HomeMy WebLinkAboutOrdinance 3110 ORDINANCE NO.3uo An Ordinance Pertaining to the Furnishing of Metro- politan Area Telephone Service by Southwestern Bell Telephone Company; Establishing Certain Rates, Charges and Practices Pertaining to the Service and Continuing in Effect Certain Ordinances Heretofore Ordained. WHEREAS, the Southwestern Bell Telephone Company has presented plans to the City Council for a new Metropolitan Area Tele- phone Service Plan, which provides for the establishment of the Fort Worth Metropolitan Exchange and the furnishing of a broadened scope of telephone service known as extended area service, all as more fully set out and described in Exhibits "A" and "B" which are attached here- to and made a part hereof; and WHEREAS, according to telephone engineers, the extended area service plan will permit the Telephone Company to design the most economical and efficient telephone plant to serve the Fort Worth Metro- politan Area, which will promote orderly and rapid telephone growth and usage, thereby benefiting Fort Worth customers in knitting more closely together the commercial and social activities of the people of Fort Worth and adjoining communities served by this Company; and WHEREAS, said extended area service plan will enable Fort Worth telephone users to call directly any telephone in the Arlington ex- change without the payment of message charges, and will also enable all telephone users in Arlington to call any telephone in the Fort Worth J � exchange directly without message charges as soon as facilities can be made available; and WHEREAS, said plan will mean a substantial saving to Fort Worth Telephone customers who have occasion to make frequent calls to the Arlington exchange, and will encourage additional calls of both a business and social nature between Arlington and Fort Worth tele- phone customers; and WHEREAS, said plan provides that message charges will con- tinue to apply between non-contiguous exchanges as shown in the table included in the description of the extended area service offering, described in said Exhibits "A" and "B"; and WHEREAS, it appears that the placing in effect of said extended area service plan contemplates no change in the basic schedule of rates now in effect in Fart Worth, and that no customers in Fort Worth not now pay- ing mileage charges will be required to pay mileage charges, and further, that the base rate area will be extended from time to time as development warrants; consequently, said plan will provide substantial benefits in the form of savings and improved telephone service; and WHEREAS, similar plans are in use in other Metropolitans centers, such as New York, Baltimore, Los Angeles, Atlanta, San Francisco, St. Louis and Dallas, and it is the sense of this City Council the initiation of the Metropolitan Area Service Plan is in the best interest of the citizens of Fart Worth. - 2 � Y � NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1: Upon initiation of the Metropolitan Area Telephone Service Plan Southwestern Bell Telephone Company is authorized to place in effect those rates, charges, rules and regulations hereinbefore set out in Exhibits "A" and "B" pertaining to the furnishing of extended area service within the City of Fort Worth. Section 2: Ordinance No. 2586 passed September 15, 1948, Ordinance No. 2211 passed August 2, 1944, Ordinance No. 1931 passed December 23, 1936, and Ordinance No. 2925 passed January 30, 1952, and Ordinance No. 3085 passed June 10, 1953, shall remain in full force and effect except as any particular provision of any of them may conflict with the provisions hereof; as to any such conflict, the terms hereof shall prevail and the conflicting provisions of said Ordinances 2586, 2211, 1931, 2925 and 3085 shall be suspended. Should the Metropolitan Area Service Plan or any part thereof be discontinued at any time, those of said ordinances pertaining to service or area involved in such discontinuance shall thereupon revert to their original form and content. Section 3: Neither the passage of this ordinance nor anything in this ordinance contained shall be construed now or hereafter as limiting, modifying or in anywise surrendering in. any manner, or to any degree, the right and power of the City under the law to regulate the' service, rates - 3 - and charges of Southwestern Bell Telephone Company.
