ORDINANCE NO. to 001
AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
SOUTH HENDERSON
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS ; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE
CITY SECRETARY 10 GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION
OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE
COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY;
AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore or-
dered that each of the hereinafter described portions of streets, avenues and public
places in the City of Fort Worth, Texas, be improved by raising, grading and filling
same and by constructing thereon the following, to-wit:
Unit 1: South Henderson Street From Broadus Street to Seminary Drive,
known and designated as Unit 1, Project
No. 104-24000-181: to be improved by con-
structing a six-inch thick hot-mix asphal-
tic concrete pavement on a lime stabilized
subgrade, with seven-inch high reinforced
concrete curbs and two-foot wide reinforced
concrete gutters, and by reconstructing an
existing driveway to proper alignment and
grade, and by constructing five-inch thick
concrete sidewalks where specified, so that
the finished street will consist of one
thirty-foot wide roadway.
Unit 2: West Allen Street From Enderly Place to Eighth Avenue,
known and designated as Unit 2, Project
No. 104-24000-181: to be improved by recon-
structing existing sidewalk and curb and
gutter to proper alignment and grade where
specified, and by constructing a six-inch
thick hot-mix asphaltic concrete pavement
on a lime stabilized subgrade, with seven-
inch high reinforced concrete curbs and
two-foot wide reinforced concrete gutters,
on the south half of West Allen Street from
Enderly Place to the east line of Lot 1,
Block E2, Enderly Park Addition, and by con-
structing a six-inch thick concrete drive-
way, so that the finished street will con-
sist of one twenty-six foot wide roadway.
Unit 3: Bryan Avenue From Magnolia Avenue to Morphy Street,
known and designated as Unit 3, Project
No. 104-24000-181: to be improved by con-
structing a six-inch thick hot-mix asphal-
tic concrete pavement on a lime stabilized
subgrade, with seven-inch high reinforced
concrete curbs and two-foot wide reinforced
concrete gutters, and by reconstructing ex-
isting sidewalks and driveways to proper
alignment and grade where specified, and by
constricting five-inch thick concrete side-
walks and six-inch thick concrete driveways
where specified, so that the finished street
will consist of one thirty-foot wide roadway.
Unit 4: Fifth Avenue From Beddell Street to Gambrell Street,
known and designated as Unit 4, Project
No. 104-24000-181: to be improved by con-
structing a six-inch thick hot-mix asphal-
tic concrete pavement on a lime stabilized
subgrade, with seven-inch high reinforced
concrete curbs and two-foot wide reinforced
concrete gutters, and by reconstructing an
existing driveway to proper alignment and
grade, so that the finished street will
consist of one thirty-foot wide roadway.
Unit 5: Morphy Street From South Main Street to Crawford Street,
known and designated as Unit 5, Project
No. 104-24000-181: to be improved by con-
structing a six-inch thick hot-mix asphal-
tic concrete pavement on a lime stabilized
subgrade, with seven-inch high reinforced
concrete curbs and two-foot wide reinforced
concrete gutters, and bT reconstructing ex-
isting sidewalks and driveways to proper
alignment and grade where specified, and by
constructing five-inch thick concrete side-
walks and six-inch thick concrete driveways
where specified, so that the finished street
will consist of one thirty-foot wide roadway.
Unit 6: Baldwin Avenue From Broadus Street to Seminary Drive,
known and designated as Unit 6, Proj--ct
No. 104-24000-181: to be improved by con-
structing a six-inch t1iick hot-mix asphal-
tic concrete pavement on a lime stabilized
subgrade, with seven-inch high reinforced
concrete curbs and two-foot wide reinforced
concrete gutters, and by constructing five-
inch thick concrete sidewalks and six-inch
thick concrete driveways where specified,
so that the finished street will consist of
one thirty-foot wide roadway.
Unit 7: Baldwin Avenue From Seminary Drive to Flint Street, known
and designated as Untt 7, Project No. 104-
24000-181: to be improved by constructing
a six-inch thick hot-mix asphaltic concrete
pavement on a lime stabilized subgrade, with
seven-inch high reinforced concrete curbs
and two-foot wide reinforced concrete gut-
ters, and by reconstructing existing side-
walks and driveways to proper alignment and
grade where specified, and by constructing
six-inch thick concrete driveways where
specified, so that the finished street will
consist of one thirty-foot wide roadway.
Unit 8: Fuller Street From James Avenue to Stanley Avenue, known
and designated as Unit 8, Project No. 104-
24000-181: to be improved by constructing
a six-inch thick hot-mix asphaltic concrete
pavement on a lime stabilized subgrade,
with seven-inch high reinforced concrete
curbs and two-foot wide reinforced concrete
gutters, and by reconstructing existing
sidewalks to proper alignment and grade
where specified, and by constructing five-
inch thick concrete sidewalks where speci-
fied, so that the finished street will con-
sist of one thirty-foot wide roadway.
Unit 9: Joyce Drive From the North Line of Lot 12, Block 10,
Highland Homes Addition to U. S. Highway
80 West, known and designated as Unit 9,
Project No. 104-24000-181: to be improved
by constructing a six-inch thick hot-mix
asphaltic concrete pavement on a lime sta-
bilized subgrade, wi'. h a seven-inch high re-
inforced concrete curbs and two-foot wide
reinforced concrete gutters, and by con-
structing six-inch thick concrete drive-
ways where specified, so that the finished
street will consist of one forty-foot wide
roadway.
Unit 10: Sandage Avenue From the North Line of Lot S, Block 18,
to the North Line of Lot 4, Block 18,
Prospect Heights Addition, (East side of
street only) , known and designated as Unit
10, Project No. 104-24000-181: to be im-
proved by constructing a seven-inch high
reinforced concrete curb and a two-foot
wide reinforced concrete gutter, and by
constructing a six-inch thick concrete
driveway.
together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefor has been made and
entered into with SRO ASPHALT, INC. ;
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the
Public Works Director to prepare and file estimates of the cost of such improvements
and estimates of the amount per front foot proposed to be assessed against abutting
property and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
Unit 1: South Henderson Street From Broadus Street to Seminary Drive,
known and designated as Unit 1, Project
No. 104-24000-181.
The estimated cost of improvements is $ 9,406.10 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.90 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 5.53
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for 4 foot wide concrete sidewalk is $ 2.12 the estimated
amount per square foot to be assessed against abutting property and the owners there-
of for 6-inch thick concrete driveway is $ -0- per square foot; the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ 10.55 , plus the cost incurred for concrete driveway construction
where specified.

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places , as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 4th day of November , 19 68 , at 9:30 A.M.
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per-
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage. y

The estimated cost of improvements is $ 2,665.85 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.90 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 4.67 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for wide concrete sidewalk is $ -0- ; the esti-
mated amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .74 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the own-
ers thereof is $ 7.57 plus the cost i.ncurred for concrete driveway construction
where specified.

The estimated cost cf improvements is $ 12,179.20 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.90 ; the estimated amount per front foot to
be assessed against abutting property and the owners tiiereof for pavement is $ 5.53 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for 4 foot wide concrete sidewalk is $ 2.12 ; the esti-
mated amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .74 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the own-
ers thereof is $ 10.55 plus the cost incurred for concrete driveway con-

per front foot to be assessed against abutting property and the owners thereof for

assessed against abutting property and the owners thereof for pavement is $ 5.53 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for wide concrete sidewalk is $ -0- the esti-
mated amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ -0- per square foot; the total

The estimated cost of improvements is $ 13,319.35 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.90 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 5.53 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for 4 foot wide concrete sidewalk is $ 2.12 ; the esti-
mated amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .74 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the own-
ers thereof is $ 1055 plus the cost i.ncurred for concrete driveway construction
where specified.

Sidewalks are included on Units 1, 3, 5, 6 and 8 to divide and protect
pedestrian traffic from vehicular traffic and to tie in with existing side-
walks in the area.

Project Cost and Financing
Based on the low bid, approximately $48,741.68 will be assessed against-
abutting property owners. The cost to the City-at-large will be approximately
$49,291.42, including engineering. A bond fund transfer from Unspecified
Funds is proposed to provide for the City's portion of the cost of the project.
Request for Immediate Work Order, Units 1 and 6
The normal procedure on assessment paving projects is to award the construc-
tion contract; one month later hold the benefit hearing and then issue the
'work order.
Big Tex Building and Development Company entered into Community Facilities
Contract No. 5923 with the City of Fort Worth on December 22, 1967. This
contract provided for the assessment paving of South Henderson and Baldwin
Avanue as other property owners were involved. The apartment project is
complete and the final loan cannot be closed until the paving is complete.
Therefore it is proposed to issue a work order immediately on Units 1 and 6.

c) Directing the Public Works Department to prepare estimates

d) Awarding a contract to SRO Asphalt, Inc. in the amount of
$89,121.00;
e) Making appropriations to cover the indebtedness thereby incurred
for improvements of the project named above.
3) An ordinance be adopted:
a) Approving the estimates of cost and amounts proposed to

b) Setting November 4, 1968, as the date of the benefit hearing.
