incorporated herein by reference be physically closed with appropriate end-of-road treatment. 3. That access into the closed streets shall be allowed for maintenance of water, sewer, electric, cable, and telephone utility facilities, unless other satisfactory arrangements are made, including relocation at the applicant's expense. 4. That the rights-of-way be physically closed with an acceptable barricade or other satisfactory arrangements approved by the City of Fort Worth Department of Transportation and Public Works. The City shall retain title to the public right-of-way in said streets and any and all easements for existing and prospective utilities, and retaining the right of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access: In addition, the City reserves the right, at the sole discretion of the City Council, to reopen by resolution the aforesaid streets and alleys at any time by directing the removal of any barricade or other means of closure. DISCUSSION: The Transportation Public Works Department has requested the physical closure of these portions of East 1 st Street and Peach Street to permit permanent closure of these two railroad crossings. The City Plan Commission recommended approval of this request at its meeting on August 28,2019. The City will install gates that meet the requirements of the Transportation and Public Works Department. The City will retain title to the public right-of--way in the streets,retain any and all easements for existing and prospective utilities,and retain the right of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access. The City reserves the right,at the sole discretion of the City Council,to reopen by resolution the street right-of-way to public travel at any time by directing the removal of any barricade or other means of closure,and reconstruction of the roadway. This project is located in COUNCIL DISTRICT 8. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
