AN ORDINANCE RELEASING TERRITORY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF FORT WORTH; MAKING THIS ORDINANCE CUMULATIVE; PRESCRIBING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. The City of Fort Worth hereby relinquishes all extraterritorial 3uri'sulctional authority over the following described territory under the provisions of the Municipal Annexation Act, Article 970a Vernon's Texas Civil Statutes said tract of land being described by metes and bounds as follows: BEING a tract of land about 12 miles northeast from the Court House of Tarrant County, Texas, lying in the J. Edmonds Survey and being more fully described as follows: BEGINNING at a point in the present City Limit line of the City of Keller, said point being the southwest corner of the W. J. Holland Survey, Abstract #692; THENCE south, along the west line of the W. J. Holland Survey Abstract #692 produced south, to its intersection with the north line of Tract 5 of the J. Edmonds Survey Abstract #457; THENCE west, along the north line of Tract 5 of the J. Edmonds Survey Abstract #457, to its intersection with the east right-of-way line of U.S. Highway 377; THENCE north and northeast, along the east and southeast right-df-way line of U. S. Highway 377, to its intersection with the present City Limit line of the City of Keller, the west line of the W. J. Holland Survey; THENCE south, along the present City Limit line of the City of Keller, the west line of the W. J. Holland Survey, to the place of beginning and containing approximately .03 square miles. SECTION 2. That this ordinance shall and does hereby amend every prior ordin- ance in conflict herewith, but as to all other ordinances or sections of ordin- ances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3. If any section, subsection or provision of this ordinance shall be held inval d or unconstitutional by a court of competent jurisdiction, that portion so held to be invalid or unconstitutional shall not affect the validity of any other part of the ordinance, which shall remain in full force and effect. SECTION 4. That this ordinance shall become effective and shall be in full force an—d-effect from and after its passage, and it is so ordained. Passed and adopted this 9,7_day of , 1964. Scalel"-4000 FT. ` ae mY City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Extraterr i for i a l Jurisdiction PAGE NUMBER .7/27/64 PZ-109 Apportionment a City of Keller IOf I In response to requests by the City of Keller, negotiations have been conducted between representatives of Fort Worth and Keller for the purpose of apportioning the overlapping territorial jurisdictions of the two municipalities in accordance with the provisions of the Municipal Annexation Act of 1963. Attached is a map of Keller and surrounding area showing the proposed apportion- ment of the area where the overlapping jurisdiction exists. Keller agrees to release its jurisdiction over 2,722. 12 acres, which is approximately 80 per cent of the existing overlapping area. Fort Worth would release 684.75 acres of its jurisdiction to Keller. The presently Tncorporated area of fart Worth would not be affected by the proposed agreement. On July 8, 1964, the City Plan Commission considered the proposed apportionment, and adopted the following recommendations unanimously: 1) That ordinances be adopted apportioning the extraterritorial jurisdiction with the City of Keller as proposed, and, 2) That the City Plan Commission be authorized to review proposed apportionment agreements with surrounding communities on a systematic basis in accordance with general policies theft the City Council may wish to establish including the consideration of protective annexations in areas reteased by other municipalities in connection with the apportionment of extraterritorial jur-indiction.
