ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF Bi1RTON HILL ROAD
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION CF SAID
IMPROVEMENTS FULLY COMPLETED AND PERF010ED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS
MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST 3014E OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with TgxAs BTTuLTTgTc CokiPANY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:

known and designated as Unit 2, Project
No. 104-27000-160.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 6434 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 6434 a and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; .and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on'the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certifiactes has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage. A

DRIVE TO CITY LIMIT, to be improved with two-inch thick hot-mix asphaltic concrete pavement
on a five-inch thick cement stabilized gravel base on a six-inch thick lime stabilized
subgrade, with seven-inch high concrete curb and two-foot wide concrete gutter, so that
the finished roadway will be thirty-six feet wide, and by constructing six-inch thick
concrete driveways where specified.

Deviation from Bid Price: The final cost of this project is $6,474 less than
the revised contract price. This under-run was caused primarily by the fol-
lowing:
1) The need for no utility adjustment which resulted in a savings of
$1,500, and
2) The need for no metal pipe subdrain which resulted in a savings of
$4,500.
The remainder of this cost difference, $474, can be attributed to minor varia-
tions between quantities estimated in the contract documents and quantities
actually measured and used at the job site.

Compliance with Specifications
During testing on this project, 21 corings were made with the following
results:

On the entire project, the average thickness of the HMAC surface is 2.38 inches
as compared to the 2.00 inches specified, and the average thickness of the
cement stabilized base is 5.04 inches as compared to the 5.00 inches specified.
The average thickness of the lime stabilized sub-grade is 6.02 inches as com-
pared to the 6.00 inches specified. The area where initial coring revealed
that the paving thickness was "Below Tolerance", was an isolated area of only
71 square yards. The thickness deficiency in this area was not sufficient
to justify an overlay, therefore, a cash penalty was applied in accordance
with specifications. This penalty has been deducted from the amount of final
payment due. Tests made during construction show that materials used were in
compliance with contract specifications.
Recommendations
It is recommended that the project described above be accepted by the adoption
of an ordinance and that final payment of $3,697.85 be authorized to Texas
Bitulithic Company.
