THIS AGREEMENT is entered into by and between the City of Fort Worth, Texas, a home-rule municipal
corporation situated in Tarrant, Denton, Parker, and Wise Counties, Texas, hereinafter called "Fort Worth,"
acting herein by and through Valerie Washington, its duly authorized Assistant City Manager and
Tarrant County,Texas acting herein by and through B.Glen Whitley its duly authorized
County Judge as directed by the County Commissioners Court.
Throughout this document the term "County" or "the County" when used in the context of a party to the
agreement shall mean Unincorporated Tarrant County,Texas.

VOUCHER UTILIZATION
The County:
_X_DOES wish to use a voucher system for its residents visiting the Fort Worth Drop-off Stations.
DOES NOT wish to use a voucher system for its residents visiting the Fort Worth Drop-off Stations.
If a voucher system will be used only residents with an official voucher provided by the County will be allowed
to drop waste at the Fort Worth citizens Drop-off Stations. A copy of the official voucher must be attached to
this agreement.

WHEREAS, Texas Government Code, Chapter 791, authorizes the formulation of interlocal cooperation
agreements between and among local governments;and
WHEREAS,Texas Government Code,§791.011 provides that a local government may contract with another local
government to perform governmental functions and services,and §791.003(3)(H) defines waste disposal as a
governmental function and service;and
WHEREAS,Texas Government Code, §791.025 provides that a local government may agree with another local
government to purchase services;and
WHEREAS, Fort Worth and the County desire to enter into an interlocal agreement whereby Fort Worth will
purchase the services of a waste disposal/recycling firm or firms and will administer collection,disposal and/or
recycling brush, bulky waste, bagged garbage, mixed items, recyclable materials, donated items and limited
special waste(residential building materials,tires, Freon containing items,electronics including televisions and
computer monitors/screens)at all four(4) Drop-Off Stations program within the County;and
WHEREAS; Fort Worth and the County mutually desire to be subject to the provisions of Texas Government
Code,Chapter 791,also known as the Interiocal Cooperation Act.
NOW THEREFORE,it is agreed as follows:
1.
DEFINITIONS
A. Unless a provision in this Agreement explicitly states otherwise, the following terms and phrases, as
used in this Agreement,shall have the meanings hereinafter designated.
Act of God means an act occasioned by the direct, immediate,and exclusive operation of the forces of
nature, uncontrolled or uninfluenced by the power of humans and without human intervention.
DroD_On Station (DOS) Drop-off stations are open to Fort Worth and Unincorporated Tarrant County
homeowners for disposal of trash,brush,recyclables and donated Items.To use a drop-off station,show
a valid Unincorporated Tarrant County voucher(Type A or B)and driver license.Locations go as follows:

"Type A Voucher"—Bulk,mixed waste means materials such as broken furniture,vacuums,mops or
brooms,framed mirrors or paintings,glass windows or doors,patio umbrellas,small bookshelves,

lamps,chairs,and tables not to exceed 10 cubic yards.Single stream recyclables means acceptable
materials such as clean and dry paper items(newspaper,magazines,catalogs,junk mail cardboard
boxes,chip-board,office paper,and aseptic milk,juice and soup cartons);rinsed and empty plastic
containers(#1 through#7,except Styrofoam);glass,steel and aluminum containers and cans,and
clean single-use plastic bags or package wrap films(#4).Scrap metals such as fences,gutters,rebar,
mail boxes,baking or cooking sheets,pots,pans and skillets,and car parts. Donation items that are
resalable such as clothes,shoes and accessories,small appliances such as microwaves,toasters,
blenders,electric skillets,electronic toys,stereos, record players,clock radios,and electronics such as
computers(stationary or laptop)excluding separate monitors or display screens,tablets,Mods or
routers.VCRs,video games or consoles,cameras(digital,35mm,110,etc.),cassette tapes,CDs and
DVD players,cell phones,fax machines,and uninterrupted power supplies(UPS). Large appliances
such as washers,dryers.Items can be working or non-working.
"Type B Voucher"- Bulk,mixed waste,recyclable materials and donated items included in Type A
Vouchers,as well as limited special waste materials meaning residential building materials and
household construction debris such as carpet,drywall,lumber and insulation,tires(limited to four
tires per visit),Freon containing items(limited to three items per visit),and specifically televisions and
computer monitors/screens(limited to three items per visit)not to exceed 10 cubic yards.Materials
such as: roofing shingles,rock,concrete,asphalt,dirt,ceramic tiles,asbestos, PCBs,household
hazardous and medical waste,radioactive items(oil field pipes and smoke detectors)and ammunition
are not acceptable materials and excluded from both vouchers.
Environmental damages means all claims, judgments, damages, losses, penalties, fines, liabilities
(including strict liability),encumbrances, liens,costs,and expenses of investigation and defense of any
claim,whether or not such claim is ultimately defeated,and of any good faith settlement or judgment,
of whatever kind or nature, contingent or otherwise, matured or un-matured, foreseeable or
unforeseeable, Including without limitation reasonable attorney's fees and disbursements and
consultant's fees, any of which are incurred subsequent to the execution of this Agreement as a result
of the handling,collection,transportation,storage,disposal,treatment,recovery,and/or reuse of waste
pursuant to this Agreement,or the existence of a violation of environmental requirements pertaining to
same,and including without limitation:
(a) Damages for personal injury and death,or Injury to property or natural resources;
(b) Fees incurred for the services of attorneys, consultants, contractors, experts, laboratories and
all other costs incurred in connection with the investigation or remediation of such wastes or
violation of environmental requirements including, but not limited to, the preparation of any
feasibility studies or reports or the performance of any cleanup, remediation, removal,
response, abatement, containment, closure, restoration or monitoring work required by any
federal, state or local governmental agency or political subdivision, or otherwise expended in
connection with the existence of such wastes or violations of environmental requirements,and
including without limitation any attorney's fees, costs and expenses incurred in enforcing this
Agreement or collecting any sums due hereunder;and
(c) Liability to any third person or governmental agency to indemnify such person or agency for
costs expended in connection with the items referenced in subparagraph(b)herein.
Environmental requirements means all applicable present and future statutes, regulations, rules,
ordinances, codes, licenses, permits, orders, approvals, plans, authorizations, concessions, franchises,
and similar items, of all governmental agencies, departments, commissions, boards, bureaus, or

instrumentalities of the United States, states, and political subdivisions thereof and all applicable
judicial, administrative, and regulatory decrees, judgments, and orders relating to the protection of
human health or the environment,including without limitation:
(a) All requirements, including but not limited to those pertaining to reporting, licensing,
permitting, investigation, and remedlation of emissions, discharges, releases, or threatened
releases of hazardous materials, pollutants, contaminants, or hazardous or toxic substances,
materials, or wastes whether solid, liquid, or gaseous in nature, into the air, surface water,
groundwater,storm water,or land,or relating to the manufacture,processing,distribution,use,
treatment, storage, disposal,transport, or handling of pollutants,contaminants, or hazardous
or toxic substances,materials,or wastes,whether solid,liquid,or gaseous in nature;and
(b) All requirements pertaining to the protection of the health and safety of employees or the
public.
Force maieure means decrees of or restraints by a governmental instrumentality other than the Parties,
acts of God, work stoppages due to labor disputes or strikes, failure of Fort Worth's contractor(s) to
perform pursuant to their agreements with Fort Worth for the conduct of the collection of household
hazardous waste, fires, explosions, epidemics, floods, extreme weather, riots, war, rebellion, and
sabotage.
Participating Entities when used in the plural,means Fort Worth,County,and all other entities which
have entered into interlocal agreements with Fort Worth for the DOS bulk material and recycling
program.
Person means an individual, corporation, organization, government, or governmental subdivision or
agency,business trust,partnership,association,or any other legal entity.
Waste has the same meaning as"solid waste"as that term is defined in Texas Health and Safety Code
§361.003,and including hazardous substances.
B. Unless a provision in this Agreement explicitly states otherwise,the following abbreviations,as used in
this Agreement,shall have the meanings hereinafter designated.
2.
PURPOSE
The purpose of this interlocal agreement(hereafter"Agreement")is the provision of services by Fort Worth to
County whereby,subject to the terms and conditions specified below, Fort Worth will administer and supervise
an unincorporated Tarrant County bulk waste disposal and recycling services, which will be available to
households within Unincorporated Tarrant County as described herein.
3.
TERM
This Agreement shall be effective from the date the last party has signed this Agreement.This Agreement maybe
renewed yearly by mutual written agreement. Either party may terminate this agreement by providing 45 days
advance notice. .Fort Worth shall be compensated for any services provided to Tarrant County and shall provide
such services up to the 45u'day or as otherwise agreed to and provided in the notice.

4.
SERVICES OF FORT WORTH
Fort Worth agrees to perform the following services for Unincorporated Tarrant County in connection with the
bulk waste and recycling program:
A. Fort Worth will administer an Unincorporated Tarrant County bulk waste and recycling program.This
program will include the operation of the Drop-Off Stations, which will accept for disposal and/or
recycling of bulk material located within Unincorporated Tarrant County.
B. Fort Worth will employ or retain personnel to provide the services necessary to perform Fort Worth's
obligations in this Agreement.
C. Fort Worth will enter into a contract(s) with a waste disposal/recycling firms) for the handling,
collection, transportation, storage, disposal, treatment, recovery, and/or reuse of bulk waste and
recyclable material.
D. Fort Worth will,if requested in writing by County,provide County with copies of waste manifests for
shipments of waste from the Drop-Off Stations.
E. Fort Worth will,provide County a quarterly report of applicable County's household vouchers received
for disposal of bulk and recyclable material at the DOS.
F. Fort Worth will issue a report and an invoice at the end of each quarter detailing the number of County's
households that disposed of bulk and recyclable material at the DOS.
G. Fort Worth will act under this Agreement in accordance with all applicable state and federal laws.

5.
DUTIES OF UNINCORPORATED TARRANT COUNTY
County agrees to perform the following duties in connection with the bulk material and recycling disposal
program:
A. County will designate one of its employees,and another as an alternate,to act as the primary Operational
Contact and administer distribution of no more than 2,500 Unincorporated Tarrant County vouchers(Type
A and B)to residents located within Unincorporated Tarrant County on an annual basis and process quarterly
invoices within 30 days of receipt.
B. County will coordinate and fund all program advertising targeted to its own unincorporated citizens,as
It deems necessary.Such advertising shall include the type of wastes that will and will not be accepted
at the DOS,the requirement the Unincorporated Tarrant County vouchers(Type A and B).
C. County shall notify its residents of the DOS hours of operation and dates it Is closed as provided in
Section 7"-Drop-Off Station Hours of Operation."

D. County will require a quarterly report listing the number of its county's households that have disposed
of material at the DOS.
E. If a County resident presents waste that was collected from multiple households, Fort Worth reserves
the right to charge the County based on the total number of households from which the waste originated
even if the resident has only one voucher.
6.
USE OF WASTE DISPOSAL/RECYCLING FIRMS FOR BULK AND RECYCLING MATERIALS
A. Fort Worth will enter into a contract(s) with a waste disposallrecycling firm(s) for the handling,
collection,transportation,storage,disposal,treatment,recovery,and/or solid waste,from the DOS.
B. Such firm(s) shall be required pursuant to the contract(s) to assume generator status for the waste
collected,(excluding used oil,lead-acid batteries and antifreeze)to choose a disposal site for the waste
subject to Fort Worth's approval,and to Indemnify Fort Worth and participating entities against any and
all environmental damages and the violation of any and all environmental requirements resulting from
the handling, collection, transportation, storage, disposal, treatment, recovery, and/or recycling of
waste collected pursuant to this agreement,when said environmental damages or the violation of said
environmental requirements was the result of any act or omission of contractor, Its officers, agents,
employees,or subcontractors,or the joint act or omission of contractor,its officers,agents,employees,
or subcontractors and any other person or entity.
C. THE PARTIES RECOGNIZE THAT ALTHOUGH THE FIRM(S)WILL BE REQUIRED TO ASSUME GENERATOR
STATUS,THIS ASSUMPTION WILL NOT RELIEVE COUNTY OF LIABIUTY FOR THE WASTE UNDER FEDERAL
LAW AND STATE LAW,AND COUNTY HEREBY RELEASES AND ACKNOWLEDGES FORT WORTH SHALL
NEVER ASSUME GENERATOR STATUS FOR ANY WASTE DELIVERED TO IT UNDER THIS AGREEMENT.
Fort Worth will arrange for recycling vendors for cardboard,televisions,tires,plastic,etc.
7.
DROP-OFF STATIONS HOURS AND DAYS
OF OPERATION
A. Hours of Operation
During the term of the Agreement,the DOS's hours of operation are as follows:
Monday-Friday 8:00 a.m.—6:00 p.m.
Saturday 8:00 a.m.--5:00 p.m.
B. Days the Drop-Off Stations(DOS)will be closed
During the term of the agreement,the DOS will be closed on the following holidays that are observed
on days the ECC would otherwise be open to the public:
New Year's Day
Martin Luther King Jr.Day
Thanksgiving holiday,Thursday and Friday

C. Notifying Residents
County agrees to notify its residents of the DOS's hours of operation and dates it will be closed. County
also may advertise the 24-hour Drop-Off Station telephone number:917-392-1234
B.
COMPENSATION
As fair compensation for the services provided by Fort Worth pursuant to this Agreement:
A. County agrees to pay Fort Worth the sum of$19.50 per"Type A"voucher(including brush,bulky waste,
bagged garbage,mixed items,recyclable materials and donated Items not to exceed 10 cubic yard limit)
per visit.

mirrors or paintings, glass windows or doors, patio umbrellas, small bookshelves, lamps, chairs, and
tables not to exceed 10 cubic yards.Single stream recyclables means acceptable materials such as clean
and dry paper items (newspaper, magazines, catalogs,junk mail cardboard boxes, chip-board, office
paper, and aseptic milk,juice and soup cartons); rinsed and empty plastic containers (#1 through#7,

bagged garbage, mixed items, recyclable materials and donated items not to exceed 10 cubic yard limit
and limited special waste materials)per visit.

IMMUNITY

It is expressly understood and agreed that,in the execution of this Agreement,none of the Participating Entities
waives, nor shall be hereby deemed to waive,any immunity or defense that would otherwise be available to it
against claims arising in the exercise of governmental powers and functions,and that the services described in
this Agreement are a governmental function.
10.
FORCE MAJEURE
A delay or failure of Fort Worth to perform services pursuant to this Agreement shall be excused to the extent
that the delay or failure to perform resulted from a force majeure event,and the delay or failure was beyond
the control of Fort Worth and not due to its fault or negligence. County shall not have,and hereby waives,any
claim whatever for any damages resulting from delays or failure to perform caused by a force majeure event.
12.
TERMINATION
The parties shall each have the right to terminate the Agreement for any reason,with or without cause, upon
forty five (45)days written notice to the other party. Upon termination,the parties shall be released from all
contractual obligations to the other party excluding "USE OF WASTE DISPOSAL/RECYCLING FIRMS BULK
MATERIAL, RECYCLED MATERIAL AND SPECIAL WASTE. And any terms and conditions arising from events
occurring during the term of the contract.
12.
ENTIRETY
This Agreement contains all commitments and Agreements of the parties hereto, and no other oral or written
commitments shall have any force or effect if not contained herein,except that this Agreement can be amended
or modified by the parties if such amendment or modification Is in writing and signed by County and Fort Worth.
13.
SEVERABILITY
In the event anyone or more of the provisions contained in this Agreement shall for any reason be held to be
invalid,illegal,or unenforceable in any respect,such invalidity,illegality,or unenforceability shall not affect any
other provision thereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable
provisions had never been contained herein.
14.
VENUE
Should any action,real or asserted,at law or in equity,arise out of the terms and conditions of this Agreement,
venue for said action shall be in Unincorporated Tarrant County,Texas.
15.
AUTHORITY
This Agreement is made for Fort Worth and County as an Interlocal Agreement, pursuant to Texas Government
Code,Chapter791.

16.
AUTHORIZATION
The undersigned officers and/or agents of the parties hereto are properly authorized officials and have the
necessary authority to execute this Agreement on behalf of the parties hereto,and each party hereby certifies
to the other that any necessary resolutions extending such authority have been duly passed and are now in full
force and effect.
17.
PAYMENTS
Each party to this Agreement will pay for performance of services from current revenues available to the paying
party.

Drop Off Station Voucher Partnership Proposal to provide Unincorporated Tarrant County resident's
access to the City of Fort Worth Drop-off Stations for disposal of excess solid waste, brush,
recyciables,acceptable donations and other specific materials through the use of a pre-issued
vouchers.

Project Objective
• Provide an estimate of cost to collect, consolidate, recycle, transport and dispose of materials
dropped off at the City of Fort Worth, Drop-Off Stations(DOS) by Unincorporated Tarrant County
residents.
Background
• DOS are open Monday- Friday, S a.m.-8 p.m. and Saturday, 8 a.m. -5 p.m.
• DOS personnel are trained to collect and consolidate brush, bulky waste, recyclable material and
began accepting household chemical waste in September 2017.
• Unincorporated Tarrant County currently has an intedocal agreement with the City of Fort Worth,
Environmental Collection Center to property dispose of its household hazardous waste.
• Superintendent Vazquez requested Supervisors Jacobo, Diaz and Johnson to provide a cost
comparison.This cost comparison would allow the Code Compliance Department to expand all DOS
services to include Unincorporated Tarrant County. The DOS would accept all materials allowed
based on the Tarrant County's final decision.

Draft Proposed Pricing is based on initial projected use of up to a total of 2,500 Type A and B vouchers per year and
would require additional evaluation for great annual use.
"The City of Fort Worth is recommending keeping the two(2)voucher programs(Drop Off Station and Environmental
Collection Center)separately through Fiscal Year 2019 and before evaluating the option to combine and allow

Drop Off Station Guidelines and Requirements
• Residents must present valid Driver's License and Issued Voucher at Drop Off Station Check in
station
• All loads must be covered, secured and/or tarp materials to prevent loose debris from failing out and
becoming litter or safety concerns during transit
• No dual axle trailers
• No vehicles or trailers can be labeled with commercial names or markings, except if renting a truck
from U-Haul, Home Depot or Lowes for transporting materials
• Specific items or materials that cannot be accepted: commercial or industrial based, ammunitions,
TCEQ specified hazardous, pharmaceutical medication, flammable gas cylinders, one (1) pound or
greater compressed gas cylinders.
Waste Identification, Costs and Payment Process
• The table below outlines the proposed payment procedures and timelines that will govem the process
allowing Unincorporated Tarrant County citizens to utilize this service. It is the opinion of the above
named supervisors that the existing City of Fort Worth voucher system be utilized for the drop off of

Authorize Execution of Interlocal Agreement with Tarrant County for Participation in the Fort Worth's Citizen Drop Off Station Program(ALL
COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of an Intertocal Agreement with Tarrant County for their participation in the Fort
Worth's Citizen Drop Off Station Program.
DISCUSSION:
The Fort Worth's Citizen Drop Off Station Program is now in its 14th year of operation and collecting excessive household bulk items,bagged
garbage,brush and storm debris,recyclables,reusable materials(donations),sensitive documents for shredding,household chemical waste and
other various items from the residents of Fort Worth.As a 2017-2037 Comprehensive Solid Waste Management Plan Action Item and supported
within the 2018 Matrix evaluation,this program was identified as an opportunity for better utilization through interlocal partnerships similar to the
Environmental Collection Center agreements.Therefore,City&Tarrant County staff developed the following"voucher-based"partnership program
to allow unincorporated Tarrant County residents to participate at each of the four(4)existing centers:Brennan,Southeast(MLK),Old Hemphill
and Hillshire. Upon executing the Interocal Agreement with the City of Fort Worth,unincorporated Tarrant County residents must obtain a Tarrant
County issued voucher directly from the Transportation Department and to be submitted during their visit to drop off the allowable materials.Two
different vouchers(Type A and Type B)are available based on type and volume of materials the unincorporated residents will be dropping off at
the centers.
The term for this Agreement will be for the remaining portion of Fiscal Year 2020 beginning upon the execution of the agreement. Tarrant County
approved the Agreement on December 10,2019. Annual renewals may be effective by mutual written agreement and does not require specific
City Council approval. For Fiscal Year 2020,the rate per voucher for the period covered by this Agreement is$19.50 per"Type A"and$32.50 per
"Type B"vouchers;these rates may be increased or decreased to meet program costs in future fiscal years. It is foreseeable that up to$61,750.00
may be collected annually under this agreement based on an anticipated allocation of vouchers being 60%"Type A"and 40%"Type B"for the
initial annual limit of 2,500 vouchers.
The Agreement outlines the responsibilities of each party,establishes the rates for participation,details procedures and acceptable materials by
voucher type,and delineates the usage of service marked public education materials.The City of Fort Worth is responsible for the overall
operation of each the Drop Off Stations;including contracting with disposal,recycling&reuse companies for transportation and disposal or
processing of all materials collected.The City will evaluate this partnership upon completing the initial year to determine if there are additional
benefits to the City and surrounding communities to incorporate additional communities.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Tarrant
County
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation and execution of the agreement,funds will be deposited into the
Solid Waste Fund. The Code Compliance Department(and Financial Management Services)is responsible for the collection and deposit of
funds due to the City and prior to any expense being incurred,the Code Compliance Department also has the responsibility to validate the
availability of funds.
