I AN ORDINANCE DECLARING DEFECTIVE, UNSAFE OR HAZARDOUS SIDEWALKS, PARKWAYS, CURBS OR DRIVEWAYS A NUISANCE AND MAKING IT THE DUTY OF THE OWNER, HIS AGENT OR THE TENANT OF THE PROPERTY ALONG WNHICH A SIDEWALK, CURB OR DRIVE- WAY IS ORDERED BY THE DIRECTOR OF PUBLIC WORKS TO BC CONSTRUCTED, RECONSTRUCTED OR REPAIRED WITHIN THIRTY (30) DAYS OF RECEIPT OF NOTICE TO SO CONSTRUCT, RECON- STRUCT OR REPAIR SUCH SIDEWALK, CURB OR DRIVEWAY; MAK- ING THIS ORDINANCE CUZJLATIVE OF ALL OTHER ORDINANCES AFFECTING SIDEWALKS, PARKWAYS, DRIVEWAYS OR CURBS EXCEPT IN THOSE INSTANCES IN WHICH A CONFLICT EXISTS; PRESCRIB- ING A SAVINGS CLAUSE; PROVIDING FOR A FINE OF NOT LESS THAN FIVE DOLLARS ($5.00) AND NOT TO EXCEED TWO HUNDRED DOLLA&9 ($200.00) FOR THE VIOLATION HEREOF, AND MAKING EACH DATIS VIOLATION A DISTINCT AND SEPARATE OFFENSE AND PUNISHABLE AS SUCH; AND PROVIDING THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. Any sidewalk, parkway, driveway or curb which has become or is defective, unsafe or hazardous is hereby declared a nuisance. It shall be the duty of the owner or owner's or their agent in charge, or the tenant of the property abutting on any street, avenue, public alley, place, square, section, or part thereof along which a sidewalk, curb, or driveway is ordered by the Director of the Department of Public Works of the City of Fort Worth to be constructed, reconstructed or repaired within thirty (30) days from the receipt of notice from said Director to construct, re- construct or repair said sidewalk, curb or driveway; and the failure of any owner or owners, or the agent of any owner, or the tenant to construct, reconstruct or repair any such sidewalk, curb or driveway ordered to be constructed, reconstructed or repaired by the Director of the Department of Public Works shall be a misdemeanor and a violation hereof, SECTION II. That this ordinance shall be cumulative of all the provisions of any other ordinances of the City of Fort Worth relating to the re- gulation or installation of sidewalks, parkways, curbs or driveways except in those instances where the provisions of this ordinance are in direct conflict with such provisions, in which instance said con- flicting provisions are expressly repealed. SECTION III. Any person, firm or corporation who violates any of the pro- visions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by fine of not less than Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00). Each day during which a violation continues shall be a separate offense• In case of a violation of any of the terms or provisions of this ordi- nance by any corporation, the officers and agents actively in charge of the premises regulated hereunder shall be subject to the penalty herein provided for. SECTION IV. If any section, part of a section or provision of any section of this ordinance shall be held to be void, ineffective or unconstitutional by a court of competent jurisdiction, the holding of such section, part of a section, or provision of any section to be void, ineffective or unconsti- tutional for any cause whatsoever shall in no way affect the validity of the remaining sections and provisions of this ordinance, which shall remain in full force and effect. The Council would not have passed any sections, parts of sections or provisions of any sections that were unconstitutional, void or ineffective if they had known that they were unconstitutional, void or ineffective at the time of adopting this ordinance. SECTION V. This ordinance shall take effect and be in fall force from and after the date of its passage and publication as required by law.
