HomeMy WebLinkAboutOrdinance 7410 + r ORDINANCE NO. ? 4-10 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUN- DARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF 899.9 ACRES (1.406 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVI- LEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PRO- VIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 31st day of July, 1976, which date is not more than twenty (20) nor less then ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 15th day of July, 1976, which date was not more than twenty (20) nor less than ten (10) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas was in excess of 367,000 inhabitants on January 1, 1963 and in excess of 400,000 inhabitants on January 1, 1976, and WHEREAS, the corporate area of the City of Fort Worth, Texas was 152.580 square miles on January 1, 1963 and was 238.134 square miles on January 1, 1976, and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and - 1 - WHEREAS, the hereinafter described territory contains 899.9 acres (1.406 square miles) of land, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boun- dary limits of the City of Fort Worth, Texas, and the present boun- dary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: Being 899.9 acres (1.406 square miles) of land situated in the J. McHorse Survey, Abstract No. 1087; the J. D. Farmer Survey, Abstract No. 1978; the Nathaniel Holbrook Survey, Abstract No. 647 and the C. K. Gleason Survey, Abstract No. 559 in Tarrant County, Texas, about 11 miles westerly from the Tarrant County Court- house, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth City limit line, the North- east corner of the J. McHorse Survey, Abstract No. 1087 and the Northwest corner of the Abraham Stallions Survey, Abstract No. 1396. THENCE South No Degrees - 26 Minutes East, along and with the Fort Worth City limit line and along and with the West line of the B.B.B. & C. Railroad Company Survey, Abstract No. 219, and along and with the East lines of the said McHorse, Farmer and Holbrook Surveys, 6,568.6 feet to a point for corner in the South line of said Holbrook Survey and the North line of said Gleason Survey, said point also being in the North right-of-way line of Old Weatherford Road (County Road No. 1022) . THENCE continuing along and with the present Fort Worth City limit line, South 13 Degrees -03 Minutes - 04 Seconds East 958.79 feet to a point for corner in the West right- of-way line of Chaplin School Road (County Road No. 1041) . THENCE continuing along and with the present Fort Worth City limit line and along and with the West right-of-way line of Chaplin School Road (County Road No. 1041) , South No - 2 - Degrees - 56 Minutes West 2,450.0 feet and South No Degrees - 40 Minutes West 96.9 feet to a point for corner in the South right-of-way line of Old Weatherford-Chaplin Road (County Road No. 1029). THENCE North 89 Degrees - 21 Minutes West along and with the South right-of-way line of County Road No. 1029 a distance of 1,866.24 feet to a point for corner, THENCE North No Degrees - 11 Minutes West 3,434.27 feet to a point for corner in the South right-of-way line of Old Weatherford Road (County Road No. 1022). THENCE along and with the South right-of- way line of County Road No. 1022, North 89 Degrees - 09 Minutes West 2,993.4 feet and North 89 Degrees - 53 Minutes West 1,200.17 feet to a point for corner. THENCE North No Degrees - 24 Minutes East 5,066-35 feet to a point for corner in the North line of the Nathaniel Holbrook Survey. THENCE South 89 Degrees - 27 Minutes East, along and with the North line of the N. Hol- brook Survey, 1,200.2 feet, and South 89 Degrees - 18 Minutes East 2,612.3 feet to a point for corner in the West line of the J. McHorse Survey. THENCE North No Degrees - 26 Minutes West, along and with the West line of the McHorse Survey, 1,537.3 feet to a point for its Northwest corner, in the present Fort Worth City limit line. THENCE South 89 Degrees - 37 Minutes - 10 Seconds East, along and with the North line of the McHorse Survey and along and with the Fort Worth City limit line to the PLACE OF BEGINNING, and containing 899.9 acres (1.406 square miles) of land. SECTION 2. That the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regu- lations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or - 3 - sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such unconsti- tutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. Johndroe, Jr. , City Attorney Passed and approved this the 16th day of August 1976. - 4 City of Fort Worth, Texas I Mayor and Council Communication DATE REFERENCE SUBJECT: Annexation - Westpoint PAGE NUMBER 7/12/76 PZ-742 Iof 2 Request Westpoint Development Corporation, the owner and developer of "Westpoint Addition", has requested that the Council annex 896.403 acres (1.4 square miles) of land under its involuntary annexation powers. A copy of -the letter request is attached. Location The site requested for annexation is located west of Loop 820, north of I-20 and south of Tejas Trails Addition in the western portion of Tarrant County, about 11 miles westerly from the Courthouse, as shown on the attached map. Jurisdiction The site is adjacent and contiguous to the Fort Worth city limits on the east and on the north and is within Fort Worth's exclusive extraterritorial jurisdiction and not subject to annexation by any other city. There are no known boundary conflicts and no boundary agreements with other cities would be required. This annexation would leave 19.7 square miles available for involuntary annexation in the remainder of calendar year 1976. District Plan The site lies within the confines of District 0. Except for the industrial zoning which was requested in the concept plan for the business and commer- cial area, the concept plan is generally in accord with the provisions of the District 0 Plan. Concern by the Plan Commission for this departure from the Plan was alleviated by the developer's stated intent to file deed restric- tions with each final plat and to provide landscape buffers to insure compati- bility with proposed adjoining residential development. Project Scope The attached concept plan for this development was approved by the City Plan Commission on May 26, 1976. According to information furnished by the developer the 896 acre tract requested to be annexed plus an adjoining 415 acre tract already within the city limits is planned to be fully developed in 8 to 10 years. At ultimate development, the project is expected to have a population of 15,692 in 4,990 dwelling units. The developer estimates that the cost benefit ratio will be favorable to the city by a factor of 1.47 to 1 at full development. Staff feels this is an optimistic analysis. DATE REFERENCE SUBJECT: Annexation - Westpoint PAGE NUMBER 7/12/76 PZ-742 2 of 2 City Departments City operating departments indicate an ability to serve the area but at higher than normal costs due to its isolated location away from existing major service facilities such as ,water and sewer. Additional funds would need to be budgeted to install the necessary facilities and to serve the development on a continuing basis, otherwise the existing level of service to areas already within the city limits would have to be further reduced. Plan Commission The City Plan Commission at its regular meeting on June 30, 1976, recom- mended- annexation for the following reasons: 1. The cost benefit ratio appears to be favorable to the City; 2. Plan Commission revised and approved the Concept Plan for the development; 3. The staff information report which was reviewed by the Develop- ment Review Committee offered no objections to the requested annexation. 4. Approximately 1/3 (415 acres) of the total land to be developed (1,311) is already within the city limits. Recommendation It is recommended that the Council adopt the recommendation of the Plan Commission and initiate proceedings to annex the area as recommended on the attached City Council Annexation Timetable schedule beginning on July 12, 1976, with final annexation to be on September 13, 1976.
