AN ORDINANCE AMENDING ARTICLE I AND SECTION 19-1
OF CHAPTER 19 OF THE CODE OF THE CITY OF FORT
WORTH (1964), AS AMENDED, BY SUBSTITUTING A NEW
ARTICLE AND SECTIONS THEREFOR ESTABLISHING AND
REGULATING A DEPARTMENT OF PUBLIC HEALTH, PRO-
VIDING FOR A DIRECTOR THEREOF TO BE APPOINTED
BY THE CITY MANAGER AND FIXING THE FUNCTIONS
AND DUTIES OF SAID DEPARTMENT AND ITS DIRECTOR;
AND NAMING AN EFFECTIVE DATE.
WHEREAS, on April 8, 1975, a majority of the elec-
torate of the City of Fort Worth voting in a Charter amend-
ment election found and determined that Sections 1 through
19, inclusive, of Chapter XV, Department of Public Health
and Welfare, of the Charter of the City of Fort Worth be
amended so that said chapter shall hereafter read and be
as follows:
"CHAPTER XV.
DEPARTMENT OF PUBLIC HEALTH
"The City Council shall provide by ordi-
nance for the establishment and regulation of
a Department of Public Health.";
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Article I and Section 19-1 of Chapter 19 of the
Code of the City of Fort Worth (1964), as amended, be and
the same is hereby amended so that same shall read and be
as follows:
"ARTICLE I.
DEPARTMENT OF PUBLIC HEALTH
"Sec. 19-1. Department Established. There
is hereby established a Department of Public
Health, which department shall be under the
supervision of the Director of the Department
of Public Health, who shall be subject to ap-
pointment and removal by the City Manager.
The salary of the Director of the Department
of Public Health shall be in accordance with
the compensation plan of the City. The Di-
rector shall be either a duly qualified and
licensed physician under the laws of the State
of Texas or a trained expert in public health
service. He shall devote his entire time to
the work of his department and shall be respon-
sible to the City Manager for the efficient
administration thereof. The Director shall be
authorized to appoint, employ and remove such
officers, assistants, employees and personnel
as he may deem necessary for the efficient ad-
ministration of the affairs of the department
and prescribe and fix their duties, scope of
authority and qualifications. All officers
and employees of the Department of Public
Health shall be governed by the same personnel
rules and classification and compensation plan
as is established for all other employees of
the City.
"Sec. 19-1A. General Powers of the Depart-
ment. The Department of Public Health shall
have supervision of all matters pertaining to
sanitary conditions in the City and to the health
of its inhabitants, as hereinafter provided.
"Sec. 19-lb. Fees. All fees collected by
the department shall be paid over to the City
Treasurer and deposited in the General Fund."
SECTION 2.
That this ordinance shall be in full force and effect
from and after the date of its passage, and it is so ordained.

On April 8, 1975, a majority of the electorate of the City of Fort Worth
BAILIFF voted in a Charter Amendment Election to amend Sections 1 through 19,
inclusive, of Chapter XV, Department of Public Health and Welfare, of
the City Charter.
Such amendment called for the Public Health Department to be regulated
by ordinance. Attached is an ordinance prepared ,by the City Attorney.
There are no substantive changes from the proposed ordinance previously
presented to the City Council on May 13, 1975.
Recommendation
It is recommended that the City Council approve the ordinance as prepared
by the' City Attorney.
