ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF LONG AVENUE EXTENSION AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION CF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOIL OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with TEXAS BITULITHIC COMPANY for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: LONG AVENUE EXTENSION: FROM NORTHWEST 34th STREET TO ELLIS AVENUE, KNOWN AND DESIGNATED AS UNIT NO. 3, PROJECT 094-23000-104, A 7-INCH REINFORCED CONCRETE PAVEMENT ON A 64- FOOT ROADWAY. PRAIRIE AVENUE: FROM LONG AVENUE TO ANGLE AVENUE, KNOWN AND DESIGNATED AS UNIT NO. 1, PROJECT 094-22000-101, A 7-INCH REINFORCED CONCRETE PAVEMENT ON A 40-FOOT ROADWAY. ANGIE AVENUE: FROM COLUMBUS AVENUE TO PRAIRIE AVENUE, KNOWN AND DESIGNATED AS UNIT NO. 2, PROJECT 094-22000-lol, A 7-INCH REINFORCED CONCRETE PAVEMENT ON A VARIABLE 45 TO 64-FooT ROADWAY. WHEREAS, by sundry proceedings heretofore.passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 5253 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Forth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial ,justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5253 _, and WHEHEA3, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TIMREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: Its. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tsar Assessor-Collector as .part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort !North, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. PAGE NUMBER 1/24/66 FP-301 From 34th to Ellis Ave., Project Nos. 2 j of Compliance with Specifications Attached is a tabulation of paving cores showing compliance with specifications within construction tolerance, except in the areas of cores No. 1232, 1246, 1280 and 1313. The total area of de- ficiency was 171 square yards or 0.34 per cent of the 50,399 total square yards on this project for a penalty amounting to $56.46. Depth testing of the west lane of the north bound roadway in two locations on Angle Avenue, indicated a 1,450 square yard area was deficient an average of 0.54 inches. The 12.5 foot wide lane was removed and replaced for the length of the deficiency. Attached are tabulations of cores 1900 through 1905 showing compliance with specifications within construction tolerances. During testing on the project, 250 corings were made, with the results shown on the table below. The corings include six made in the replaced concrete in the west lane of the north bound traffic on Angle Avenue, but not the 36 corings made to isolate the deficiency which was removed and replaced.
