HomeMy WebLinkAboutOrdinance 7309 ORDINANCE NO. y � AN ORDINANCE PROVIDING THAT THE 5200 BLOCK OF STANLEY AVENUE (ALSO KNOWN AS STANLEY DRIVE), AS SAME IS LOCATED FROM THE SOUTH LINE OF SOUTHCREST DRIVE SOUTHERLY AND EASTERLY TO THE WEST LINE OF JAMES AVENUE, AND ABUTTING BLOCKS 1 AND 2, SOUTHCREST ADDITION, BE VACATED, ABAN- DONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EF- FECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 5200 Block of Stanley Avenue (also known as Stanley Drive), being 50' in width, from the south line of Southcrest Drive southerly and easterly to the west line of James Avenue, as same abuts Blocks 1 and 2, Southcrest Addition, be and the same is hereby vacated, closed and abandoned as a public street and thoroughfare in the City of Fort Worth. SECTION 2. That the fee to the land in the above described 5200 Block of Stanley Avenue is hereby released and will revert to the adjacent owners as provided by law, save and except that easements are reserved for any and all existing utilities. SECTION 3. All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full s force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LLEGALITCY� S. G. Swift has requested on behalf of Ralph P. Sherman, owner of all WALLS abutting property, that the City vacate Stanley Avenue in the 5200 block a width of 50 feet from Southcrest Drive south and eastward to James Avenue LAKE abutting Blocks 1 and 2, Southcrest Addition. The requested vacation is shown on the attached map. Subject right-of-way, acquired by dedication, is neither paved nor open, and contains gas facilities. Reviewing City departments and private utility companies have no objections to this request provided: 1. A 15' utility easement be provided Lone Star Gas Company or satisfactory relocation arrangements made (since the Plan Commission decision, an instrument easement has been executed by the owner and accepted by Lone Star Gas Company in lieu of a platted easement) ; 2. The street is physically closed with standard curb and gutter at James Avenue, and at Southcrest Drive (when this street is improved) . (Agreement has been reached providing for curb and gutter on James Avenue and regular assessment paving on Southcrest Drive) ; 3. A 30' building line along the entire west line and along the south line adjacent to Lots 14-17 is shown on replat. (A satisfactory re- plat of the vacated right-of-way has been submitted to City Staff.) The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject right-of-way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right- of-way as recommended by the City Plan Commission.
