HomeMy WebLinkAboutContract 35294-A2 CITY SECRETARY CONTRACT NO.-35 2q .�Z AMENDMENT NO. 2 STATE OF TEXAS § CITY SECRETARY CONTRACT NO. § COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and ANA Consultants LLC ("Engineer") made and entered into City Secretary Contract No. 35294, (the "Contract") which was executed administratively by the City Manager on the 16th1h day of September, 2008 ; and WHEREAS, the Contract involves engineering services for the following project: Fossil Drive, Yolanda Drive, Meadowlane Terrace and Kings Oak Addition Areas Drainage Improvements, Project No.00485; WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C C-24522, adopted by the City Council on the 121h day of October 2010 and further amplified in a proposal letter dated July 21", 2010, copies of which are attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $79, 243 .00 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the contract, as amended, so that the total fee paid by the city for all work and services shall not exceed the sum of $312, 846.00. 3. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth,preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance,master planning,enhanced development review,and increased public education and outreach. On September 22, 2009, (Ordinance No. 18838-09-2009)the City Council approved the issuance and sale of$45,000,000.00 in revenue bonds for the Storm Water Capital Project Bond 09 Fund,to fund a two—year storm water capital project program. A Request for Qualifications (RFQ)to provide drainage design was issued by the City in January 2006. Twenty—four design consultants submitted statements of qualifications,including ANA Consultants,L.L.C. The project was initiated to provide a solution to the drainage issues located in the Fossil Drive,Yolanda Drive, Meadowlane Terrace and Kings Oak Addition areas. Issues include inadequate drainage along Fossil Drive,home flooding near the Yolanda Drive,Meadowlane Terrace intersection and home flooding south and east of the Kings Oak Addition. ANA Consultants,L.L.C.,was selected to study the drainage in the subject area and provide design services for drainage improvements for the Fossil Drive, Yolanda Drive,Meadowlane Terrace and Kings Oak Addition Areas Drainage Improvements (Project No.00483). On April 16, 2007,the City Manager executed administratively an agreement with ANA Consultants,L.L.C., in the amount of$24,800.00 to perform a conceptual drainage study for the above mentioned areas. It was anticipated that the study project would be expanded to a design project. On September 16, 2008,the City Council authorized the City Manager to execute Amendment No. 1 (M&C C-23053)to the agreement with ANA Consultants,L.L.C., (City Secretary Contract No. 37830)in the amount of$208,803.00.Amendment No. 1 included additional design for drainage and erosion control measures as recommended in the Fossil Drive,Yolanda Drive,Meadowlane Terrace and Kings Oak Addition Drainage System Improvements Study performed by ANA Consultants,L.L.C. During the design process,it was determined that different alignment alternatives could minimize construction costs. Also,work scope items that were not included in the original contract are now standard. The designs for two of the four locations in this project are close to completion, and it is advantageous to construct them as early as possible.Amendment No. 2 will provide the following: additional topographic survey, additional engineering alignment analysis and design,traffic control, and the preparation of two separate bid packages for the construction of the drainage improvements recommended. ANA Consultants,L.L.C.,proposes to perform the design services for a lump sum fee of$79,243.00. City staff considers the fee to be fair and reasonable for the scope of services proposed. ANA Consultants,L.L.C., is in compliance with the City's M/WBE Ordinance by committing to 21 percent M/WBE participation.The City's goal on the project is 18 percent. This project is located in COUNCIL DISTRICT 4,Mapsco 64A, 64T and 80B.
