HomeMy WebLinkAboutOrdinance 3709 1 t - � ORDINANCE N0. .57O AN ORDINANCE AMENDING SECTION 1, DEFINITIONS; AND PARAGRAPH 40, SECTION 13; OF ORDINANCE NO. 3ol3., BEING AN AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF FORT WORTH; PRESCRIBING A SAVINGS CLAUSE: PROVIDING A FINE OF NOT LESS THAN FIVE DOLLARS ($5.00) NOR MORE THAN.TffO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1. That SECTION 1, DEFINITIONS, of Ordinance No. 3031 be and the same is hereby amended by adding the following definition: TERMINAL, MOTOR FREIGHT: The use of property or buildings for the temporary parking of motor freight vehicles or trucks of common carriers, during loading and unloading and between trips, including necessary warehouse space for storage of transitory freight. Section 2. That Paragraph 40, Section 13 of Ordinance No. 3011 be, and the same is hereby amended, and after being amended it shall hereafter read as follows: 40. TER10MLL, MOTOR FREIGHT -- On approval of the Building Commissioner after a recommendation by the City Traffic Engineer and provided that such motor freight terminals shall meet the following requirements: a. A traffic flow plan approved by the City Traffic Engineer, based on an accurate plot plan drawn to scale. The applicant shall prepare and submit the plot plan to the City Traffic Engineer. b. Loading, parking, and maneuvering space shall be entirely on private property. c. The operation of any such motor freight terminal shall be not less than two hundred feet (2001) from an "A", "B", "C-R", "C" or "D" District. Section 3. Should any section, clause or provision of this ordinance be declared by the Court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. Section 4- AM person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Section 5, This ordinance will take effect and be in full force and effect from and after its passage and publication as required by law. T. A.
