HomeMy WebLinkAboutOrdinance 17558-05-2007Ordinance No. 17558-OS-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECTS FUND IN THE AMOUNT OF $123,950 FROM GAS WELL BONUS REVENUES FOR THE PURPOSE OF EXECUTING A PROFESSIONAL SERVICES AGREEMENT WITH ECOLOGICAL COMMUNICATIONS CORPORATION FOR ENVIRONMENTAL MASTER PLANNING OF THE TANDY HILLS AND STRATFORD PARK NATURAL AREA; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Park Gas Lease Projects Fund in the amount of $123,950 from Gas Well Bonus Revenues for the purpose of executing a Professional Services Agreement with Ecological Communications Corporation for environmental master planning of the Tandy Hills and Stratford Park Natural Area. SECTION 2. That-should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances.where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $123,950.00 in the Park Gas Lease Project Fund from the Gas Well Bonus Revenues for Tandy Hills Park; and 2. Authorize the City Manager to execute a professional services agreement with Ecological Communications Corporation (ECOMM) in the amount of $118,950.00 for environmental master planning of Tandy Hills Park. DISCUSSION: On April 26, 2005, (M&C G-14767) the City Council adopted a policy for the distribution of revenues received from gas well leases on City property. In accordance with that policy, bonus revenue assigned to the Parks and Community Services Department (PACs) is designated for the relevant gas leased park site. On March 21, 2006, Informal Report No. 8751 was presented to City Council outlining the PACS's plan for the expenditure of funds, of which $199,749.67 was earmarked for a detailed study that would result in the creation of a conservation master plan for Tandy Hills Park. PACs staff solicited proposals from firms specializing in natural resource management planning and selected Ecological Communications Corporation (ECOMM) to provide such services. The master planning effort will include a site assessment of existing natural resources and, with staff and neighborhood input, develop recommendations for a long term site conservation management plan, identify environmental site improvement methods, and implement measures for site improvements and operational costs necessary to sustain the management plan. The proposed agreement for these services is in the amount of $118,950.00 with an additional $5,000.00 appropriated for PACs administrative salaries, together totaling $123,950.00. ECOMM is in compliance to the City of Fort Worth's MNVBE Ordinance by committing 40 percent participation. The City's goal on this project is 40 percent.
